2022 Pretreatment Annual Report Narrative
A. General Program Information:
1. The Collection Systems permit, WQCS00150 remains effective June 28, 2018,
through February 28, 2026.
2. A Pretreatment Program Information Data Sheet was provided by the Municipal Unit,
and it can be found following this narrative. There are no changes required for the
PPID.
3. One IUP renewed in 2022. This is discussed in the Industrial Users and Compliance
Information below.
4. There were no new SIUs in 2022.
5. LTMP pollutants of concern for the receiving POTW, Town of Wallace, were
included in the first half of 2022 semi-annual monitoring for all industries. The data
are reported with IUP parameters on the IDSF sheets for each industry.
6. The Pretreatment Program was audited by the Wilmington Regional Office on July
12th, 2022, during which the inspection of SIU 0006, LL Buildings, was conducted.
The Pretreatment Program was found to be satisfactory.
B. Industrial Users and Compliance Information:
1. American Skin Food Group, LLC (IUP # 0004)
• This SIU was inspected once and sampled twice by the POTW during this PAR
year.
• This SIU performed all sampling as required, was compliant, and received no
violations for this PAR year.
• There were no significant changes to the process during 2022.
• The industry permit remains in effect until December 31 st, 2026.
• The industry provided a reviewed/updated Spill and Slug Control Plan and Sludge
Management Plan on May 1 Oth, 2022. These have been reviewed by the POTW
and added to the file.
2. LL Building Products, Inc. (IUP # 0006)
• This CIU was inspected once and sampled twice by the POTW.
• This CIU performed all sampling as required, was compliant, and received no
violations for this PAR year.
• Full TTO monitoring was completed for this industry during 2022 by both the
industry and the POTW.
• There were no significant changes to the process during 2022.
• The industry permit remains in effect until December 31 ", 2026.
• The industry provided a Spill and Slug Control Plan to the POTW on January 4,
2022. This has been reviewed and added to the file.
3. Cardinal Foods, LLC. (IUP # 0007)
This SIU was inspected once and sampled once by the POTW. The second
sampling event was scheduled for November of 2022. The industry notified the
POTW on October 25th, however, that production had shut down and would be
restarting December 13th. The POTW rescheduled the monitoring for after the
industry was scheduled to be in production again, however, the industry did not
resume any production for the remainder of 2022. As a result, the monitoring for
the second half of 2022 could not be conducted.
• The industry had significant difficulty remaining in compliance with TSS for the
first half of 2022 and was found to be in SNC for this permit parameter. A
consent order with a compliance schedule was drafted by the POTW and agreed
upon by the Town of Wallace and the industry. The order provided relaxed limits
for BOD and TSS and flat fees for civil penalties, in addition to a schedule for
working towards compliance with new/updated pretreatment equipment. This
consent order was signed by all parties on June 6th. A copy is provided with report
as Appendix A.
• On June 7th, an unannounced, onsite inspection was performed in conjunction
with the ORC for the Town of Wallace. Numerous suggestions for BMPs to assist
with obtaining compliance were given to the industry during the inspection. It was
also noted that the industry was operating process units in areas previously unused
by this industry, apparently in preparation for future building modifications.
• The industry continued to have issues with non-compliance into the second half of
2022 to spite the relaxed limits in the compliance order. The industry was found
to be in SNC for BOD, TSS and pH for the second half of 2022.
• On September 30th, the ORC of the Town of Wallace WWTP noted a slug of
milky material entering their plant. The ORC traced this back to several lift
stations in Burgaw. Visual inspection of the lift stations revealed chunks of sweet
potato floating in the wet wells. Grab samples were taken from the wet wells by
the ORC and later showed high levels of BOD, TSS, and Ammonia.
• As a result of the slug to the Wallace WWTP, the Town of Burgaw did not renew
IUP 0007, which expired October 1st, 2022, and the Town of Burgaw issued a
formal Cease Discharge order to Cardinal Foods effective October Yd, 2022. A
copy of this order is included in this report as Appendix B.
• An agreement was reached between the Town of Wallace, the Town of Burgaw,
and the industry to allow the discharge of clean up water (and other non -process
wastewater) to the collection system, but to require the industry to pump and haul
any process wastewater until such time as new/updated pretreatment equipment
was identified and installed as agreed upon by both Wallace and Burgaw.
• The industry operated production up until October 25th, 2022, following the
permit renewal. At the time of this report, the industry is investigating various
types of pretreatment, and is not running production.

