DWQ issued the 401 for the Monroe bypass on December 22, 2010. th On May 3, 2012, the 4 Circuit Court ruling in favor of the SELC remanded the evaluation of the no build alternative back to NCDOT and the FHWA. In a letter from DOT to DWQ dated May 24, 2012, DOT voluntarily withdrew their current 401 certification for the Monroe Bypass project. In all the correspondence I’m seeing in laserfiche, it appears the Corps of Engineers only suspended the 404 application. It was not withdrawn with them. So DOT would have to completely reapply with DWQ for this project. DOT withdrew their application, so they have nothing in house any longer.
