We have read through the comments from SELC. They are pretty significant and raise some questions that should be
addressed. SELC has requested a meeting to discuss their comments and we plan to set something up as soon as
possible. This will obviously extend our timeframe for issuing a 401. Our public notice comment period ended
yesterday, so we have 30 days to issue the 401. Based on our planned meeting and the responses we get from NCTA
regarding outstanding questions, it is possible that we may need to place the project on hold further delaying
issuance. This may be problematic given NCTA’s time table for getting bond funding and considering the information I
provided to the State Auditor. Just wanted to make sure you are aware of the situation and that we are working
towards resolving these issues. Please let me know if you have questions. Thanks.

Southern Environmental Law Center offers the attached comments on the application of the North Carolina
Turnpike Authority (“NCTA”) for a § 401 Water Quality Certification for the Monroe Connector/
