The Division of Water Resources (DWR) has reviewed the above - referenced document, dated February 2015. Our
comments are as follows:
• Regulatory Consideration and Potential Constraints - FEMA /Hydrologic Trespass: DWR has concerns
regarding the statement on Page 14 of the Draft Mitigation Plan which states the appropriate measures were
taken to avoid hydrologic trespass of the adjacent land area. Please provide additional information as to
what measures were taken or will be taken to address this concern.
• Executive Summary and Wetland Restoration Summary: As stated during the previous Prospectus review,
DWR has concerns regarding the usage of permanent grade control structure(s) installation at the
downstream end of the sloughs to control water elevation on the site. Please provide additional information
as to why a permanent grade control structures are required. The DWR discourages the use of permanent
structures (e.g. earthen berms and water controls structures) to achieve and maintain site hydrology.
• DWR recommends soil ripping due to the historical agricultural land usage of the majority of the proposed
project area.
