Hi Michelle, and thanks for your email and earlier update. The 5 foot width listed in the letter is an estimate often used
for the "typical" piedmont NC stream width when on -the -ground measurements are not available. I apparently didn't
see the NCSAM form width prior to writing the letter; great catch! The Corps is amenable to using an estimate of 3'
width for the stream channel. This would place the acreage for the 306 linear feet of impacts at 0.021 acre. This is below
the Standard PErmit threshold for stream impacts, though it is above the compensatory mitigation threshold. Hopefully
his helps for clarification. Please let me know if you have any questions.

Dave,
Can you possibly give me clarification on how the width of the intermittent stream was estimated? The NCSAM form has
it as 2-3 feet at top of bank. I don't have the PJD or any figures submitted that are referenced by RK&K. The violation
letter has it as 5 feet in width. Is that top of bank or streambed width? This makes a big difference between an NWP and
a Standard Permit.
