Dear Ms. Reutter:
The Wilmington Regional Office of the Division of Energy, Mineral and Land Resources received a complete
permit transfer application and a permit modification regarding the Stormwater Management Permit for
Landfall Clubhouse.
TRANSFER
On June 16, 2016, the Division accepted a request to transfer the subject stormwater management permit to the
Country Club of Landfall. Certain compliance issues were identified in the June 8, 2016 inspection report. It
was later discovered that the pond that was inspected on June 8, 2016 was not the permitted facility. The
facility was reinspected on February 20, 2018 and except for some minor slope erosion issues, the pond was
determined to be in compliance and the permit was transferred to the Country Club of Landfall on February 23,
2018.
MODIFICATION
On February 26, 2018, the Division accepted a modified State Stormwater Management Permit Application for
Landfall Clubhouse. The application was made complete on June 14, 2018. Staff review of the plans and
specifications has determined that the modified project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000 effective January 1, 2017. We are forwarding modified
Permit No. SW8 950506 dated June 27, 2018, for the construction, operation and maintenance of the
stormwater control measures (SCMs), built -upon areas, and the stormwater collection system and/or vegetated
conveyance system associated with the subject project. Please add the attached plans to the previously
approved plan set. Please also replace the previous application (SWU-101), wet pond supplement form and
0&M agreement with the attached modified versions.
The following modifications are included and covered by this permit: The addition of 3137 sf of net gain built -
upon area for the construction of the Dining Terrace expansion at the back of the Clubhouse. This permit shall
be effective from the date of issuance until September 10, 2020 and shall be subject to the conditions and
limitations as specified therein, and does not supersede any other agency permit that may be required. Please
pay special attention to the permit conditions regarding the operation and maintenance of the SCMs,
stormwater collection system, and/or vegetated conveyances; the limitation of built -upon area; recordation of
deed restrictions and protective covenants; modification of the project; the procedures for changing ownership
of and/or transferring the permit; and the need to renew the permit. Failure to comply with these requirements
will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adj udicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH).
The written petition must conform to Chapter 150B of the North Carolina General Statutes and must be filed
with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH with all questions
regarding the filing fee (if a filing fee is required) and/or the details of the filing process at 6714 Mail Service

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of one (1) wet detention pond ("stormwater control measure"
or "SCM") in compliance with the provisions of Title 15A NCAC 2H .1000 effective January 1, 2017
(the "stormwater rules") and the approved stormwater management plans, application, supplement(s),
specifications, and other supporting data (the "approved plans and specifications") as attached and/or
on file with and approved by the Division of Energy, Mineral and Land Resources (the "Division" or
"DEMLR") and considered an enforceable part of this permit.
This permit shall be effective from the date of issuance until September 10, 2020, and shall be subject
to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the management and volume of stormwater
described in the -approved plans and specifications. The maximum amount of built -upon area
(BUA) allowed for the entire project is 450,502 square feet.
2. The drainage area for the on -site stormwater control measure will be limited to the amount of
built -upon area indicated in this permit and the approved plans and specifications. The runoff
from all built -upon area within the permitted drainage area of this project must be directed into
the permitted stormwater control measure. The stormwater control measure has been designed
using the runoff treatment method to handle the runoff volume from a maximum of 450,502
square feet of impervious area. This permit does not provide any allocation of built -upon area for
future development.
3. The drainage area of the permitted SCM includes 10 lots off Sun Runner Place, each allowed
50% of the lot area as built -upon area (total lot impervious of 189,640 ft2); the clubhouse project,
including buildings, cart paths, sidewalks, and parking at a total of 204,754 ft2; and Sun Runner
Place Extension at 56,108 ft2.
4. Approved .plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.

II. SCHEDULE OF COMPLIANCE
The project's built -upon area and SCM shall be constructed, operated and maintained in
accordance with the conditions of this permit and the approved plans and specifications.
2. The on -site stormwater system shall be entirely constructed, vegetated, and operational prior to
the construction of any development within the drainage area, per the approved plans and
specifications.
3. During construction of the project, erosion shall be kept to a minimum and any eroded areas of
the on -site stormwater system will be repaired immediately. If the stormwater system is used as
an Erosion Control device, it must be restored to design condition prior to operation as a
stormwater treatment device, and prior to occupancy of the facility.
4. All stormwater control measures, stormwater collection systems, vegetated conveyance
systems, and/or maintenance accesses must be located in public rights -of -way, dedicated
common areas that extend to the nearest public right-of-way, and/or permanent recorded
easements that extend to the nearest public right-of-way for the purpose of inspection,
operation, maintenance, and repair.
5. The permittee shall provide and perform the operation and maintenance necessary, as listed in
the signed Operation and Maintenance Agreement, to assure that all components of the
permitted on -site stormwater system functions at the approved design condition. The approved
Operation and Maintenance Agreement is incorporated by reference into this permit and must
be followed in its entirety and maintenance must occur at the scheduled intervals.
6. Records of maintenance activities must be kept and made available upon request to authorized
personnel of the Division. The records will indicate the date, activity, name of person performing
the work and what actions were taken.
7. The permittee is responsible for verifying that the proposed built -upon area for the entire project
does not exceed the maximum allowed by this permit.

