Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: * The Project Area is an -98 acre tract with approximately 70 acres in woodland. Snipes Creek runs along the eastern property boundary. Counting Snipes Creek, there are 3 Neuse Buffered streams on the property. There is a new S/D being constructed (Phase 1) of Carolina Landing immediately to the north. The general land use in the area is farming and woodland. Subdivisions are also being built in the vicinity. 4b. Have Corps permits or DWR certifications been obtained for this project (including all prior phases) in the past? * Yes No Unknown 4f. Explain the purpose of the proposed project:* The purpose is to construct an -100 lot single family homesites for the growing needs of northern Johnston County. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * Since most of the Project Area is wooded, bull dozers, motor graders and track hoes will be used to clear the trees, stumps to clear and grade the streets. The streets will be asphalt and built to DOT specifications. The crossings will be constructed with stream pump arounds and will be installed with track hoes. The utilities lines will be installed in the streets and the septic will be onsite on each individual homesite. An approved sediment and control plan will be followed and inspected by Johnston County Stormwater. I don't know of any indirect impacts. 5. Jurisdictional Determinations 5a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: In design, the Phase 4 Impact Site, Street A was strategically located to be south of the small wetland on Lot 25 and also avoiding impact of the Neuse Buffer to the south. Headwalls will be used on both crossings to minimize stream impact and the road shoulders were narrowed from 8 foot to 6 foot wide. Both crossings are needed to access lots across the streams. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: A pump around is required when each crossing is installed. The work is required not to begin in times of high flow or when heavy rainfall is predicted. All wetlands will be clearly marked and the approved sediment and erosion control plan will required to be followed and inspected by the Johnston County Stormwater. 2. IPaC-1) Tricolored Bat -Is known to hibernate in caves and mines. There are none of these on the property. 2) Red -cockaded Woodpecker -"The red - cockaded woodpecker makes its home in mature pine forests." There are no old growth pine forest on the Project Area. No habitat, no affect. 3) Neuse River Waterdog- "They are usually found in streams wider than 15 meters (m), deeper than 100 centimeters (cm), and with a main channel flow rate greater than 10cm/second." No habitat, our the Phase 2 and Phase 4 streams are both 1st order streams with low flows. 4) Carolina Madtom-"Prefer clean water 1 to 3 feet deep with permanent flow and are not tolerant of siltation and turbidity." The phase 4 crossing is intermittent flow, the Phase 2 feature begins at the back of lots from a subdivision, also an earlier phase of this subdivision drains to this stream and there is some siltation in the water. Our location does not overlap the critical habitat, No habitat no affect. 6) Atlantic Pigtoe "Dependent on clean, moderate -flowing water with high dissolved oxygen content in creek and riverine environments:' Our location does not overlap the critical habitat. As stated both are 1st order streams w/o clean high dissolved water. No habitat, no affect. 7) Dwarf Wedgemussel - "To survive, they need a silt -free, stable streambed and welloxygenated water free of pollutants." No habitat, No affect. 8) Tar River Spinymussel - "Lives in relatively silt -free uncompacted gravel and/or coarse sand in fast -flowing, well oxygenated stream reaches." No habitat, no affect. 9) Yellow Lance - "lanceolata is dependent on clean, moderate flowing water with high dissolved oxygen content in riverine or larger creek environments (USFWS 2018)." Our location does overlap the critical habitat, no habitat no affect. 10) Monarch Butterfly - "Are found in meadows, roadsides, and sandy areas where milkweed plants grow." What are the levels of concern for migratory birds? %�Aklo Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Core tion Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of the Eagle Act requirements (for eagles) or (for non -eagles) potential susceptibilities in offshore areas from certain types of development or activities (e.g. offshore energy development or longline fishing). Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur. Proper Interpretation and Use of Your Migratory Bird Report The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. To learn more about how your list is generated, and see options for identifying what other birds may be in your project area, please see the FAQ "What does IPaC use to generate the migratory birds potentially occurring in my specified location". Please be aware this report provides the "probability of presence" of birds within the 10 km grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look carefully at the survey effort (indicated by the black vertical bar) and for the existence of the "no data" indicator (a red horizontal bar). A high survey effort is the key component. If the survey effort is high, then the probability of presence score can be viewed as more dependable. In contrast, a low survey effort bar or no data bar means a lack of data and, therefore, a lack of certainty about presence of the species. This list is not perfect; it is simply a starting point for identifying what birds of concern have the potential to be in your project area, when they might be there, and if they might be breeding (which means nests might be present). These habitats include seagrasses or submerged aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and nearshore coastal waters.
