Dear Ms. Kim:
Ten civil penalties were assessed against IT and K Enterprise, Inc. by the N.C.
Department of Environment and Natural Resources, Division of Water Quality, on March 24,
2010, June 2, 2010, March 2, 2011, August 25, 2011, October 31, 2011,November 3, 2011,
November 8, 2011, and November 21, 2011. Please find attached a list of the civil penalties. On
August 28,2012,a Consent and Settlement Agreement was entered whereby IT and K
Enterprise, Inc. agreed to pay the settled amount of five thousand dollars ($5,000.00) for the
penalties in twelve (12) installments within a specified timeframe. As of the date of this letter, no
payments have been received. Therefore, due to the default provisions of the settlement
agreement, the outstanding balance of the original penalties, twenty-five thousand two hundred
ninety-two dollars and seventy cents($25,292.70), which includes accrued interest,remains due
and owing.
In order to avoid the filing of a civil action against IT and K Enterprise Inc.,the civil
penalty assessments must be paid. Payment should be made by check or money order payable to
"N.C. Department of Environment and Natural Resources"or"NCDENR", and sent to my
attention at the above address. If payment is not made within ten(10) days of receipt of this •
letter, the State will file a legal action in McDowell County Superior Court to collect the civil
penalties, plus court costs, and interest at the legal rate.
