This letter is in response to your email dated February 5, 2015. Below are the following
responses. Plepse also refer to the response email I sent on February 5, 2015 answering some
of your concerns.

additional wetlands impacts.
3. Please find enclosed the front page of the permit form that has been revised to show a
NWP-14.
4. Please find enclosed a Credit Reservation letter from the Northeast Camp Fear Umbrella
Mitigation Bank for stream and wetland mitigation credits. Also please find enclosed an
acceptance letter from NCEEP for the remainder of stream credits not available at the
mitigation bank,

6. An easement will be show on the final plat for future owners to not allow for additional
impacts.

Pursuant to your recent ema:i| transmittal dated February 24(2015), the Northeast Cape Fear Umbrella
Mitigation Bank (Bank) is providing preliminary acceptance to supply mitigation credits for impacts to
jurisdictional wetlands and streams associated with the Reserve at Island Creek Project (conditional
upon receipt ofpayment as outlined below). Please refer to the tab]* below depicting the type and
quantity of credits requested and reserved for your project.

Based upon your request, the Bank will reserve the credits outlined above for a period of up to 90 days
from the date of this |etber. Note that the credits reserved under the pending credit release are subject
to change pending the review and concurrence by the U.S. Army Corps of Engineers (USACE). It is the
applicant's responsibility to mmsune that the credit types and amounts requested are consistent with the
compensatory mitigation requirements nf the permit(s)issued. The NE[FUMB and/or 'its agents are not
responsible for determining, the applicant's mitigation requirements.
Upon request for credit transfer, the Bank will issue an invoke in the amount of $68,013.20. Upon
receipt mf payment, the Bank will provide an executed Transfer mfCredit Certificate for the total amount
of credits invoiced and paid for,

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below, Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved. You must also corn l with all other state federal or focal overntrtent ertnits. gulations or authorizations associated
with the oroi)osed activity including SL 2009-337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S.L. 2011-343.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certificatiort/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In-
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.necep.net,
Based on the information supplied by you in your request to use the NCEEP', the impacts that may require compensatory mitigation
are summarized in the following table. The amount of mitigation required and assigned to NCEEP for this impact is determined by
permitting agencies and may exceed the impact amounts shown below.
Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. The mitigation will be performed
in accordance with the N.C. Department of Environment and Natural Resources' Fcosystern Enhancement Program In-Lieu Fee
Instrument dated July 28, 2010.