8. Upon completion of the project, the permittee shall determine whether or not the project is in
compliance with the permitted plans and take the necessary following actions:
a. If the permittee determines that the project is in compliance with the permitted plans,
then within 45 days of completion, the permittee shall cause the completed and signed
Designer's Certification to be submitted noting that the modifications approved by this
permit have been completed in accordance with the approved plans and specifications.
Any noted deviations may require additional approval from the Division;
b. If the permittee determines that the project is not in compliance with the permitted plans,
the permittee shall either submit an application to modify the permit within 30 days of
completion of the project or provide a plan of action, with a timeline, to bring the site into
compliance.
9. Prior to the construction of any modification to any aspect of the approved plans, the permittee
shall submit to the Director, and shall have received approval for modified plans, specifications,
and calculations including, but not limited to, those listed below:
a. Any modification of the approved stormwater control measures, built -upon area, details,
etc.
In Redesign or addition to the approved amount of built -upon area or to the drainage area.
c. Further development, subdivision, acquisition, lease or sale of any, all or part of the project
area as reported in the approved plans and specifications.
d. Altering, modifying, removing, relocating, redirecting, regrading or resizing of any
component of the approved stormwater control measure, stormwater collection system
and/or vegetative conveyance system shown on the approved plan.
e. The construction of any allocated future BUA.
f. The construction of any permeable pavement, #57 stone area, public trail, or landscaping
material for BUA credit that was not included in the approved plans and specifications.
g. Any other modification as determined by the Director.
10. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee
shall submit a written time schedule to the Director for modifying the site to meet minimum
requirements. The permittee shall provide copies of modified plans and certification in writing to
the Director that the changes have been made.
11 The permittee shall assure that the following deed restriction statements are recorded such that
they apply to all ten (10) of the existing Sun Runner Court lots within the drainage area of this
pond:
a. The built -upon area is limited to a maximum of 50% of the lot area.
b. Built -upon area includes that portion of the right-of-way between the lot line and the edge of
pavement, structures, pavement, walkways of brick, stone, or slate, but not including open
wood decking_
c. The covenants pertaining to stormwater regulations may not be changed or deleted without
concurrence of the State.
d. Alteration of the drainage as shown on the approved plan may not take place without the
concurrence of the State.
e. All runoff on the lot must drain into the permitted system. This may be accomplished through
providing roof drain gutters which drain to the street, grading the lot to drain toward the
street, or grading perimeter swales and directing them into the pond or street. Lots that
naturally drain into the system are not required to provide these measures.
12. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the
date of recording the plat. The recorded copy must be signed by the Permittee, dated, stamped
with the deed book number and page, and bear the stamp/signature of the Register of Deeds.
13. If a decorative spray fountain is desired, the permittee shall submit documentation to
demonstrate that the fountain will not resuspend sediment or cause erosion in the pond.
III. GENERAL CONDITIONS
The facilities shall be constructed in accordance with the conditions of this permit, the approved
plans and specifications, and other supporting data as attached to this permit and on file with the
Division.

2. Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the requirements of the stormwater rules is subject to enforcement action
as set forth in NCGS 143 Article 21.
3. The permit is not transferable to any person or entity except after notice to and approval by the
Director. The permittee shall submit a completed and signed Name/Ownership Change Form,
accompanied by the supporting documentation as listed on the form, to the Division of Energy,
Mineral and Land Resources at least 60 days prior to any one or more of the following events:
a. An ownership change including the sale or conveyance of the project area in whole or in
part,
b. Bankruptcy;
c. Foreclosure, subject to the requirements of Session Law 2013-121
d. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS
57D-6-07;
4. The permittee shall submit a Permit Update Form to the Division within 30 days of any one or
more of the following events:
a. A name change of the current permittee;
b. A name change of the project;
c. A mailing address change of the permittee.
5. The permittee is responsible for compliance with all terms and conditions of this permit until the
Division approves the transfer request. Neither the sale of the project, in whole or in part, nor
the conveyance of common area to a third party constitutes an approved transfer of the permit.
6. The permittee grants Division Staff permission to enter the property during normal business
hours to inspect the built -upon areas and the SCM's associated with the permitted project.
7. The permit issued shall continue in force and effect until the permittee files a request with the
Division for a permit modification, transfer, renewal, or rescission; however; these actions do not
stay any permit conditions.
8. Approved plans, application documents, supplements, calculations, operation and maintenance
agreement, and specifications for this project are incorporated by reference and are enforceable
parts of the permit. A copy of this permit, application, supplements, operation and maintenance
agreement, and approved plans and specifications shall be, maintained on file by the permittee.
9. Unless specified elsewhere, permanent seeding requirements for the on -site stormwater system
must follow the guidelines established in the North Carolina Erosion and Sediment Control
Planning and Design Manual.
10. The issuance of this permit does not prohibit the Director from reopening and modifying the
permit, revoking and reissuing the permit, or terminating the permit for cause as allowed by the
laws, rules; and regulations contained in Title 15A NCAC 2H.1000 and NCGS 143-215.1 et.al.
11. A permit renewal request must be submitted at least 180 days prior to the expiration date of this
permit. The renewal request must include the appropriate application, documentation and the
processing fee as outlined in Title 15A NCAC 02H.1045(3).

VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and
Land Resources (DEMLR). A complete package includes all of the items listed below. A detailed application
instruction sheet and BMP checklists are available from
http://portal.ncdenr.org/web/wq/ws/su/statesw/forms_docs. The complete application package should be
submitted to the appropriate DEMLR Office. (The appropriate office may be found by locating project on the

For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and

forms docs. Download the latest versions for each submittal.
In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded.

protective covenants for this project, if required, shall include all the items required in the permit and listed
on the forms available on the website, that the covenants will be binding on all parties and persons claiming

Met Detention Pond Maintenance Requirements
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the vegetated filter if
one is provided.
Important maintenance procedures:
_ Immediately after the wet detention basin is established, the plants on the vegetated shelf and perimeter of the
basin should be watered twice weekly if needed, until the plants become established (commonly six weeks).
No portion of the wet detention pond should be fertilized after the first initial fertilization that is required to
establish the plants on the vegetated shelf.
Stable groundcover should be maintained in the drainage area to reduce the sediment load to the wet detention
basin.
If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through the
- emergency drain should be minimized to the maximum extent practical.
- Once a year, a dam safety expert should inspect the embankment.
After the wet detention pond is established, it should be inspected once a month and within 24 hours after every storm event

A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.

5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

In response to your comments:
1. The supplement lists the minimum required volume as 6586 cubic feet, which is
incorrect. The 1998 permit required a minimum of 25080 cubic feet, and the recent BUA
additions (@1.5") will add another 373 cubic feet, for a grand total of 25453 cubic feet.
Response: Supplement minimum required volume has been changed to 25453 cf
2. The elevations reported on the supplement for permanent pool and temporary pool are
the same, 11. The supplement rounds to the nearest whole number, which is most
inconvenient since we deal in tenths and hundredths, at times. Please overwrite the
numbers and enter the correct elevations.

3. The depth of sediment storage is incorrectly marked as N/A on the supplement. Per the
1998 O&M document, sediment had to be removed when the sediment had accumulated

elevation (5.15 + 1.375) = 6.525. Please report 16.5 inches on the supplement as the
depth of sediment storage.

1. Per NCAC 02H.1003(3)(d), the built -upon area that is in excess of the originally permitted
447365 sf maximum for the project, is subject to the 2017 rules, and the associated volume of
that excess BUA must be accounted for at 1.5". The originally permitted 447365 sf of BUA stays
at the 1" design storm (via SCS method). The resulting total minimum volume is still less than
the volume provided in the pond, but the design volume calculations need to be corrected.
Response: 1.5" rainfall was used in the volume calculations for all new BUA more than the original
permitted amount. Changes can be seen in the Stormwater Routing Calculations
2. Please provide anew wet pond supplement form to reflect the proposed changes in BUA,
SA/DA, minimum volume, etc. There was no supplement form in use in 1995, so you may use

GENERAL
The Country Club of Landfall will be re -modeling their clubhouse by making
improvements to the dining and other interior areas as well as their outdoor
amenities. Such outdoor amenities will include new terraces and decks, fire pits and
reconfigured sidewalk.
EXISTING SITE
The Country Club of Landfall is an existing facility with clubhouse amenities typical for
an upscale golf club. Site development includes the clubhouse, a pro shop and golf
cart barn with associated. parking. Stormwater runoff is treated by a wet detention
pond adjacent to this facility which was initially permitted in September 1998 (permit
# SW8 950506).
PROPOSED IMPROVEMENTS
Site improvements will include new terraces and deck, fire pits and reconfigured
sidewalk.
STORMWATER INFORMATION
Proposed additional Built Upon Area (BUA) is 4685 SF. Credits for BUA total 1548 SF
for a net BUA increase of 3137 SF. No off -site impervious area is proposed.