• Ten (10) notices of violation were issued to the industry in 2022, covering 58
individual violations. The industry has been assigned a total of $29,300.00 in civil
penalties for the 2022 violations. The SNC status of the industry was published in
The Pender-Topsail Post & Voice on February 16th, 2023. A copy of the notice is
included in this report with the SNCR.
• The Burgaw Pretreatment Program is actively working with the industry to
identify and approve an acceptable option for pretreatment going forward.

Public Notice
The Town of Burgaw, in accordance with Federal and State Regulations, is hereby giving
public notice. Listed below are Significant Industrial Users of the Town of Burgaw
Publicly Owned Treatment Works (POTW) that were in Significant Non -Compliance
with national pretreatment regulations 40 CFR Part 403, state pretreatment regulations 15
NCAC 2H .0900, or local pretreatment regulations at any time during the 2022 calendar
year.
Cardinal Foods of Burgaw was in Significant Non -Compliance for exceedance of TSS
limits for the first semi-annual period of 2022 and for exceedance of BOD, TSS, and pH
limits for the second semi-annual period of 2022. The industry was issued Notices of
Violation and civil penalties per the Town's Enforcement Response Plan and was placed
on a compliance schedule.

Last year, you submitted a publication for me to the Town's governmental section in the local newspaper. This was to
satisfy a state requirement for the Town's Pretreatment Program.
I am requesting that you please submit one for the program again this year. I've attached the needed publication. As with

CONSENT ORDER AND COMPLIANCE SCHEDULE
Pursuant to provisions of the Sewer User Ordinance and the Enforcement Response Plan of the
Town of Burgaw, this Consent Order is made effective the 6th day of June 2022, between Cardinal
Foods, LLC. (hereinafter the "User") and the Town of Burgaw (hereinafter the "Town").
The User and Town hereby stipulate and agree as follows:
1. User holds Town of Burgaw Pretreatment Permit No. 0007 (hereinafter the "Permit", which
shall refer to User's existing permit and any subsequent renewals or modifications thereof)
for the operations of existing pretreatment units and discharges from said treatment works
into the Town's sewer system.
2. User has been unable to meet the permit limitations for BOD, TSS and pH set forth in its
Permit.
3. Achievement of these limits will require resolution of existing problems in the present
treatment train and possibly, development of alternative solutions to alleviate
noncompliance, including but not limited to the construction of additional pretreatment
facilities as well as the preparation of plans and specifications as necessary.
4. User hereby agrees to do and perform all of the following:
a. Meet and comply with all terms and conditions of the Permit (except as modified by the
Order) provided, however, subject to the terms and conditions of the Consent Order, the
following shall apply:

b. Unless and until Compliance is achieved, the User will undertake activities necessary to
bring the User into Compliance in accordance with the following schedule:

and waste minimization alternatives.
(v) Complete identified pretreatment construction/pollution December 9, 2022
prevention/ waste minimization alternatives and/or
process alternatives.
(vi) Complete analysis of implemented changes and make January 10, 2023
necessary modifications to optimize and obtain full
operational status.
(vii) Achieve compliance with final (IUP) limits. March 1, 2023
C. User shall perform each of the activities set forth in subparagraph (b) on or before the dates
established thereby unless such dates are extended by agreement of User and the Town
may request such extensions for good cause, and the Town will not unreasonably withhold
its consent to such extensions.
d. User shall submit a comprehensive written resort within five (5) days followina each
milestone date specified in subparagraph (b). Each such report shall be in narrative form,
shall state in detail the activities undertaken since the last report to achieve compliance, and
shall indicate whether User has met the due date for the relevant milestone established in
this Consent Order. If any report contains notice of failure to meet a milestone date, the
report shall also include a statement explaining the cause of the failure, any remedial actions
taken, and the probability of meeting the next milestone.
All reports required by the Consent Order shall be original reports, signed by the authorized
industrial representative, and submitted to the Town by Certified Mail, Return Receipt
Requested, addressed to:

