Dear NCIRT Member:
The purpose of this letter is to provide you with a copy of a final draft amendment to the
mitigation banking instrument (MBI) for the Hidden Lake Wetland Mitigation Bank in Tyrrell County,
North Carolina. This letter also; requests your review and comments on the attached version of the
amendment to the MBI. .
The following proposed amendments to the Hidden Lake MBI were discussed at the December
6, 2011 North Carolina Interagency Review Team ( NCIRT) meeting. These amendments have to be
finalized and approved before any credits are released for sale:
1. The RCW Enhancement plan will be removed and the associated credits placed under the
Preservation column.
2. The Credit ledger will be modified based upon the updated survey.
3. Credit types will be renamed based on today's standard nomenclature.
4. The Geographic Service Area will be changed to the entire Albemarle HUC 03010205.
5. The Conservation Easement will be finalized and easement holder presented (resulting in the
release of all available bank credits).
6. A paragraph must be developed and added to the Amendment document that will govern the
sale of the'entire bank to another entity.
As such, Hidden .Lake LLC has provided the attached amendment to the Hidden Lake MBI for
review and approval by the Interagency Review Team.
In accordance with 33 CFR 332.8 (g)(2), the district engineer (DE) has determined that the
streamlined review process is warranted. IRT members and the sponsor have 30 days to notify the DE if
they have concerns with the proposed amendment. If any IRT member raises concerns with the proposed
amendment within 30 days, we will attempt to resolve those concerns. At the end of this process, and
within 60 days of the date of this letter, we will notify the IRT of our intent to approve or disapprove the
proposed amendment. The deadline for providing comments is June 30, 2012.
