We are writing in response to your letter dated August 10, 2020 NOTICE OF VIOLATION & INTENT TO ISSUE
CIVIL PENALTY Tracking No.: NOV-2020-DV-0344, and would like to provide justification as to why a civil
penalty, of any amount, would hinder our ability to fund future repairs of collection system issues.
On May 1W' Tropical Storm Arthur was off coast of North Carolina and we experienced two low pressure
systems that stalled over North Carolina. Beginning Monday 18th, early evening, heavy rains started. We did
not see the rain subside for some two days later. By Thursday the 21" the Town have received in excess of 7
inches of rain causing flooding throughout our downtown area.
We continue to visibly inspect manholes when these rain events occur and replace/repair missing and broken
cleanouts.
We have secured funding through our annual budget to have-13,000 feet of 6- and 8-inch sewer lines cleaned
and CCTV. We received 4 quotes for this work and have informed Envirolink, Inc. that their bid was accepted.
Due to Covid-19 response and being in Phase 1, we were unable to set up meetings to begin the work until
August 1". We are awaiting Envirolink, Inc. to work us into their schedule.

Once we have the data from the CCTV and cleaning is in hand, we will begin repairs with monies allocated in
our annual budget and CIP. It is for this reason that we respectfully request that no fines be levied against the
Town. If funding is found, through grants or other programs, we will make more predictive and preventative
repairs to the collection system. If not, we will be restricted to the projects financed through our Capital
Improvement Plan and annual operating budget.
