This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983, and as subsequently amended. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty(30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings,Post Office Drawer 27447, Raleigh,North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please take note that this permit is not transferable. Part II, E. 4. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Land Resources or any other Federal or Local governmental permit that may be required. Modeling Discussion No ambient monitoring stations were identified on Peter Weaver Creek or in vicinity. Drainage area for the mouth of Morgan Mill (USGS 0343950055) was probably entered incorrectly as 24.1 square miles, and the more likely 2.41 square miles was used. (Jackie Nowell assumed the same in a model for Transylvania Evergreen WLA.) Waste Load Allocation • NPDES Wastewater Permit (NC0086223) Level B model analysis for the summer indicated that the existing limits for two facilities on Morgan Mill—Transylvania Evergreen(NC0081001) and Conoco Convenience Store (NC0085031)—do not take into account any interaction between discharges. Consequently, the model predicts NBOD is well above the standard (4.5 mg/I) in the segment of Morgan Mill prior to the confluence of Peter Weaver Creek. However, the highest NBOD predicted downstream of D&D Catfish is only 4.83 mg/1 (at the confluence), and the model is not accurate enough for this value to warrant iterations that attempt to correct for interacting discharges. The model further predicted that D.O. would not fall beneath the standard of 6.0 mg/1 during summer or winter conditions with proposed limits. The minimum D.O. was predicted to be 6.6 mg/1 at D&D's discharge point. This is the only D.O. sag within 1.0 mg/1 of the standard; therefore, no instream monitoring is recommended. (Current Division policy is to recommend instream monitoring when a D.O. sag occurs further downstream than the discharge point, and the minimum D.O. is within 1.0 mg/1 of the standard.) Under both the summer and winter conditions, D.O. continues dropping at the endpoint of the model, but the end D.O. is> 7.5 mg/1, and this is the point is where the segment meets the French Broad River. Therefore, secondary limits for BOD5 (30.0/45.0) should be adequate to protect for D.O. in this stream. General Comments • Division policy for new flow to Trout waters is to include a TRC limit between 17-28 µg/1, depending on dilution. If the allowable concentration is above 28 µg/l, a default limit of 28 µg/1 applies. (Standard of 17 gg/1 applies to Trout waters.) • Ammonia limits were determined by dilution calculations to protect against toxicity (see calculations). • The standard for MBAS is 500 gg/1, so the allowable concentration for this facility is around 3500 µg/l. Additional Comments • Level B Model Analysis used to determine effluent limitations for BOD5, protecting an instream D.O. standard of 6.0 mg/I. • Ammonia limitations based on ammonia toxicity dilution calculations. • Oil & Grease and MBAS monitoring included since a restaurant is planned at the future resort. • Division policy is to include a TRC limit no less stringent than 28 pg/1 for new dischargers into Trout streams. • The proposed discharge appears from the Topo map to be inside the Pisgah National Forest boundary; however, since the land is private(called an"inholding"), no regulatory authority exists to restrict land-disturbing activities, except in cases where access to the property during and following construction is gained through national forest land. This does not appear to be the case; highway 64 runs right next to the property. • Chris McGrath of the Nongame and Endangered Species Section(Wildlife Resources)was contacted for any information regarding endangered species in the area. He knew of no federally-listed species, but he checked the Heritage Database for others. The Hellbender salamander is state-listed as a special concern in the area; however, it has been recorded in the French Broad River(not Peter Weaver). This species tends to live in larger rivers rather than small ones. Some rare plants also exist, but not on Peter Weaver Cr—on the banks of the French Broad. The resort would have approximately 50 cabins, 50 campsites, a restaurant, and a 40-unit motel and office. 