Formal concurrence on avoidance and minimizarion will be requested during this meeting. 1.2 Project Description Project R-5014 is programmed in the current 2012-2020 NCDOT State Transportation Improvement Program (STIP). The proposed project involves operational and safety improvements to SR 1217 (Colington Road) from the end of the road to US 158 (Croatan Highway). The project area is shown on Figure 1 and Figure 2. The proposed project is appro�mately 4.3 miles long. 1.3 Purpose of the Proposed Action The purpose of the proposed project is to reduce roadway flooding and improve the operation of SR 1217 (Colington Road). Colington Road is overtopped by wind tides several times a year in several locations. The proposed project will raise the grade of Colington Road in these areas to reduce the frequency of water overtopping the roadway. T��1���� � . The narrow lanes along much of Colington Road, along with the heavy traffic volumes, exacerbate the operational issues. Colington Road experiences a substantial amount of bicycle and pedestrian traffic, particularly within the Wright Brothers National Memorial property and in the vicinity of First Flight High School. At the October 24, 2011 citizens informauonal workshop for the project, many of the comments were related to safety concerns along Colington Road, including for pedestrians and bicyclists, and several of those attending requested improved bicycle and pedestrian accommodations be provided. There is also strong local interest in a multi-use path along Colington Road. A resolution was passed by Dare County, Kill Devil Hills, and Colington Harbour on July 18, 2007, requesting NCDOT provide a multi-use path as part of improvements to the road. 1.4 Proposed Improvements NCDOT proposes to resurface, raise, widen, and slightly realign portions of Colington Road to improve operational and safety conditions along the road. Typical Sections As shown on Figure 3, from the end of Colington Road to Colington Drive the proposed project will involve resurfacing Colington Road. The e�sting nine-foot travel lanes and two-foot unpaved shoulders will be maintained. FYOm Colington Drive to SR 1452 (Baum Bay Drive), the proposed rypical secrion includes 11-foot travel lanes with ten-foot shoulders (seven-foot paved in order to accommodate bicycles). The section of Colington Road within the Wright Brothers National Memorial between Baum Bay Drive and Bermuda Bay Boulevard will also have 11-foot travel lanes, but the shoulders will be narrowed to eight feet (four feet paved) to reduce impacts to the Memorial. From Bermuda Bay Boulevard to US 158, the proposed typical section includes two 11-foot travel lanes, an 11-foot two-way center turn lane, and eight-foot shoulders (four-foot paved). Access and Right-of-way No additional right-of-way is anticipated for the portion of the project between the end of the road and Colington Drive. From Colington Drive to Bermuda Bay Boulevard, a total right-of-way width of 60 to 90 feet is proposed. Between Bermuda Bay Boulevard and US 158, the existing 100-foot right-of-way is expected to be maintained, except for one area between Bermuda Bay Boulevard and Veterans Drive, where an additional approximately 12 feet of right-of-way will be required on the south side of Colington Road. A temporary easement will be required within the Memorial property to accommodate the proposed multi-use path on the south side of Colington Road between Baum Bay Drive and Bermuda Bay Boulevard. No control of access is proposed along SR 1217 (Colington Road) within the project limits. Structures Two bridges are located on Colington Road in the project area. These structures are described in Table 1. Improvements to these structures are not included as part of the project. There are no major proposed structures included in the preliminary design. From Bermuda Bay Boulevard to Veterans Drive paved multi-use paths exist on both sides of the road. The paved path north of Colington Road ends at Veterans Drive. A crosswalk on Colington Road at the signalized intersection with Veterans Drive allows path users to cross Colington Road to access the multi-use path on the south side of the road. The path on the south side of Colington Road continues from Veterans Drive to beyond the project limits, crossing US 158 and NC 12 and ending at a beach access. Photo 2. This project proposes to construct a multi-use path on the south side of Colington Road from Baum Bay to Bermuda Bay Boulevard. The existing path from Bermuda Bay Boulevard to Veteran's Drive would be realigned. Although there is strong local interest in a multi-use path along the entire Colington Road project corridor, there is not sufficient room along most of the corridor because of property impacts. The proposed project includes wider (seven-foot) paved shoulders between Colington Drive and Baum Day Drive to accommodate bicyclists. 