Angel Reece WWTP Office Manager areece@msdbc.org Office: (828) 225-8321 2022 Update At the beginning of 2021, MSD had twenty-one (21) Significant Industrial User's (SIU's), thirteen (13) of which are Categorical Industrial User's (CIU's) under the Federal Code of Regulations. Eaton Electrical decided to become a Zero Discharge Permit and Continental Automotive Systems Closed. MSD added Clement Pappas, a non -categorical SIU. Therefore, the number of SIU's was nineteen (19) with eleven (11) CIU's at the end of the year. MSD issued fifteen (15) Notice of Violations (NOV's)/Notice of Concerns (NOC's), with one Civil Penalty of $500.00. There are no industries in Significant Non - Compliance (SNC) for the 2022 calendar year. MSD completed required sampling for all SIU and CIU industries throughout the 2022 calendar year. Two SIU's did not discharge during the 2022 calendar year. Please see the notes on Eaton Electrical and Clemet Pappas for further explanation. PAGE 11 Contact the local pretreatment coordinator or state pretreatment staff if en— are noted. 2021 Pretreatment Annual Report Narrative Metropolitan Sewerage District of Buncombe County (MSD) NPDES Permit # NCO024911 Arcadia Farms LLC (S-078) Arcadia Farms LLC was issued a NOV in April for both BOD and TSS and one in November for BOD. Asheville Metal Finishing (S-003) Asheville Metal Finishing had a significant decrease in production and discharge days. Therefore, Asheville Metal Finishing did not sample as frequently as listed in the permit. Asheville Metal Finishing contacted MSD about the less frequent discharges. MSD informed Asheville Metal Finishing that they were not required to pull samples if they were not discharging. Asheville Paint and Powder (S-OOS) Asheville Paint and Powder had a significant decrease in production and therefore discharge. Clement Pappas NC, LLC (S-081) Clement Pappas was issued a permit in the second half of the year. They have not yet discharged any wastewater to MSD. Discharge is expected to begin March 14, 2023. Continental Automotive Systems (5-015) Continental Automotive Systems has closed. The documentation for the closure is in the attachments. Craggy Prison Laundry (5-066) Craggy Prison Laundry had a Notice of Violation for failure to collect samples. They were in a period of employee transition. The issue has been corrected and Craggy did not receive any additional NOV's during 2022. Day International Inc. (S-057) Day international Inc. had a Toluene Violations in November and December. The problem has been corrected. Eaton Electrical (5-014) Eaton Electrical - Arden Plant was issued an updated permit beginning in January 2022, however decided to re -apply for a zero discharge permit since they have hauled their wastewater for several years and do not plan on discharging. Glatfelter Industries Asheville, Inc (S-067) Glatfelter Industries was previously Jacob Holm Industries, America. The new permit reflecting the name change was effective on August 1, 2022. Linamar Light Metals - MR (S-076) Linamar Light Metals was previously GF Linamar. The new permit reflecting the name change was effective on January 7, 2022. Meritor Heavy Vehicle Systems (S-061) Meritor Heavy Vehicle Systems received two NOV's during 2022 one for copper and pH and the other for pH. Meritor submitted two sets of samples to a contract laboratory in November 2022. The first set of samples was lost by the laboratory. MSD did not issue a NOV. Meritor completed their due diligence by collecting the samples and bringing them to the laboratory. Included with the attachments is the chain of custody and sample acknowledgment from the laboratory. Milkco, Inc. (S-036) Milkco, Inc. was issued a flow violation, an unauthorized discharge violation, and a notice of concern. MSD continues to work with Milkco. Milkco is reviewing their pretreatment options for the future. Mission Hospital Laundry (S-068) Mission Hospital Laundry was issued a NOV for pH violations in January. The issue was corrected. New Belgium Brewing (S-075) New Belgium Brewing was issued several bypass authorizations while they worked to clean their membrane filters. Prince Manufacturing (5-065) Prince Manufacturing failed to sample for all required parameters twice during 2022. They had failed to sample for all required parameters during 2021 as well. Each time the failure was sampling that they are only required to sample twice per year unless otherwise noted. To avoid this in the future, the permit was modified to remove the monitoring relief. Prince Manufacturing was also issued a Civil Penalty of $500.00 which they paid. Williams Plating (S-007) Williams Plating received a NOV for January 2022 TTO samples. They continued to monitor and changed one part of the operation. They were able to sample out of SNC. Mailing Mr. Michael J. Henderson Facility One Quality Way Fletcher, North Carolina 28732 Re: Permit Drop Request S-015 