Flow from additional impervious areas will be channeled to the detention pond
through roof and yard drains tied to the existing stormwater conveyance system.
A major stormwater permit modification is required based on the net BUA increase.
We have analyzed the proposed site improvements using the original stormwater
detention pond calculations from the DEQ permit file for this facility and determined
that no additional treatment or volume is required. Attached to this narrative are the
original calculations with redline markups indicating the updated calculations based
on these proposed improvements. 1.5 inch rainfall is used for all proposed BUA.
Criser Troutman Tanner (CTT) Consulting Engineers does not certify the original
stormwater system design. We have only endeavored to analyze the proposed
improvements of this project with respect to the original design and certify the
amended calculations that we have performed and provided herein, including those
calculations indicated in red in the attached report.
EROSION CONTROL INFORMATION
The proposed work will disturb less than one (1) acre, so a Land Quality permit is not
required. We are coordinating this project with New Hanover County and will provide
them with a submittal for policy review only, per their request.

Inspection Summary:
The Division received a request to transfer this permit to the Landfall Country Club back on June 16, 2016. The project
had been inspected on June 8, 2016 and determined to be Out of compliance. The Division received only a few of the
items in response to the inspection report on June 15, 2017, and on August 11, 2017, additional information was
requested again. The Division did not get a response, so on January 8, 2018, the August 2017 email was resent and it
was then discovered that the Division had inspected the wrong pond. The engineer was granted a time extension of a few
extra weeks to complete any necessary maintenance. Arrangements were then made for the Division to reinspect the
pond on February 20, 2018.
Except for some minor maintenance issues, the project is currently in compliance with the permit and can be
transferred.
The project was certified on April 6, 1998.
The 10 lots located off Sun Runner Place are limited to a maximum BUA that equates to 50% of their lot area, for a total
of 189,640 square feet.
Sun Runner Place has been accounted for at 56,108 square feet.
A deed conveying the clubhouse property to Landfall Country Club has been recorded in DB2568 at Pg 0722.

Comment: 1. The pond slopes have that characteristic "shelf' where the water level rise and fall over the vears has
created a nearly vertical slope between the permanent pool and the temporary pool elevations. You will
want to restore the 3:1 slope to that area.
2. Turtles have been getting into the 2" diameter orifices and getting stuck, and clogging them up.
Consider adding a screen in front of the orifice openings to keep the turtles out.

Improvements are complete and the pond should be ready for your inspection. Interestingly we did locate four 2-inch
orifices even though the permit indicated that there should only be three orifices. The contractor is plugging one of the
holes today.
Please let us know when you might be on site as Landfall is ready to start building the improvements on the clubhouse. I
believe that Georgette Scott is reviewing the submittal for that work.

think I see what happened. I agree with you that the pond area which is "downstream" of the timber
headwall appears to be the permitted pond. The original plans were approved on July 25, 1995, but
then a revision to the clubhouse area was approved in 2006. Since the 2006 approved plans only
showed the upstream pond's headwall, not the downstream pond, I thought the pond I saw on the
2006 plan was the right one. I am very sorry for this mix-up.
I'll probably need to reinspect as soon as I can to keep the transfer moving forward. To make this
process as short as possible, please inspect the project yourself and address any deficiencies that
you see before I go out there so I only have to go out there once. Landfall inspections are a bit more
convenient for me since I live nearby and can make an inspection right after my lunch, if my meeting
schedule allows.

Club of Landfall. The transfer application was received in June 2016, but the inspection revealed a

GENERAL
The Country Club of Landfall will be re -modeling their clubhouse by making
improvements to the dining and other interior areas as well as their outdoor
amenities. Such outdoor amenities will include new terraces and deck, fire pits and
reconfigured sidewalk.
EXISTING SITE
The Country Club of Landfall is an existing facility with clubhouse amenities typical for
an upscale golf club. Site development includes the clubhouse, a pro shop and golf
cart barn with associated parking. Stormwater runoff is treated by a wet detention
pond adjacent to this facility which was initially permitted in September 1998 (permit
# SW8 950506).
PROPOSED IMPROVEMENTS
Site improvements will include new terraces and deck, fire pits and reconfigured
sidewalk.

