Clean Water Act Section 404/401 Individual Permit Modification Request
Dear Ms. Davis and Ms. Homewood:
HDR, on behalf of Duke Energy Carolinas, LLC (Duke Energy), is requesting a modification to the
approved Clean Water Act (CWA) Section 404 (Action ID 20215-02542) and Section 401 Individual
Permit (DWR # 20160742 Ver 4) for design changes related to the Cedar Cliff Auxiliary Spillway
Upgrade Project (Project) located in Jackson County, North Carolina.
Original Section 404/401 Approval (March 22, 2017) —A Pre -Construction Notification
was submitted to authorize 110 linear feet of temporary stream impacts associated with
temporary stream crossings, 0.05 acres of temporary open water impacts associated with
barge loading/staging area, 9.6 acres of permanent open water impacts associated with
disposal of rock spoil, 50.8 acres of temporary open water impacts associated with
dewatering the reservoir, 0.01 acres of permanent open water impacts associated with
construction of a submerged weir/rock vane, and 0.22 acres of permanent open water
impacts associated with construction of a haul/access road.
Modification #1 Request (June 21, 2019) — A permit modification request was submitted
for (1) approval of the water quality monitoring plan, (2) revision of 404 Special Condition
20.0 regarding required turbidity curtain barriers, and (3) authorization of additional fill
impacts associated with improvements to the Cedar Cliff Lake access boat ramp and
construction of a temporary barge access road. The additional impacts consisted of 1.4
acres of temporary impacts to open waters, 0.73 acres of permanent impacts to open
waters, and 45 linear feet of temporary impacts to streams.
• Modification #2 Request (October 29, 2020) — A permit modification request was
submitted for additional impacts associated with further improvements to the Cedar Cliff
Lake public access area including a temporary riprap apron and excavation of accumulated
lake sediment. These impacts consisted of 0.017 acres of temporary impacts to open
waters and 0.007 acres of permanent impacts to open waters.

• Modification #3 Request (August 25, 2021) — Duke Energy requested approval of design
changes related to the previously authorized 1951 Access Road and newly proposed weir
and spoil repository footprint located within Cedar Cliff Lake.
• Modification #4 Request (February 8, 2022) — Duke Energy requested authorization for
additional impacts assocated with modification for spoils disposal areas within the bypass
reach of the East Fork Tuckasegee River. These impacts consist of 597 linear feet of
permanent stream impacts and 100 linear feet of temporary stream impacts to the East
Fork Tuckasegee River.
• Modification #5 (March 6, 2023) — Duke Energy is requesting authorization for additional
permanent impacts below the normal pond elevation of Cedar Cliff Lake (2,330 feet mean
sea level [ft msl]) related to (1) modifications of the revised Shook Cove Road Boat Ramp,
and (2) riprap assocated with the barge loading area at the peninsula along the 1951
Access Road proposed to be left in place.
Shook Cove Road Boat Ramp
Duke Energy is proposing to extend the existing 16-foot-wide concrete boat ramp at the
Cedar Cliff Lake Access Area by approximately 168 feet (0.06 acres) and to leave the
remaining surge stone used for the temporary barge access road to serve as a permanent
maintenance access during drawdowns. The proposed permanent maintenance ramp will
be located entirely within the previously permitted 0.49-acre footprint of the temporary
barge access road (OW6). Excavation will be required to connect the existing concrete
boat ramp with the extended boat ramp and will be located with the previously authorized
excavation impacts footprint (OW7). An approximately 260-foot-long by maximum 5-foot-
high retaining wall is proposed to be installed between the permanent maintenance access
and the rock ditch (OW8). The boat ramp modifications have been reviewed and approved
by the N.C. Wildlife Resources Commission and Jackson County. Duke Energy is
requesting that OW6 impacts be revised from temporary to permanent impacts to
accommodate the permanent maintenance access (Figure 1 and Figure 2).
1951 Access Road
The current permit authorized approximately 0.61 acres (OW5) of permanent impacts
below the normal pond elevations associated with the 1951 Access Road. Duke Energy's
construction contractor did not build out the 1951 Access Road in its entirety. Riprap was
placed below the normal pond elevation at the apex of the peninsula to accommodate a
barge loading area. Duke Energy is proposing to leave approximately 0.04 acres of
permanent riprap below the normal pond elevation at this location, as it would cause more
disturbance to the reservoir bottom to remove it. Figure 3 illustrates the as -built survey
within the shortened 1951 Access Road and the location of riprap requested to remain in
place (OW10) associated with the peninsula barge loading area.
Table 1 details the timeline of approved Section 404/401 impacts as well as newly requested
impacts associated with this Project.
