All previous references to DWQ or its predecessor, the Division of Environmental Management (DEM), will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that the addendum to this renewed permit will now reference DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal Application for Landfall Clubhouse on March 28, 2016. The Division is hereby notifying you that permit SW8 950506 has been renewed on May 12, 2016, and shall be effective until September 10, 2020. The renewal and reissuance of this stormwater permit does not imply that the site is currently in compliance with the terms and conditions of this state stormwater permit. The revised plans approved on April 6, 2006, will remain in full force and effect in accordance with the regulations set forth in Title 15A NCAC 21-1.1000 effective September 1, 1995. Please attach this cover letter and permit addendum to your High Density Permit last issued on September 10, 1998. This permit is subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, and the procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. Landfall Clubhouse 800 Sunrunner Place, Wilmington, New Hanover County FOR THE construction, operation and maintenance of one (1) wet detention pond in compliance with the provisions of 15A NCAC 2H .1000 (hereafter the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Energy, Mineral and Land Resources (hereafter the Division or DEMLR) and considered an enforceable part of this permit. The permit is hereby renewed subject to the following addendums, clarifications, conditions and limitations: 1. The original permit conditions contained in the permit issued on September 10, 1998 remain in full force and effect, except as amended herein. (An additional copy of this original permit can be obtained from the Division, Wilmington Regional Office.) 2. This permit shall be effective from the date of issuance until September 10, 2020. 3. The permittee shall submit a permit renewal application request at least 180 days prior to the expiration date of this permit. The renewal request must include the applicable documentation and the processing fee. 4. Decorative spray fountains are allowed in a wet detention pond, subject to the following criteria: a. The permanent pool volume is a minimum of 30,00 cubic feet. The calculations did not include the permanent pool volume, so if a fountain is desired, those calculations must first be provided to the Division. b. The fountain must draw its water from less than 2' below the permanent pool surface. c. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. d. The falling water from the fountain must be centered in the pond, away from the shoreline. e. The maximum horsepower for a fountain in this pond is n/a horsepower. 5. If,the use of permeable pavement for BUA credit is desired, this permit must be modified to add the permeable pavement conditions. 6. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement action as set forth in NCGS 143 Article 21. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121; e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D-6-07; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee. I was researching a complaint about piping of a swale from a Mr. John Homestead at 720 Autumn Crest Place and discovered that this permit expired in 2012 and needs to be renewed as soon as possible. The Division sent a letter to Landfall Subdivision II Owners Association, dated September 2, 2011, (attached) to remind the permittee of the need to renew. To date, we have not received the renewal application. Landfall Subdivision II Owners Association is currently discharging stormwater to surface waters without a valid permit, which is a violation of NCGS 143 Article 21 subject to a fine of up to $25,000. Please take a moment to download, complete, sign and submit the renewal application form available from our website and submit it along with the required $505.00 renewal application fee. Please submit the required renewal application by March 31, 2016, to avoid enforcement action. Please forward this email to the correct person, if you are not in charge of handling permit renewals. It appears that there are two separate projects going on at the Nicklaus Clubhouse, one is yours for the berm at the practice area, and one is ESP's for the addition of a Pro Shop at the clubhouse itself. ESP has not responded to our request for an application propbably because the letter we sent was copied to you instead of to them. I'm going to send a new letter to Landfallc copied to ESP, requesting an application for the Pro Shop addition. As far as the berm is concerned, that project was exempted on June 27, 2006, and the exemption applies only to that activity. Future land -disturbing activities will need to be submitted for separate exemption under the same permit number.
