Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). No changes have been made from the draft permit. I would, however, like to again remind you of the monitoring and reporting requirements for Total Residual Chlorine (TRC). As of March 8, 2001, the Division of Water Quality (Division) is requiring all facilities with a TRC limit to pursue the utilization of a field instrument that will measure TRC concentrations to the lowest attainable levels. Currently, there exist portable instruments that have the capability of analyzing TRC in the range of 10-15 µg/l. Although this may be an optimistic expectation, these instruments are able to reliably analyze TRC to levels much lower than your current reported detection level of 100 µg/L. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699- 6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. CHRONIC TOXICITY PASS/FAIL PERMT LIAUT The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 6%. The permit holder shall perform at a minimum, 4uarterlu monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.' The tests will be performed during the months of January, April, July and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase U Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the'geomet ie mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The wasteflow at this facility is entirely domestic, so Maggie Valley has no pretreatment program. The facility discharges to Jonathan's Creek in the French Broad River Basin; these waters are classified C-Trout. The 2000 basin plan for the French Broad River rated the benthic macroinvertebrate community in Jonathan's Creek as excellent and suggests a potential reclassification to High Quality Waters (HQW). At the time of the last permit renewal, the facility was experiencing severe operational problems. This eventually led to the Water Pollution Control System Operator Certification Commission (WPCSOCC) issuance of letter of reprimand to the ORC, Mr. Ronald Gratton in 1997. The facility received a new ORC in 1998, and operational and maintenance improvements have been noted since. The Construction Grants and Loans (CG&L) section issued an Authorization to Construct (ATC) for Maggie Valley in July 2001. This ATC grants permission for the addition of a new mechanical bar screen, sludge digester improvements, a new sludge dewatering building with a belt filter press, chemical feed equipment, and a covered storage pad for sludge storage. It is anticipated that construction will begin soon. Since the installation of a new ORC, the plant has largely been in compliance. No other significant equipment or operation changes have occurred during this permitting cycle. Instream Monitoring and Verification of Existing Conditions and DMR Data Review. Maggie Valley WWTP is not required to perform any instream monitoring. DMRs for the facility were reviewed from January 1998 through June 2001. The average effluent BOD concentration during this time period 10.97 mg/L and the average TSS concentration was 14.35 mg/L; both are well below the permit limits. The average ammonia nitrogen concentration was 6.33 mg/L. Total nitrogen and phosphorus data are collected quarterly and reported in the facility's Discharge Monitoring Reports (DMRs). The average total nitrogen concentration from, January 1998-June 2001 was 11.06 mg/L with a maximum of 19.23 mg/L and a minimum of 3.28 mg/L. The average total phosphorus concentration was 3.96 mg/L with a maximum of 21.6 mg/L and a minimum of 0.19 mg/L. These data suggest some variability in the plant's nutrient removal�capabilities. A review of the results from the facility's quarterly chronic toxicity test indicates that since November 1997 (the issuance month of the existing permit), Maggie Valley WWTP has consistently passed all toxicity tests, though they did receive a Notice of Violation (NOV) in 1997 for late submittal of test results. Reasonable Potential Analysis: No reasonable potential analysis was performed for this facility since Maggie Valley WWTP is not required to monitor for metals. As mentioned above, the ORC at the time of the last renewal was reprimanded for operations and maintenance problems at the Maggie Valley WWTP. The town hired a new ORC in 1997 and Compliance Evaluation Inspection reports from the Asheville Regional Office (ARO) note significant improvements to plant maintenance from that point onward. The facility has received two NOVs — one for late submittal of toxicity test results and one for violating the monthly average BOD limit (both of these in 1997). The Aquatic Toxicity Unit issued one Notice of Deficiency (NOD) in 2001 for collecting the wrong type of sample for the toxicity test. The facility also received two (NODs) following Compliance Evaluation Inspections for violations of the total residual chlorine limit. The Compliance Evaluation Inspection reports otherwise describe the facility as well -maintained and having improved tremendously since the hiring of the new ORC. Authorization to Construct (ATC): The original plant ATC was issued on July 18, 1986. On February 14, 1990, a second ATC was issued for a plant expansion to a flow of 0.75-MGD. Recently, the CG&L section issued an ATC for plant improvements, primarily to the influent structure and the sludge handling facilities. Sinc ellyy, Scott Buffkin Town Manager Existing Facilities The Town of Maggie Valley currently operates a 0.75-MGD wastewater treatment plant (WWTP) and an alkaline sludge stabilization facility. The wastewater treatment facilities include a manually cleaned influent bar screen, flow splitter box, three (3) Aero-Mod treatment trains with Aero-Mod'tube settler clarifiers, dual aeration blowers for each treatment train (six (6) blowers total), two (2) sludge holding basins, effluent chlorination, a chlorine contact basin, sulfur dioxide dechlorination, and effluent flow monitoring. The alkaline sludge stabilization facility includes a lime kiln dust silo, a volumetric lime kiln dust feeder, a sludge mixer/blender, and a small concrete sludge drying pad. The stabilized sludge is stockpiled and disposed of onsite or offered to the public for beneficial reuse applications. Proposed Facilities A project is currently under review by the DWQ Construction Grants and Loans Section (CG&L) that includes the addition of a belt filter press and covered drying and storage area for the alkaline stabilized sludge product and a new influent channel and mechanical bar screen.
