PROJECT SUMMARY: The applicant proposes to remove an existing docking facility and construct a new single- family docking facility that can accommodate up to two (2) vessels within Piney Point Creek. 152 Oceangreens Lane, Granata Living Trust Page Two 9. PROJECT DESCRIPTION The project site is located at 152 Oceangreens Lane, adjacent to Piney Point Creek, in the Town of Caswell Beach, Brunswick County. According to the application, the parcel has a maximum elevation of approximately 4' above normal high water (NHW) and is approximately 0.21 acres. The lot has an existing single-family residence and private docking facility with high ground vegetation consisting of maintained grasses, natural trees, and shrubs. The project site has approximately 58' of shoreline frontage with coastal wetlands. The interface between marsh and high ground consists of mixed high marsh species, including, Sea Ox-eye (Borrichia frutescens), Salt Meadow Grass (Spartina patens) and Black Needlerush (Juncus romerus). There is an approximately 80' wide border of high coastal marsh characterized by Black Needlerush (Juncus romerus) and Smooth Cordgrass (Spartina alferniflora) that transitions to low marsh vegetation in the proximity of mean high water. Smaller tidal channels (approximately 30-50' wide) cut through the marsh in front of the applicant's and the neighboring properties, The adjacent shorelines have not been stabilized by bulkheads or rip -rap. Adjacent marsh areas located below NHW are owned by the Coastal Land Trust and Duke Energy Progress, Inc. The applicant currently maintains a private docking facility with a fixed pier, measuring approximately 4' wide x 290' long, which then terminates to a fixed platform. The fixed platform, measuring approximately 10' long x 13' wide, has a ramp that leads to an approximately 10' wide x 12' long floating dock, that is located to the south and oriented perpendicular to the shoreline. Adjacent to the south side of the floating dock, is a kayak launch, that measures approximately 55 wide x 10.5' long. There is also an uncovered 13' x 13' boat lift located on the north side of the previously mentioned fixed platform. There was a CAMA Major Permit (Permit No. 52-04) that had been issued to a previous property owner for the construction of a single-family docking facility in 2004, however, the existing configuration of the existing docking facility does not reflect what was previously permitted. The Town of Caswell Beach Land Use Plan classifies the adjacent waters as Developed and Conservation, and the adjacent high ground portion of the project area as Residential. The adjacent waters of Piney Point Creek in the project area are classified SA -HOW by the Division of Water Resources and this area is designated as Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to construct a new single-family docking facility that can accommodate up to two (2) vessels within Piney Point Creek. The applicant proposes to construct a new single-family docking facility that can accommodate up to two (2) vessels. An approximately 4.5' wide x 586' long fixed pier is proposed to be constructed perpendicular to the shoreline of the subject property and will extend north to Piney Point Creek. Approximately 430' of the fixed pier is proposed to be constructed below NHW (see Page 2 of 5). The fixed pier would cross over Coastal Wetland areas and would be constructed so that the deck boards would be a minimum of 3' above the substrate to allow for light penetration. Approximately 200' waterward if NHW, the applicant proposes to have the pier cross over a navigational slough. The section of pier to cross this navigational slough is proposed to have an ADA compliant 40' bridge section that would be at least 10 ft. wide and 8' above NHW at the highest point (see Page 4 of 5). At the start of the bridged section, the applicant proposes to construct an approximately 10' wide x 8' long fixed platform off the east side of the pier over open water (see Page 2 of 5). An uncovered boatlift, measuring approximately 13' wide x 13' long would be located at the end of the proposed pier to the east. Approximately 60' landward from the waterward end of the 152 Oceangreens Lane, Granata Living Trust Page Three docking facility, an approximately 4' long x 6' wide fixed platform would lead via ramp to an approximately 14' long x 8' wide floating dock that would have the potential to accommodate up to one (1) vessel on the east side. Located landward of the proposed floating dock an approximately 5.5' wide x 10.5' kayak launch would be installed. Finally, (see Pages 2, 3, & 4 of 5). Water depths in the vicinity of the project range from -4 to -5.8' at Normal Low Water. The proposed location of the new docking facility would encroach into the 15' adjacent riparian setbacks on the east side, however, the neighbor at 151 Oceangreens Lane and the Oceangreens HOA have both provided a waiver. Please Note: Riparian lines have been recorded and the plat is included with the permit application drawings. Piney Point Creek measures approximately 200' across in this area, the proposed docking facility would not exceed the width and would extend approximately 20' past the outer edge of coastal wetlands. 10. ANTICIPATED IMPACTS The proposed new docking facility would result in the shading of approximately 3,036 sq. ft. of Coastal Wetlands, consisting primarily of Salt Marsh Cord Grass (Spartina alterniflora) and Black Needlerush (Juncus romerianus), and the incorporation of approximately 683 sq. ft. of Estuarine Waters and Public Trust Area. Minor increases in turbidity can be expected during excavation and construction. The applicant is proposing a bridged section in order to maintain a navigable slough within public trust waters. Shoreline length = 58' x 8 sq. ft. = 464 sq. ft. (maximum allowable platform area) Proposed fixed platform (4' x 6') = 24 sq. ft. Proposed fixed platform (8' x 10') = 80 sq. ft. I looked over the elec. apps for 151 and 152 and have several comments. I am sick this week and will not get out there until next week, but wanted to give you a heads up. 1. Please make sure the proposed drawings are all to scale, especially if you are proposing bridged sections over secondary channefs or navigable areas within surveyed riparian areas. Those areas also need to be clearly defined on the drawings so we can determine the span needed. Show the distance across the area to be bridged on the top view drawings/site plan. 2. The distance across the waterbody that you are showing are not in the alignment where the new piers are proposed, it needs to be taken from where the new structure would be built off the wetland areas and go straight across for both projects on drawing 1 of 4. 3. The previous permit for 152 was 481 ft. below NHW and this proposal is 524 ft., the structure does not appear to be that much farther out. Did someone at DCM verify NHW for you to pick that up via survey or scaled drawing by pulling a tape?...otherwise you can use surveyed MHW and pick that up. I will pull a tape from NHW to the beginning of the pier when I go onsite to verify the drawings. 4. The waterward end of the pier for 152 appears to go over open water instead of wetland areas, in order to protect navigation and public trust rights that should be shifted back to the originally permitted alignment. 5. Were the corridors adjusted? It looks like the eastern corridor line was shifted for 152 and if so we will need proposed riparian lines and authorizations from the HOA for those new riparian lines. 6. If the recorded riparian lines are being used please use the surveyed lines for the proposed drawings and make sure everything is to scale. The permit will reference the drawings specifically. It would be ideal if you could put the proposed structures overlayed on the riparian survey. The drawing 2 of 4 shows a riparian line in red 1 believe, but then you drew in a new one? Work Plats • All adjacent property owners are required to be identified and labeled • Use the previously surveyed riparian lines on the drawings for the applications for accurate representation of the footprints for the proposed docking facilities o Drawings currently say "approximate riparian lines" • All drawings need to be drawn to scale o Page 1 of 4 does not have a scale or scale bar o Page 2 of 4 has a 1" = 90' scale.