Proposed additional Built Upon Area (BUA) is 4685 SF. Credits for BUA total 1548 SF
for a net BUA increase of 3137 SF. No off -site impervious area is proposed.

Flow from additional impervious areas will be channeled to the detention pond
through roof and yard drains tied to the existing stormwater conveyance system.
A major stormwater permit modification is required based on the net BUA increase.
We have analyzed the proposed site improvements using the original stormwater
detention pond calculations from the DEQ permit file for this facility and determined
that no additional treatment or volume is required. Attached to this narrative are the
original calculations with redline markups indicating the updated calculations based
on these proposed improvements. Criser Troutman Tanner (CTT) Consulting
Engineers does not certify the original stormwater system design. We have only
endcuvored to analyze the proposed improvements of this pr sect with respect to the
original design and certify the amended calculations that we have performed and
provided herein, including those calculations indicated in red in the attached report.
EROSION CONTROL INFORMATION
The proposed work will disturb less than one (1) acre, so a Land Quality permit is not
required. We are coordinating this project with New Hanover County and will provide
them with a submittal for policy review only, per their request.

Grantor, in consideration of the sum of One Dollar (51.00) and other valuable

1. This conveyance is made subject to all existing rights -of -way, restricily
and casements of record in and to the Property, all easements, rights and licenses previously
conveyed by Grantor in and to the Property and to all easements and rights -of -way shown on the

Grantor and/or The Landfall Council of Associations, Inc., and all contracts and contract

2. This conveyance is subject to all governmental regulations, including but
not limited to environmental, zoning, subdivision, building and land use statutes, ordinances and
regulations and all permits and permit conditions of any federal, state or local entity.
3. Grantee shall continuously operate and use the Property as golf courses,
tennis and recreational facilities. Grantee shall not use the property for any other uses except
sports and social uses normally and historically associated with golf courses, tennis, sports aril
country clubs. Without the written consent of Grantor, its successors or assigns, the Property
shall not be conveyed to any person or entity other than an entity comprised of former Existing
Members, non-Membcr owners and Associate members pursuant to the terms of the Purchase
and Sale Agreement for the Sale of Landfall Club dated September 25, 1998 between the Grantor
and Grantee. if the property is conveyed this entity shall own and maintain the Property as

Notwithstanding the foregoing, Grantee may convey portions of the Property to adjoining
properly owners at no cost, other than costs and fees incurred for engineering, surveying and
legal services, which portions arc non -essential to the operation and use of the Property for the
purposes sated in this covenant, and which portions must become and be combined with existing
platted Landfall subdivision lots and be conveyed subject to the appropriate Landfall restrictive
covenants which shall encumber the combined properties.
4. Grantee, at Grantee's expense, shall continuously maintain, repair and
preserve the Property, all casements and casement areas, and all improvements thereto described
in this deed to standards which are consistent with the Landfall development.
5. In the event the Grantor joint venture is no longer in existence at the time
any breach of the provisions of 3 and/or 4 above occurs and Grantor has not expressly transferred
in writing its rights under this instrument. The Landfall Council of Associations, Inc. and all
Landfall property owners associations shall have the right to enforce the provisions of such
paragraph. The restrictions and covenants contained herein shall exist for a period of twenty (20)
years from the date of this deed.
G. The Property is, and is conveyed and shall be held, used and maintained
subject to the Declaration of Annexation Subjecting Special Use Property to Master Cross -
Access Easement and Maintenance Agreement (Country Club Project) recorded in Book -Ta
Page 7� of the New Hanover County Registry and the Master Cross-Acccss Easement and
Maintenance Agreement dated October 22, 1990 and recorded in Book 1515, Page 1583, New
I lanover County Registry, as amended (the "Master Easement"), subject to all casements, rights
and licenses of all persons and entities as provided in the Master Easement, and subject to the
provisions of the Delegation of Powers and Authority dated March 16, 1992 and recorded in
Book 1594, Page 1476, New Hanover County Registry, as amended (the "Delegation").
7. Grantor hereby reserves unto itself, its successors and assigns, tenants,
partners, employees, agents, contractors, guests and invitees (including prospective purchasers),
al! of the casements, rights and licenses established, conveyed, granted and created for the benefit
of Grantor pursuant to the Master Easement and/or the Delegation.
8. Grantor also reserves unto itself, its successors and assigns, a nonexclusive
casement, right and license to discharge, drain and divert surface waters from property owned by

