Per our discussion I have a few questions regarding avoidance and minimization that require clarification prior to proceeding with processing of the permit modification: 1) The information submitted states that, "Without a stream crossing, there is no way to access the area adjacent to the bridges between the South embankment of Buffalo Creek, a distance of over 500 feet." However, this is not clear based on the included permit drawing (Permit Site 37). Based on project plans referenced in our April 15, 2014 permit as well as a GIS review, it appears that the site could be accessed from both Rankin Mill and Camp Burton Roads, enabling construction access from both sides of North Buffalo Creek and negating the need for temporary stream crossings. Please clarify any other site constraints or practicability issues that would not allow the bridge to be constructed as currently authorized without temporary impacts to North Buffalo Creek. 2) There is an existing wetland on the north side of North Buffalo Creek, and the included permit drawing (Permit Site 37) shows the eastern-most proposed temporary impact aligned such that wetland impacts are likely. As no wetland impacts are proposed at this site, please explain how wetland impacts will be avoided. � 3) In the case that item #1 above can be resolved, would it be possible to minimize impacts to North Buffalo Creek by realigning the temporary crossings to be perpendicular (or more so) to the stream banks? If not, please explain why this is not practicable. 4) Please submit the proposed temporary crossing details (plan and profile view). Feel free to provide responses to the above items via e-mail.