Gentlemen, In October 2022, MSD received the plans for the shutdown and clean-up of the Continental Automotive Systems, Inc. Henderson Facility. The facility located at One Quality Way discharged from the production area for the last time on October 31, 2022. MSD staff conducted a walls -through inspection on November 16, 2022. At that time, it was noted that the production discharge point was sealed to prevent any further discharge to MSD, however there was a large amount of remediation remaining before Continental could close the building. A final walls -through of the facility was conducted on December 16, 2022, Most of the building remediation was complete, and the contractors are painting the old plating area. Some chemicals remain in chemical storage, most of which is new chemicals that were unused. A frac tank for some of the building cleanup will remain onsite until the contents can be tested to determine how to properly dispose of the contents. The Metal Finishing, Phosphating, and Powder Paint Operations meets the criteria of 40 CFR 433 and the description of a Zero Discharge Process. B. Location and Position of Process 1. The Metal Finishing. Phosphating and and Powder Paint line wastewater flows to a holding tank. The holding tank discharge to MSD is valved off and has been locked near MP01, Therefore, no wastewater flows through Pipe 01. The tank is easily pumped to a truck for hauling off site. 21Page PART II ZERO DISCHARGE REQUIREMENTS Required Conditions Permit No. Z-072-22 1, Industrial User is prohibited from discharging directly or indirectly, to the MSD sewer system, any wastewater generated from or associated with the Metal Finishing, Phosphating, and Powder Paint Operations. 2. Any wastewater generated from processes or operations immediately pursuant to the Metal Finishing, Phosphating, and Powder Paint Operations operation may not be discharged to the MSD sewer system. 3. It shall be the purpose and intent of the Industrial User to be bound and committed to take any and all actions necessary to prevent any discharge or introduction of the process, mentioned above, into the Metropolitan Sewerage District's sewer system. 4, Under no circumstances will the Industrial User's facility be modified or operated in any manner so as to allow wastewater from the Metal Finishing, Phosphating, and Powder Paint Operations to enter any portion of said plumbing system. S. Statement of Certification a. The Industrial User shall submit the following Statement of Certification due 30 days upon receipt of this permit and, thereafter by the 20th of January of each year for the duration of the permit. 1, hereby, certify that to the best of my knowledge and belief IF, discharge of wastewater generated from or associated with the Metal Finishing, Phosphating, and Powder Paint Operations has occurred since filing the last report dated , 1 further certify that this facility is compliant to the terms and conditions with this Zero Discharge Industrial Waste Permit, b. Should the Industrial User wish to seek approval for such methods of treatment of the generated wastewater to the MSD sewer system will be allowed upon written approval from MSD and a Permit to Discharge Industrial Waste for this process is issued. b. The Industrial User shall give MSD a notice of one hundred and eighty (180) days prior to any expansion, production increase or decrease, or process modification that has the potential to result in new or substantially increase or decreased wastewater generation or a change in the nature of the wastewater generation from the Metal Finishing, Phosphating, and Powder Paint Operations. c. The Industrial User may submit a request to MSD inquiring acceptance of the process wastewater from the Metal Finishing, Phosphating, and Powder Paint Operations. No discharge to the MSD sewer system will be allowed without first obtaining a permit to do so from the Metropolitan Sewerage District of Buncombe County, NC and after satisfying all other applicable requirements. 41Page Permit No. Z-072-22 PART III GENERAL CONDITIONS AND REQUIREMENTS A. Duty to C01BVIV The Industrial User must comply with all conditions of the Permit. Any non- compliance with the Permit constitutes a violation of the SUO and may be grounds for possible enforcement action. The MSD may levy fines of up to twenty-five thousand dollars ($25,000.00) per day per violation. The Industrial User may be subject to criminal penalties levied by the State of North Carolina or the United States of America. B. Right of Entry The Industrial User shall, upon the presentation of credentials, allow access to representatives of MSD into the facility at any reasonable time without advance notice for the purpose of inspecting the facilities for compliance of this Permit: C. Monitoring Access MSD, the Approval Authority and EPA shall have the right to set up on the Industrial User's Property such devices as