Thorpe, Ph.D., Acting Director Division of Water Quality April 11, 2002 Subject: NPDES Permit NC0056561 Town of Maggie Valley WWTP Haywood County Dear Mr. Buffkin: I received your letter dated March 12, 2002 regarding the frequency of monitoring in your renewed NPDES permit. Currently, the Maggie Valley WWTP is ranked as a Class III facility. Under North Carolina Administrative Code Section 15A NCAC 2B.0500, Class III facilities discharging primarily domestic waste must sample for BODs, TSS, ammonia nitrogen, and fecal coliform three times per week. This is reflected in your current NPDES. permit. If you feel that your facility has been classified incorrectly, you may call the Asheville Regional Office and request that it be reassessed:. Should your facility get reclassified, you would then need to apply for a major modification to your NPDES permit in order to get the monitoring frequencies reduced. Goodrich NCDENR — Division of Water Quality 1617 Mail Service Center Raleigh, N.C. 27699-1617 Dear Mr. Goodrich: The Town of Maggie Valley recently received our renewed NPDES discharge permit. To our surprise the monitoring requirements had been increased. Specifically the BOD 5 day, total suspended residue, NH3-N, and fecal coliform sampling rates have all been increased from once per week to three times per week. This change will cost the Town approximately $1,000.00 per month. While I cannot argue the point that these tests are important, I must point out the Town's perfect record on passing these tests. In the past 48 months, Maggie Valley's sewer plant has achieved a perfect record on all monitored samplings. In addition, the Town monitors temperature, residual chlorine, and PH daily, which is more often than our permit requires because we feel that it important to know these things for proper plant operation. I believe this shows our commitment to the proper operation and maintenance of the plant as well as our concern for the environment. With all that being said, I respectfully request that the above listed sampling rates be reviewed. Perhaps the extra $12,000.00 per year could be better used for other worth wild projects. As a point of compromise, the Town could do the increased samplings for some period of time and use that opportunity to show that the increased rate is unwarranted by passing all the tests.