9. Grantor for itself, its successors and assigns, reserves and excepts here

10. Except as conveyed to Grantee and identified in Exhibit B, Grantor hereby
reserves unto itself, its successors and assigns and exempts and excepts from this conveyance all
casements, access ways, rights -of -way or the equivalent as shown, described or depicted on any
recorded maps of the Property (Tracts) herein conveyed which easements, access ways, rights -of -
way or the equivalent are identified for (a) access, installation and maintenance of drainage
facilities, ponds, lakes, and other bodies of water including creeks, ditches and swails, including
but not limited to those identified as Storm Drainage Easements, Storm Drainage and
Maintenance Easements, Access Easements for Pond Maintenance, Storm Drainage and
Maintenance Casement over Pond and Maintenance Easements, Storm Drainage and Utility
Easement and oiher similar titles, and (b) installation and maintenance of utility services
including wells, water, water lines, sewer, sewer lines, lift stations sites, lift station access
casement, utility casements, access easements for well maintenance, water utility and well
casements.
11. This conveyance is further subject to the rights of any parties having rights
therein to discharge water in existing drainage lines or ditches, creeks, ponds and/or lakes in the

property conveyed and to the ownership rights and rights of use of all persons and entities in and
to that area of the property which is comprised of ponds, lakes, creeks, natural area and other
water bodies and water courses and to usage rights to any of the above described water bodies or
natural areas which may be "common areas" for the benefit of surrounding properties..
12. This conveyance is subject to those certain covenants, conditions and
agreements contained in Section 6.7 Real P Issues as set forth in the Purchase and Sale
Agreement for the sale of Landfall Club dated September 25, 1998 between Grantor, Grantee and
The Acquisition Committee, Inc., a North Carolina corporation. Specifically included herein is
the reservation by Grantor in association with its ownership of and development of properties
within the Landfall Subdivision of the right to grant easements, dedications, agreements,
licenses, including grants to the City of Wilmington, County of New Hanover, or other
govcmmcntal district or entity, restrictions, reservations, covenants and rights -of -way over the
Property conveyed herein and to make minor adjustments to boundary lines of the property
herein conveyed due to plat or survey inconsistencies, which adjustments will not materially
affect the use of the real property and facilities herein conveyed for the existing or intended uses
or materially diminish the value or appearance of the real property or the facilities. Provided
Grantee is given prior consultation, Grantee agrees by acceptance of this conveyance to execute
and deliver documents and instruments which are reasonably necessary to accomplish the
provisions of this reservation.
13. Grantor does hereby reserve and retain for itself, its successors and assigns
and the various Landfall associations as appropriate and The Landfall Council of Associations,
Inc., a perpetual non-exclusive easement over, across, through and under all portions of real
property conveyed and the facilities located thereon for all purposes reasonably necessary for the
development, maintenance and repair of lots, drainage facilities and common areas within the
Landfall Subdivision.
14. Grantor reserves all rights to access to the Property conveyed herein and
the facilities located thereon as set forth in the Purchase and Sale Agreement for the sale of
Landfall Club dated September 25, 1998 by and between Grantor, Grantee and The Acquisition
Committee, Inc., a North Carolina corporation.
15. The easements reserved by and/or granted by Grantor herein and the
restrictions and covenants set forth herein shall be appurtenant to and run with the Property and
all adjacent property now or hereafter owned by Grantor, and shall bind and inure to the benefit
of the parties hereto and their respective successors and assigns, forever. Such successors and
assigns of Grantor shall include but arc not limited to The Landfall Council of Associations, Inc.,
and all Landfall property owners associations established to own and/or maintain common areas
with the Landfall development.
TO HAVE AND TO (TOLD the aforesaid tract of land and all privileges and
appurtenances thercunto belonging to Grantee, its successors and assigns, subject to the
reservations, restrictions and all other matters set out in this deed.
The Grantor covenants with the Grantee that the Grantor has done nothing to
impair such title as the Grantor received, and the Grantor will warrant and defend the title against
the lawful claims of all persons claiming by, under or through the Grantor, subject however to
those exceptions, reservations and conditions as set forth herein.

