I agree with all of them and I certainly agree that they are reasonable "conditions" prior to releasing water. I spoke with others in my office and they confirmed that the Corps has, on a case- by-case basis, allowed water release into mitigation channels prior to full veg cover. However, they also agreed that the issues you mentioned should be addressed/corrected prior to doing so. My only suggestion is that, once they have fulfilled the "conditions" below, that they request a field visit and/or send documentation pictures prior to getting our explicit approval. They obviously need to dewater the most downstream portion or the mitigation site and reseed matted area; * The channel structure you pointed out needs to be leveled so that flow is maintained within the center of the structure; and, * Upstream erosion and sediment erosion control measures need to be improved to reduce downstream turbidity and potential sediment discharges. I will coordinate with Barry and Jerry, but drainage ditches and slopes near the Huffine Mill Road area (hill slopes, drainage channels, V-ditch, etc) all need to be shored up in some way (core fiber matted, mulched, permanently seeded). Let me know what else you might add to improve the situation. I think it is within reason to request the above work prior to returning the stream to its new channel.
