Poplar Creek Village is located at 7633 Poole Road in Knightdale The residential subdivision has been
designed in three phases Phase I has already been constructed and Phase II and Phase III are
currently under Construction Plan Review by the Town of Knightdale
A U S Army Corps of Engineering 404 Permit (Nationwide Permit 29) was approved on February 22,
2010 by Jamie Sherri (see attached) The permit was for a road crossing and utility installation related to
development of Phase I of the project A Stream Determination was also completed by Michael Horan
with the Division of Water Quality on November 11, 2005 (see attached) Both of these documents have
since expired
As part of the Phase II construction a ten foot wide greenway trail has been designed around the
perimeter of the site that will impact a riparian buffer This area of impact is designated as Feature #1 on
the DWQ determination letter Feature #1 is subject to Neuse Buffer regulations at the confluence of two
non - jurisdictional features The nearest body of water is Poplar Creek (WS -IV, NSW) and is in the
Neuse River Basin (see attached USGS Quad Map & NRCS Soils Map)
The greenway trail has been designed to minimize impacts to the natural topography of the site by
following the existing terrain as close as possible A 250 foot boardwalk has been designed as part of
the greenway trail to minimize grading impacts to the surrounding environment The trail will be built with
light construction equipment and all temporary impacts will be re- vegetated and returned to pre -
construction conditions
The riparian buffer impacts are
Permanent Zone 1 = 1,576 S F
Permanent Zone 2 = 2,222 S F
Temporary Zone 1 = 2,777 S F
Temporary Zone 2 = 5,872 S F
The boardwalk makes up 1,639 square feet of permanent Zone 1 and Zone 2 impacts and the remaining
permanent impact is from paved trail The temporary buffer impact will be 10 feet on either side of the
greenway trail to allow for construction Once construction of the greenway trail is complete the
disturbed area will be planted using native species that are locally adapted to re- establish the original
vegetated state

Size and location of property (water body, road name /number, town, etc ) Poplar Creek Village Subdivision — Phase 1-
The subdivision will be located on an approximately 82 acre parcel, north of the existing trailer park, at 7633
Poole Road. The parcel is immediately adjacent to the eastern bank of an unnamed tributary of the Neuse River,
due south of the interchange of I -540 and US 64, in Knightdale, Wake County, North Carolina.
Description of projects area and activity The purpose of the project is to construct a residential subdivision. The
project includes residential lots, roads, utilities. and stormwater management facilities. This authorization is for
the existing fill of an estimated 100 If of intermittent stream channel and an estimated 0.22 acres of wetland that
occurred during the first culverted stream crossing of Stony Falls Way. An additional 40 if of temporary impacts
were assumed to have been associated with water and sewerline stream crossings installed along the utility
easements to serve the subdivision. The existing rill impacts are estimated, as Stony Falls Way fill impacts
reportedly occurred in November of 2007. Any additional jurisdictional fill associated with Phase 1 or future
Phases of Poplar Creek Village will need to be permitted in advance of any further jurisdictional fill activities.
Special Conditions Mitigation in the form of a preservation easement on remaining wetlands and riparian areas
(11.5 acres) was proposed by the applicant to offset 0.22 acres of wetland fill. The attached Conservation Easement
Map for Poplar Creek (February 17, 2010) is to be recorded with the first lots as part of the subdivision plat. Note
that the conservation easement area may be only a subset of the community open space. The following language is to
be included in the Declaration of Covenants for the subdivision.
"The areas shown on the recorded plat entitled Conservation Easement Poplar Creek February 17, 2010 as
conservation easement areas shall be maintained in perpetuity in their natural condition No person or entity
shall perform any of the following activities on such conservation area-
a. fill, grade, excavate or perform any other land disturbing activities
b. cut, mow, burn, remove, or harm any vegetation
C. construct or place any roads, trails, walkways, buildings, mobile homes, signs, utility poles or
towers, or any other permanent or temporary structures
d drain or otherwise disrupt or alter the hydrology or drainage ways of the conservation area
e. dump or store soil, trash, or other waste
f graze or water animals, or use for any agricultural or horticultural purpose
This covenant is intended to ensure continued compliance with the mitigation condition of a Clean Water Act
authorization issued by the United States of America, U S. Army Corps of Engineers, Wilmington District, Action
ID 200620385, and therefore may be enforced by the United States of America This covenant is to run with the
land, and shall be binding on the Owner, and all parties claiming under it "
