Dear Ms. Tuttle:
Jesse Barnes, of the North Carolina Division of Water Resources (DWR), Winston-Salem
Regional Office (WSRO), conducted a compliance evaluation inspection of the Hilltop Living
Center WWTP on February 7, 2023. Joseph Shaffer, Operator in Responsible Charge (ORC), was
present for the inspection. The facility was found to be noncompliant with the subject permit.
The determined permit violation and items of concern are listed below. Inspection findings are
detailed in the attached Water Compliance Inspection Report.
PERMIT VIOLATION
1. Field parameters have been performed by Mr. Shaffer, but no field laboratory
certification was present or able to be produced upon request by either Mr. Shaffer or
the facility owner. Subject permit Part II, Section D. (5.) requires field laboratories to hold
the appropriate field parameter laboratory certifications.
ITEMS OF CONCERN
1. Approximately the past 18 months of DMRs were maintained on site. Mr. Shaffer stated that
he maintains DMRs older than 18 months off site at his home, along with laboratory records
and chains of custody. He was advised to maintain all permit -required records on site in
accordance with subject permit Part I, Section 5. and Part II, Section D. (6.).
2. Mr. Shaffer typically grabs downstream samples approximately 10 feet downstream of the
outfall due to the lack of a properly maintained and accessible right of way further
downstream. Subject permit Part I, Section A. (1.) requires downstream sampling to occur
approximately 300 feet from the outfall. You may request to modify the downstream

modification request explaining why the existing sampling location is unsuitable and what
new location you propose to use, including the approximate distance from the outfall.
Please be aware that the Division may take enforcement action against any individual who fails
to comply with the requirements of all applicable permits, regulations, and/or statutes.
Pursuant to NC General Statute (NCGS) 143-215.6A, a civil penalty of not more than twenty-five
thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in
accordance with the terms, conditions, or requirements of any permit, or applicable
regulations, issued pursuant to G.S. 143-215.1.
