Dear David Jackson:
The Division of Energy, Mineral and Land Resources (DEMLR) has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form, received on February 15,
2023. The Division is unable to concur with your certification of no exposure.
Based on an inspection of your facility on February 17, 2023, Asheville Regional Office staff found that
raw materials including steel, by-products, open barrels, and waste products were located outside
uncovered. The Division cannot grant your requested exemption from permit coverage when industrial
activities or materials are exposed or have the potential to be exposed. Please apply for coverage under an
NPDES General Permit NCG030000. Information can be found at deg.nc.gov/SW-industrial.
