Accordingly,: we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North.Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This permit includes no major changes from the draft permit sent to the Town on August 3, 2005. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. ' The Mars Hill Facility consists of a extended aeration package plant with a new Mechanical Spiral Screen which replaced the existing Manual Influent screen, grit removal chamber, flow meter with totalizer, three aeration basins, clarifier, aerobic digester with sludge return, chlorine contact chamber, sludge drying beds and stand-by power (diesel generator). The facility also utilizes land application for its bio-solids under WQ 0004298. The Average Daily Flows reported from the facility DMR's were as follows: in 2002 = 0.15446 mgd, 2003 = 0.16562 and 2004 = 0.16746. On 6-30-05 the Departments construction and Grants program acknowledged receipt of an Authorization to Construct application to expand/improve the existing WWTP. Use support ratings were assigned for waters in Subbasin 04-03-04 in the aquatic life, recreation, fish consumption and water supply categories. All waters are No Data on an evaluated basis in fish consumption because there are no fish consumption advisories in this Subbasin. In the water supply category, all waters are Supporting on an evaluated basis based on reports from DEH regional water treatment plant consultants. TOXICITY TESTING: There has been no WET testing requirement in the existing permit and none is anticipated for this permit renewal. COMPLIANCE SUMMARY: BASED ON THE PREVIOUS 2 YEARS File search indicates the facility has had no DMR violations. INSTREAM MONITORING: Upstream and downstream monitoring for DO and Temperature are in the existing permit and will be included in this renewal permit. PROPOSED CHANGES: NH3-N Based on the October 15, 2004 Implementation Policy for Permits with Monthly Average NH3-N limits, this facility will receive weekly averages of 6mg/1 Summer Months and 12 mg/1 Winter Months. TOTAL RESIDUAL CHLORINE Based on the June 19, 2003 Total Residual Chlorine Policy for NPDES permits this facility will receive a TRC limit of 17 mg/1. There has been one minor change in treatment process or plant design from the last permit. At our influent we have replaced our manual bar screen with a mechanical spiral screen to remove screenings from our influent flow. Our facility has an excellent record of compliance and is still well below it designed flow capacity. Sams i//;� 4, MAR 2 2005' �F ;H Town of Mars Hill Sludge Management Plan Our sludge management consists of a 44,750 gallon aerobic digester and 6 drying beds each with a surface area of approximately 1,350 SF. All residuals will be stabilized by aerobic digestion to significantly reduce pathogens (as described in 40 CFR Part 257, Appendix 2) prior to application. The sludge is then surface applied on 18.8 acres on the Larry Cody Farm (Permit # WQ0004298). Robert M.