Are you referring to the pond at the Clubhouse? That pond was permitted under SW8 950506 and
has 3-2" diameter orifices located within the spillway wall at an invert elevation of 10.65 that draw the
pond down to its permanent pool elevation. The difference between the permitted permanent pool
elevation (10.65) and the temporary pool elevation (11.0) is very little, so the lake level should not
fluctuate too much unless there's been too much rain or not enough rain.
If you are referring to plugging those small diameter orifices, then no, you are not allowed to do that. I
think my previous inspection report (August 2, 2016, attached) for that pond included my observation
that the spillway wall itself appeared to be leaking. If the leaks were fixed, I believe the water level
might stay a bit more consistent, but that really depends on what Mother Nature has in store.
You could consider modifying the permit by submitting an application proposing to raise the elevation
of the top of the spillway (which acts as the temporary pool) and/or the invert elevations of the small
orifice pipes. I don't know if that will help, but it might. It's been my experience that trying to regulate
the water level in a pond to be more "consistent" so the pond looks "prettier" is usually a conflict with
the rules and is probably going to be a losing battle.

addressing their BUA recording errors, but never finished up. Tidalholm SW8 940804 .. The
Tidalholm HOA, Inc. has not submitted their signed transfer form. The other HOA (Tidalholm Village
HOA) submitted their signed form back in December 2016, but the Tidalholm HOA has not. And,
Innkeeper of Wilmington 960215 has not responded. It's an offsite permit, but that owner is
essentially using a pond that he is not permitted for.

I am reviewing the revised plan for the Landfall Clubhouse submitted on June 15, 2017. The revised
plan was submitted in response to the August 2016 inspection report. The inspection was conducted
as part of the pending transfer of this permit to the Country Club of Landfall. 1 have the following
comments:
1. The proposed plan will need to replace the currently approved plan, but the Country Club of
Landfall does not currently own the permit and cannot request to revise this plan. If the
Country Club of Landfall will agree to address that issue later, then we can postpone the
review and approval of the revised plan until after the County Club gets the transferred
permit. If the Country Club wants the revised plan approved first, then please submit an
application for a minor modification signed by the Landfall Subdivision II Owners Association
and provide a second copy of the proposed plan. Once the new plan is approved, then we can
continue on with the transfer of the permit, pending resolution of the remaining items from the
August 2016 inspection.
2. The August 2016 Notice of Inspection included an observation that the weir headwall was
leaking. What has been done to repair those leaks and to ensure that the only way runoff is
drawn down is via the three permitted 2" diameter orifices?
3. Has anything been determined about the additional pipe that I observed entering downstream
of the headwall, but which was not shown on the approved plan? It was unclear if this was an
active pipe, or one that had been "abandoned in place" during the last expansion project. The
concern is of course, that runoff is being collected from permitted impervious areas and is
being directly discharged to surface waters without treatment.

Criser Troutman Tanner Consulting Engineers (CTT) has been engaged to assist in responding to your
August 2, 2016 letter concerning the above referenced project.
CTT has specifically looked at Deficiency No. 4 as stated in your letter —"The 2006 approved plan
revision to add the Pro Shop required the removal of certain areas of built -upon area to maintain the
overall BUA at the same amount or less. These areas that were supposed to be removed have not
been removed, and more BUA has been added without benefit of a plan revision or permit
modification."
CTT elected to have Geolnnovation, PC survey the area in question and compared the existing site
plan impervious areas prior to the 2006 additions/modifications and compared the record survey
impervious areas.

The area calculations indicate that the impervious areas as construction are actually 664 square feet
less than the existing site plan.
The April 6, 2006 letter to Mr. S. Keith Cooper from Robert Gordon indicated that the approved plans
would result in a decrease of impervious area of 470 square feet. The site as constructed actually
provides a decrease of 664 square feet or some 194 square feet more. The site meets the
impervious area allowance.

On June 16, 2016, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) met with Steve Hughes and Sandy Slocum with the Landfall Council of
Associations regarding several projects, including the Landfall Clubhouse, located at 800 Sun Runner
Place in Wilmington, New Hanover County. The Division received a request to transfer permit SW8
950506 from Landfall Subdivision II Owners Association during the June 16, 2016 meeting. This project
was inspected after the meeting to determine the status of compliance with the State Stormwater
Management Permit Number SW8 950506 renewed and reissued on May 12, 2016. DEMLR file review
and site inspection revealed that the site is currently not in compliance with the terms and conditions of
this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached
to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
L The presence of algae in the pond suggests either excessive fertilization or shallow water. Please
limit the use of fertilizer within the drainage area and assure that the pond depth is maintained at
5.5 feet or greater.
2. The headwall is leaking. Please repair the leaks to provide assurance that the design storm is
drawn down through just the three permitted 2" diameter orifices.
3. An extra pipe is entering the pond after the headwall. The origin of this pipe is unknown. This
pipe must either be removed or rerouted into the- pond for treatment.
4. The 2006 approved plan revision to add the Pro Shop required the removal of certain areas of
built -upon area to maintain the overall BUA at the same amount or less. These areas that were
supposed to be removed have not been removed, and more BUA has been added without benefit
of a plan revision or permit modification.
Please be advised that until you receive approval from the Division to transfer the permit, you are
required to comply with the terms, conditions and limitations of the Stormwater Management Permit
under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-
214.7, including the operation and maintenance of the permitted stormwater system.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a
timeline to resolve the identified deficiencies, by October 2, 2016, are considered violations of the
permit. If the requested information is not submitted to this office by the due date, then DEMLR staff
will re -inspect the site and may issue a Notice of Violation. Please also note that any individual or entity
found to be in noncompliance with the provisions of a stormwater management permit or the stormwater
rules is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of
civil penalties of up to $25,000 per day.

Thanks for yesterday. It was very informative for me. Based on our discussion, I have a few things
for your consideration:
None of the June 3, 2016 transfer requests have been received. These were for SW8 910212
(Pembroke Jones Maintenance Facility) and SW8 890917 (Muirfield). We've looked everywhere. All
the incoming mail from that date and a bit beyond, has already been processed. You'll need to
resubmit those requests using the 4-page Name/Ownership Change form. Our current mailing
address is 127 Cardinal Drive Ext. Wilmington, 28403. Please do NOT send any permit transfer
requests to Raleigh.
SW8 970633 Horseshoe Island Block 46
We had emailed about this project on March 22, 2016 and March 28, 2016. You were under the
impression that a transfer of ownership had been approved by the Division in 1998, but it turned out
that we did not receive the April 6, 1998 letter from Keith Cooper requesting that the permit be
transferred. My subsequent reply email on April 27, 2016 indicated that since we never got the
original request, and it was 20 years old, we would need to get a new form signed (the 4-pager). The
permit is currently in the name of Landfall Associates.
SW8 880908 Pembroke Jones Park Phases 1 B and 2A
There is no certification of compliance in the file. Based on the correspondence in the file, it appears
that in early September, 1988, the Division (then known as the Division of Environmental
Management or DEM) sent a letter to New Hanover County Water & Sewer asking them to provide
confirmation that these phases of Pembroke Jones Park had an approved stormwater management
plan so that the Division could issue the nondischarge sewer permit. It was later determined that the
Division could issue the sewer permit if Jim Craig provided confirmation that no modifications to the
December 10, 1987 approved SEC plan were needed. Since I cannot find a certification of
compliance in the file, I believe Mr. Craig must have provided that confirmation, so we should be able
to change the regulated activity from high density to "not subject" or "exempt". You don't need to do
anything for this.
SW8 950506 Landfall Clubhouse - Inspection
The pond looks fine, a bit of algae floating along the perimeter, but otherwise fine. The built -upon
area, however, is not quite as per the approved plan. I will detail the issues I found in my report and
send you a copy. The transfer request you gave me on 6/16/16 is being processed for review.
SW9 910212 Pembroke Jones Maintenance Facility
This is the facility on South Moorings Drive (now Deer Island). As suspected, the permitted pond was
expanded for 980605 Landfall SD II as Pond #2. Based on the information in the file, the BUA
associated with the maintenance facility was taken into account when Pond #2 was designed for
980605. For this one, I think we would accept a request to modify the regulated activity from high
density to offsite. Then we would accept a request to transfer the offsite permit to whatever entity you
choose. Current permit is issued to Landfall Associates. The offsite permit has no "maintenance"
component other than the catch basins and piping within the designated facility itself and maintaining
compliance with the BUA limit. Not all of the 910212 BUA was accounted for in 980605. The 910212
permit allowed for a 9 acre drainage area, and 4.61 acres of BUA (200,811 sf) which included 2.75
acres of future development at 40% impervious (47,916 sf). but only 147,000 sf was included in the
980605 permit, and that was intended to cover "Blocks 36/37 and the Nicklaus Facility". We may
need to try to pin down how much BUA is actually draining into Pond #2 from the maintenance facility
as part of the change in regulated activity. Based on Google images, there might be some slight
changes in the layout that may also need to be accounted for. It looks like a separate smaller building
or shed roof was added over the existing parking spaces on the west side of the larger building and
there might be some extra BUA on the east side of the building.
SW8 960506 Amsbury
