Dear Ms. Urquhart:
Please reference the As-Built Report, dated August 20 14 , and the Annual Monitoring Report
(Year 1), dated February 2015, for the Anderson Farm Mitigation Bank. Also , reference the
Mitigation Plan for the Anderson Farm Mitigation Bank and our s ubsequent acceptance letter of
the final s igned mitigation banking ins trument (MBI) entitled the "Agreement to Estab li s h the
Anderson Farm Stream Mitigation Bank in Buncombe County, North Caro lina" da ted June 25,
2013 , and rev ised February 21,2014. This plan proposed enhancement and restoration to
approximately 3,455 linear feet of s tream channels gene rating approx im ately 3,822 stream
mitigation units (SMU's). The As-Bu ilt Report documents the completed construction of s tream
channel re storation/enhancement activities on the site . Due to changes in constructed length, the
As-Bui lt Report details the adjustments to th e total stream length res tored/enhanced and
th erefore the total SMU's generated by thi s project. The adjusted figures were reduced by 25
SMU's and would generate a total of3,688 SMU's.
We have reviewed the submitted plan s and determined that the propo sed credit releas es are in
accordance with guideline s set forth in the MBI, the Interagency Stream Mitigation Guidelines
(April 2003) and the recently publi s hed federal rule entitl ed Compensatory Mitigation for Losses
of Aquatic Resources (33 CFR Part 332). Based upon the information submitted in the se reports
and observations made during our January 29,20 15 , site visit, we authorize the rel ease of89 1.9
SMU 's to be incorporated into th e Bank and used for future compensatory mitigation . This cred it
rel ease wi ll reflect the subtraction of23.9 credits due to overestimation of total credits in the
mitigation plan and thereby authorized in th e initial credit release as detailed in the As-Built