3 2.0 ENVIRONMENTAL EVALUATION 2.1 Summary of Impacts Figure 2 shows environmental features in the project area. ZSum of surface waters (0.8 acre) and identified wetlands (2.3 acres). 4 2.2 Natural Environment Impacts Streams, Wetlands and Other Surface Waters The project is within the Pasquotank River Basin (HUC 03010205). Waters within the study area include Blount Bay (Stream Index No. 30-19), Colington Creek (Stream Index Nos. 30-19-1 (north of Colington Road bridge) and 30-21-1-1 (south of Colington Road bridge)) and contiguous open water canals. There are 22 jurisdictional surface waters, 28 jurisdictional wetlands, and one non- jurisdictional pond within the study aYea. Table 3 on the next page summarizes the surface water impacts as a result of the proposed project, and Table 4 summarizes the wetland impacts. All of the surface waters are classified SC, defined as tidal salt waters protected for secondary recreation, fish and noncommercial shellfish consumption, aquatic life propagation and survival, and wildlife. Colington Creek is designated as a special secondary nursery aYea (SSNA) within the study area. There are no anadromous fish waters, Primary Nursery Areas (PNAs), ar designated Critical Areas (CAs) in the study area. There are also no designated High Quality Waters (HQWs), Outstanding Resource Waters (ORWs), or water supply watersheds (WS-I or WS-II) within one mile of the study area. There are no waters within the study area on the North Carolina 2014 Final 303(d) list of impaired waters. Coastal Area Management Act The surface waters in the stud�� area, including Blount Bay, Colington Creek, and the contiguous canals, are classified as Public Trust Waters (I'TWs) according to the Coastal Area Management Act (CAMA). The PTWs and specific wetlands, noted in Table 4, were also identified as CAMA Areas of Environmental Concern (AEC). A CAMA permit from the North Carolina Division of Coastal Management (NCDCIV� will be required for all impacts to designated AECs within the study area. Essential Fish Habitat The National Marine Fisheries Service (NMFS) has identified the study area to contain Submerged Aquatic Vegetation (SA�, Shellfish Growing Area, and Essential Fish Habitat (EFH). Six commercial fish species were reported that may occur in the area. Because the two structures are not being replaced as part of this project and in-water work is limited, it is unlikely that these species will be affected by the project. Submerged Aquatic Vegetation As requested by the North Carolina Division of Marine Fisheries (NCDMF), an addi�ional SAV study was conducted in 2013. The study was conducted in two locations: Blount Bay (Figure 2C) and Colington Creek (Figure 2E). The three SAV sample sites at Blount Bay totaled approximately 03 acre and were dominated by widgeon grass and small amounts of Eurasian watermilfoil. The SAV sample site at Colington Creek was dominated by widgeon grass with Eurasian watermilfoil interspersed and small amounts of sago pondweed. The site area was approximately 0.5 acre. The project will impact appro�mately 0.3 acre of SAV at the Colington Creek site. [.7 Table 3. E.3 2.3 Cultural Resources Impacts The proposed improvements to Colington Road will affect the Wright Brothers National Memorial, a National Historic Landmark. The proposed project will require approximately 1.8 acres of new permanent easement from the Memorial property, as well as approximately 0.7 acre of temporary easement for the proposed multi-use path. A meeting with NC HPO, NPS, and NCDOT was held on January 13, 2015 to review the potential impacts of the proposed improvements on the Memorial in accordance with Section 106 of the National Historic Preservation Act of 1966, as amended. It was determined the project would have No Adverse Effect on the Memorial, with the condition that the original gate posts for the Memorial on Colington Road are not affected by the proposed project. FHWA intends to use HPO's concurrence as a basis for a de �niniyni.r finding for the Wright Brothers National Memorial pursuant to Section 4(� of the USDOT Act of 1966, as amended. �. . f •- .� � ,.�-;„� A � ,:,,.�. r.7R •� ��-.- - -r �. However, it is not feasible for it to completely avoid impacts to the Waters of the US and meet the purpose and need of the project.
