Poole Jr. 4847 Sidney Road Belhaven,North Carolina 27810 SUBJECT: Permit No. WV0700168 Variance Request to Rule 15A NCAC 2C .0 1 07(a)(2)(Q) One Irrigation Well (CU3255) 1 Banjo Drive Belhaven,Beaufort County,North Carolina Dear Mr. Poole: On March 7,2023,the Washington Regional Office received your request for a variance to Rule 15A NCAC 2C .0 1 07(a)(2)(Q)which requires a well to be located at least fifty(50)feet from a surface water body(pond). The variance request is for one(1)irrigation well on property owned by you, S. R. Poole Jr., at 1 Banjo Drive, Belhaven, Beaufort County, North Carolina (PIN No. 6674-92-2832). In your request, you indicate that the irrigation well needs to be located less than fifty (50) feet from a pond so that the existing power infrastructure can be utilized. Based upon the information that you have submitted,and a site visit conducted by staff from this office on March 3,2023,a variance to the above cited rule is granted. However,the well shall not be located less than twenty five (25)feet from any surface water body(pond). It is my finding that the factors specified above are sufficient to satisfy the conditions for approval of a variance as defined in 15A NCAC 2C.0118. A copy of this variance should be attached to the required Well Construction Records (GW-1). This variance will be effective from the date of its issuance until March 13, 2024, and shall be subject to the conditions and limitations as specified therein. Please note that Condition 1 of Well Variance No. WV0700168 requires that the well be grouted completely from ground surface down to the top of the well's production zone. Also,please note that Condition 2 of Well Variance No.WV0700168 requires that prior to the start of any well drilling and/or construction activities, the well driller's name, contact information, and North Carolina certification information shall be provided to the Washington Regional Office of the Water Quality Regional Operations Section. Thirdly, please note that Condition 3 of Well Variance No. WV0700168 requires that,at least two business days prior to the well being grouted,the Washington Regional Office of the Water Quality Regional Operations Section shall be notified so that an inspection of the grouting activities can be performed. R. Poole Jr. FOR THE CONSTRUCTION OF One (1) Irrigation Well in the Tertiary Aquifer System on property owned by S. R. Poole Jr., at 1 Banjo Drive, Belhaven, Beaufort County, North Carolina (PIN No. 6674-92-2832). This Permit is issued in accordance with the application received on March 7, 2023,in conformity with specifications and supporting data, all of which are filed with the Department of Environment and Natural Resources and are considered integral parts of this Permit. This Permit is for well construction only,and does not waive any provision or requirement or any other applicable law or regulation. Construction of any well under this Permit shall be in strict compliance with the North Carolina Well Construction Regulations and Standards (15A NCAC 02C .0100), and other State and Local Laws and regulations pertaining to water supply well construction. If any requirements or limitations specified in this Permit are unacceptable, you have a right to an adjudicatory hearing upon written request within 30 days of receipt of this Permit. The request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this Permit is final and binding. The well(s) casing will be grouted completely from ground surface down to the top of the well's production zone. 2. Prior to the commencement of any well drilling and/or construction activities, the well driller's name, contact information, and North Carolina certification information shall be provided to David May or Randy Sipe,Water Quality Regional Operations Section, 943 Washington Square Mall, Washington, North Carolina 27889, telephone (252) 948-3939 or(252) 948-3849. 3. At least two business days prior to the start of any grouting activities notification shall be given to David May or Randy Sipe, Water Quality Regional Operations Section, 943 Washington Square Mall, Washington, North Carolina 27889, telephone (252) 948-3939 or (252) 948-3849 so that an inspection of the grouting activities can be performed. 4. The well(s)will not be located less than 25 feet from any surface water body(pond). 5. The well(s) shall have a Well Contractor Identification Plate and a Pump Installation Information Plate in accordance with 15A NCAC 02C .01070)(2) and(3). 6. Well construction records (GW-1) for each well shall be submitted to the Division of Water Resources' Information Processing Unit within 30 days of the well completion. 7. When the well(s) are discontinued or abandoned, they shall be abandoned in accordance with 15A NCAC 02C .0113 and a well abandonment record(GW-30) shall be submitted to the Division of Water Resources' Information Processing Unit within 30 days of the well abandonment.
