Dear Mr. Wolfe:
Division personnel have reviewed and approved your representative, Hart and Hickman,
application for modification to the subject permit. Accordingly, we are forwarding the attached
modified NPDES discharge permit. This modified permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
Please note that the receiving stream is listed as an impaired waterbody on the North Carolina
2014 303(d) Impaired Waters List. Addressing impaired waters is a high priority with the Division,
and instream data will continue to be evaluated. If there is noncompliance with permitted effluent
limits and stream impairment can be attributed to your facility, then mitigative measures may be
required.
• The permit was original issued in October 2013 for a limited timeframe to accommodate
dewatering activities associated with the Lynx Blue Line extension construction project. Two new
dewatering activities were recently defined along with new discharge locations on Little Sugar Creek.
The new outfalls predicted maximum discharge rate will be same as the existing outfalls, 0.28 MGD.
This permit modification includes the following changes to the existing permit:
1) Change the permit expiration date from September 30, 2015 to June 30, 2017 to
accommodate the extended construction schedule. The total permit duration is less than 4
years.
2) Addition of Outfalls 003 and 004, which may be used to discharge treated wastewater from
any of the four dewatering sites defined for this construction project. These additional
outfalls would discharge to the same receiving waterbody(Little Sugar Creek).

3) Amendment of Outfall 001 and 002 limitation pages, which may be used to discharge
treated wastewater from any of the four dewatering sites defined for this construction
project.
4) Amendment of special condition A. (4) to include a new reporting requirement, which will
provide information on corrective actions made for non-compliance occurrences. The report
will be mailed to the Mooresville Regional Office.
If this temporary construction activity is completed prior to January 2017, please notify the
Division whether the intention is to apply for a major permit modification for converting this permit to
a permanent groundwater remediation discharge or the permit is no longer needed, in which case
request permit rescission.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made,this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect the
legal requirements to obtain other permits which may be required by the Division of Water Resources
or any other Federal, State, or Local governmental permits that may be required.

TO DISCHARGE WASTEWATER UNDER THE
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM
In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards
and regulations promulgated and adopted by the North Carolina Environmental Management
Commission, and the Federal Water Pollution Control Act, as amended,the
City of Charlotte
is hereby authorized to discharge wastewater from a facility located at the
Charlotte Area Transit System Construction
Nearby Cullman Ave and Nearby Alpha Mill Lane
Mecklenburg County
to receiving waters designated as the Little Sugar Creek and an unnamed tributary to Little Sugar
Creek in the Catawba River Basin in accordance with effluent limitations, monitoring requirements,
and other conditions set forth in Parts I, II, III and IV hereof.
This modified permit shall become effective March 18, 2015.
This permit and authorization to discharge shall expire at midnight on June 30, 2017.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions described herein.
City of Charlotte
is hereby authorized to:
•
1. Discharge wastewater from City of Charlotte dewatering construction operation to Outfalls 001
(nearby Cullman Ave), 002 (nearby Alpha Mill Lane), 003 (nearby Norfolk Southern Intermodal
Facility), 004 (nearby Raleigh Street), estimated peak flow of 195 gpm (0.28 MGD). Permittee
anticipates treatment components to consist of combination of settling, filtering, air stripping,
activated carbon adsorption, and ionic resins adsorption.
The mobile treatment system or systems are located in Charlotte in conjunction with the
construction of Charlotte Area Transit System dewatering sites in Mecklenburg County.
2. Discharge from said treatment works at the locations specified on the attached map into the Little
Sugar Creek Outfalls 001, 003, and 004, an unnamed tributary into Little Sugar Creek Outfall 002,
classified C waters in the Catawba River Basin.

3. An effluent meter with flow totalizer shall be installed. A daily log shall be maintained and
available for inspection indicating the date of operation, the total flow volume discharged on
that date, and the number of hours of operation on that date.
4. The Permittee can demonstrate compliance with the turbidity limit by sampling 100 ft
upstream and downstream from the discharge during a discharge event, in which case the
discharge shall not cause the downstream turbidity to exceed 50 NTU or if the upstream
turbidity is above 50 NTU then the discharge shall not cause an increase in turbidity.
b. All samples collected shall be from a representative discharge event.
c. Discharges to individual storm sewers require review and approval by Charlotte's Utility
Department.

A. (4) OPERATION LOG
A daily log shall be maintained and available for inspection that provides details for each individual
treatment system, but not limited to, that mobile treatment system's configuration, system operation's
event that significantly compromise treatment, maintenance, and indicated when treatment components
are cleaned, replaced, added, or removed. For example, when an activated carbon canister is replaced or
filter is cleaned. In addition upon completion of each DMR report, if any permit limits are not in
compliance (reported averages or turbidity exceed limits) a Compliance Action Report indicating actions
taken to mitigate the cause of the non-compliance shall be submitted to:
