Dear Mr. Buss:
This letter transmits a Notice of Violation and assessment of civil penalty in the amount off $6,786.57 ($6,750.00 civil
penalty + $36.57 enforcement costs) against Jones Estates Pace LLC. I
This assessment is based upon the following facts: a review has been conducted of the Dis barge Monitoring Report
(DMR) submitted by Jones Estates Pace LLC for the month of April 2022. This review 13 s shown the subject facility to
be in violation of the discharge limitations and/or monitoring requirements found in NPD S WW Permit No. NC0064246.
The violations, which occurred in April 2022, are summarized in Attachment A to this letter.
Based upon the above facts, 1 conclude as a matter of law that Jones Estates Pace LLC vio tad the terms, conditions or
requirements ofNPDES WW Permit No. NC0O64246 and G.S. 143-215.1(a)(6) in the ma nor and extent shown in
Attachment A. In accordance Lvitlt the maximums established by G.S. 143-2I .6A(a)(2), civil penalty may be assessed
against any person who violates the terms, conditions or requirements of a permit required y G.S. 143-215.1(a).
