Dear Mrs. Roland:
This correspondence is in reference to the Water & Land Solutions Yadkin 01
Umbrella Mitigation Bank —Rolling Meadows Mitigation Site located at 525 Kendlebrook
Farm Road in Lexington, Davidson County, NC, within the Yadkin-PeeDee River Basin
Cataloging Unit (03040101). The purpose of this letter is to confirm the initial release of
credits for this mitigation site. (35.9166960N,-80.304871 °W)
Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish
the WLS Yadkin 01 Umbrella Mitigation Banking Instrument Within the State of North
Carolina, approved December 18, 2019, 15 percent of the mitigation site's restoration
credits and 100 percent of the site's preservation credits shall be available for sale
immediately upon completion of all the following:
a. Approval of the final mitigation plan (October 19, 2022);
b. Issuance of the 404-permit authorization for construction of the site (December
12, 2022);
c. Delivery of the executed financial assurance documents as described in the
UMBI (February 16, 2023);
d. Recordation of the Corps -approved site protection mechanism described in the
UMBI including a title opinion covering the property. (February 16, 2023)
e. Execution of the UMBI by Water & Land Solutions, LLC and USACE
(December 18, 2019); and
Documentation of the establishment of the long-term endowment/escrow
account (February 28, 2023).
By copy of this correspondence, we confirm that you have satisfied the above
requirements for the initial credit release; and 1125.75 warm stream mitigation units
(SMUs), constituting 15 percent of the mitigation site's total restoration and enhancement
credits (7,505 potential SMUs), plus 1.258 riparian wetland credits are now available,
which includes the 15 percent release of 1.175 WMUs and 100 percent of the site's total
wetland preservation credits (0.08 WMUs) are now available for sale. The total potential
riparian wetland credits for the site are 7.93 WMUs.
