Division of Water Quality holds a public hearing Dec. 9 about the N.C. Department of Transportation application for a permit to build the Monroe Bypass. The public will be allowed to speak for three minutes. The hearing was requested by the Southern Environmental Law Center. It represents environmental groups which successfully halted bypass construction in 2012 through a lawsuit and aims to the same again. In May 2012, a panel of federal appeals judges ruled that NCDOT's impact studies used flawed data. NCDOT presented a revised impact study late last year. Officials have begun the process of getting the permits required to restart construction. Though the project was permitted, the permitting agencies withdrew the permits after the federal appeals court ruling that rejected the impact studies. SELC attorney Kate Asquith wrote a 50 -page Nov. 24 letter to NCDWQ stating NCDOT has not properly performed the revised impact study properly. She cited outdated traffic forecasts, flawed determination of need and other problems with the required document.