The User shall pay the Town $1,000, no later than June 20, 2022, for the Significant Non -
Compliance during the July through December 2021 reporting period.
Any violation of the terms of this Consent Order shall subject the User to the enforcement
authority outlined in the Ordinance. Such action may include, but is not limited to such fines,
penalties and assessments as may be set forth in the Code of Ordinance of the Town of
Burgaw, as amended from time to time.
In lieu of other penalties, the following stipulated penalties shall apply for violations of the
User's limits or failure to meet a milestone date under this Consent Order, or failure to
achieve full compliance with Consent Order.

Once compliance is achieved, this Consent Order shall terminate and all obligations
hereunder except any obligation to pay identified moneys to the Town shall expire. Upon
termination of this Order, the User shall be subject to all terms of the Permit.
h. The User may request an extension of any deadline herein. The request must be in written
form and shall follow the requirements of section d. above, including submission of the
written request. The Town may not unreasonably withhold approval of such a request,
provided that the User is in compliance with the remainder of this Order and can demonstrate
that the proposed new deadline will not extend this compliance schedule beyond what is
determined by the Director to be acceptable for the Town's operations.
In the performance of activities under this Consent Order, User must otherwise follow the
procedures, rules, regulations, ordinances, and statutes of the Town, State, and Federal
governments as they may apply to User. Nothing contained herein shall be construed as a
waiver thereof by the Town.

Appendix B: IUP 0007 Cease

ORDER TO CEASE DISCHARGE
Pursuant to provisions of the Sewer User Ordinance, Section 8.1 (d), and the Enforcement
Response Plan of the Town of Burgaw, Cardinal Foods, LLC., Significant Industrial User Permit
0007, herein after referred to as 'User', is hereby ordered to cease discharge of all non -domestic
sources of wastewater, pretreated or otherwise, to the Town of Burgaw Collection System
immediately and until further notice. In addition to this written notice, verbal order to cease
discharge was provided to the User on September 30, 2022, at 1:38 PM.
The following reasons are cited in reference to this order to cease discharge:
1. User holds Town of Burgaw Industrial User Permit (IUP) #0007 for the operations of
existing pretreatment units and discharges from said treatment works into the Town's
collection system which expires October 1, 2022.
2. User has been unable to meet the permit limitations for BOD, TSS and pH set forth in its
Industrial User Permit.
3. User has been under a consent order with a compliance schedule dated June 6, 2022,
which contains relaxed limits and additional requirements for BOD, TSS and pH testing.
This compliance schedule also contains requirements for milestones, including completion
of the Application for Authorization to Construct.
4. User has been unable to meet the June 6, 2022, consent order limitations for BOD, TSS
and pH, and has discharged at more than four times the consent order limits for BOD and
more than eight times the consent order limits for TSS in August of 2022. Additionally, pH
values have repeatedly been in the range of 4 to 5, which is below the permitted range of
6.0 to 9.0.
5. User has failed to complete the Application for Authorization to Construct, which was due
July 25, 2022, per the consent order. The blank Application for Authorization to Construct
was provided to User on multiple occasions, including most recently, May 9, 2022, and July
10, 2022.
IUP #0007 expires on October 1, 2022. At this time, the IUP renewal is on hold until further notice.
Please note that discharging without a current IUP is a violation of the Town of Burgaw Sewer Use
Ordinance.