15A NCAC 2B .0300 Index # 6-10: Peter Weaver Creek classified as C-Tr in 7/1/73. Basinwide Plan Info.: • No specific point source management strategy recommended unless HQW applies. Many of the streams in this area are classified as Trout streams, and HQW streams exist up and downstream (Major sections of the North, West, and East Forks, and all of Catheys Creek). A review of the upper French Broad River HQW report (B- 890510) indicated that the French Broad R from its source to SR1129 was inadvertently overlooked for HQW designation, and it is DEM's intent to pursue reclassification of this stream reach (below Morgan Mill confluence). • Benthic macroinvertebrate sampling near Rosman indicates excellent to good water quality conditions. • A QUAL2E model was scheduled to be developed for Brevard to Asheville (this is downstream from proposed discharge). • Approximately one half of the land within the sub-basin is contained in Pisgah National Forest and Pisgah Game Land and is therefore protected from most land disturbing activities. The proposed discharge appears to be contained inside national forest boundaries.* *NOTE: I spoke with a Public Information Officer of Forest Resources (?) at (704) 257- 4264 about how land disturbing activities are overseen/approved inside national forest boundaries on 5/29/98. He said that if the land is private (called an "inholding"), no regulatory authority exists to restrict such activities, except in cases where access to the property during and following construction is gained through national forest land. This does not appear to be the case; highway 64 runs right next to the property. EAA Review: • Is action allowed? Peter Weaver Cr is not a zero flow stream, and nothing in the basinwide plan prohibits new dischargers in this area. • Flow probably overestimated; I estimate about 30,800 gpd, 35K for design purposes. Consultant (Burgin) concurred. • This request had been submitted at an earlier date and returned because long-term operating costs of alternatives had not been assessed. Options that were considered were: connection to regional sewer, on-site subsurface disposal, and direct discharge. The Town of Rosman will not accept the additional discharge (documentation supplied in the form of a letter from the Mayor of Rosman). • Kerry Becker at region mentioned that because of the steep grade of the property, subsurface system installation would be even more difficult and expensive than initial cost estimates may show. Robert Burgin noted this in the revised EAA. • Why is used package WWTP only $5,500?! I question this—it seems too low.' • Although it is true that amount of force main necessary with a subsurface system would exceed that of the WWTP option, will it require as much as 6 1/2 times more?2 • Amount of hours charged to "Engineering and Soil Scientist Fees" seem arbitrary, with more weight given to a subsurface option. The actual difference may by difficult to predict, however. • NC0086223 BAB Discussion with Robert Burgin on 5/28/98: 'Package WWTP (dual 20,000 gal aeration tanks with digestion and clarifiers) has already been purchased for $5000 that would have otherwise been abandoned. Really the only cost to the owner was transportation and backfill of land from where it was taken. Blowers, EQ tanks, and chlor/dechlor are also factored in separately. The pump station is also less for direct discharge option because it is necessary only to raise water above the flood plain. The pump will be oversized to handle future tie- in to regional sewer. 2Force main estimate is so much greater because location of suitable soil for disposal is so remote and at the rear of the property. According to property map, the approximation may be close if pump station remains in same location and sewage is transported to it and back up to the back of the property. 3585 ft may be somewhat excessive, but considering lines would not travel straight to rear of property, it is possible this amount would be needed. • Other initial costs seem reasonable. O&M costs: As expected, these costs for subsurface disposal are significantly less and converge the present worth of the two options more closely. Power and operation costs seem reasonable. Testing costs estimated from quotes in ATEL lab fees manual and can be subtracted from "Operational Cost of WWTP and testing",with sufficient amount left for operational costs. Final assessment: Final present worth costs were added and calculated correctly using an 8% discount rate. Cost of non-discharge alternative (subsurface) was only about 14.3% higher than that of discharge from a WWTP; however, since costs for subsurface are likely underestimated due to the steep grade of the property, the actual difference in cost is probably greater than 15%. I double-checked Burgin's present worth calculations with a spreadsheet. Presently, direct discharge appears to be the most economically feasible option. Burgin expressed optimism that regional connection (Town of Rosman) will be a possibility in the future (next 5 years or so), and the owner favors connection when the option comes available. The discharge is proposed for Peter Weaver Creek, north of Rosman (close to where Highway 64 crosses Peter Weaver Cr) . On the Topo map, this appears to be just inside the Pisgah National Forest boundary, so the property is probably an inholding.