are necessary to conduct sampling, inspection, compliance monitoring and flow metering operations. D. Availability of Records and Reports The Industrial User shall retain records of all monitoring information, including all calibration and maintenance records as well as copies of reports and information used to complete the application for the Permit for at least three (3) years. All records pertaining to any enforcement action shall be retained and preserved by the Industrial User until all enforcement activities have concluded and all periods of limitation with respect to any and all appeals have expired. Except for data determined to be confidential under the Sewer Use Ordinance, all reports prepared in accordance with terms of the Permit shall be available for public inspection at the Metropolitan Sewerage District. Effluent data shall not be considered confidential. E. Duty to Provide Information The Industrial User shall furnish to the General Manger or his designees, within a reasonable time, any information MSD, or its designee, or the North Carolina Department of Environmental Quality may request to determine whether cause exists for modifying, revolting, and reissuing, or terminating the Permit or to determine compliance with the Permit. Penalties for Falsification of Reports The Metropolitan Sewerage District SUO provides that any person who knowingly makes any false statements or representation in any application or report or other document submitted or required to be maintained pursuant to the SUO or the Permit, or who knowingly renders inaccurate any monitoring device or method required under this ordinance, shall upon conviction be punished by a fine of not more than $25,000 for each violation. NCGS 143-215.613 provides that similar offenses may be punished by a fine of up to $10,000 per violation. G. Signatory atory Requirements All reports or information submitted pursuant to the requirements of the Permit must be signed and certified by the Authorized Representative of the Industrial User as specified in the Application for Permit to Discharge Industrial Waste, If the designation of the Authorized Representative is no longer accurate, a new authorization satisfying the requirements of this section must be submitted to General Manager prior to or together with any reports to be signed by the new Authorized Representative. H. Civil and Criminal Liability Nothing in the Permit shall be construed to relieve the Industrial User from civil or criminal penalties for noncompliance with provisions of the Permit. Federal and State Laws Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties established pursuant to any applicable Federal and State law or regulation. j, Property Rights The Permit does not convey any property rights in either real or personal property, or any executive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any infringement of Federal, State or local laws or regulations. K. The Granodizer was aerated during the same period that the pH readings were above the daily maximum limit. Residuals of the aeration process go into wastewater for pretreatment. During this time frame wastewater storage tank levels were below 4.5 feet, which could have elevated pH levels as there was an insufficient amount of wastewater to dilute the residuals from the Granodizer aeration. No processes or materials have changed. Aeration of the Granodizer equipment is necessary to our production. When this work is performed in the future, effort will be made to verify water levels prior to sending the material to pretreatment. Per Permit S-036-22, Part III B, Milkco, Inc. has a Duty to Mitigate or Prevent Adverse Impact to the collection system and the treatment plant. Per Part III M, the Need to Halt or Reduce Production is not a Defense from enforcement action. MSD acknowledges that Milkco, Inc. attempted to contact the Pretreatment Supervisor around 11 am on Saturday. When Mill(co, Inc. did not receive a response, Milkco, Inc. employees began discharging the batch of buttermilk around 1pm. Proper notification protocol was not met. The Industrial User Permit lists phone numbers to contact after hours and on the weekends. Millcco, Inc. is required to receive authorization prior to discharging any off -spec material. Discharge of any off -spec material without prior authorization is considered willful and intentional to maintain production. Mill(co, Inc. is required by Part III 1, to maintain a Slug/Spill Plan. Additionally, over the weekend, we had a filter power failure, which resulted in about 100hL of beer and some DE to drain, adding to our solids issues. We are currently having to backflush the membranes multiple times per day, limiting the amount of permeate discharged. From a corrective action's standpoint, the drum screen has been repaired (with old spare parts) and is fully operational. We just received a new belt today for our Oberlin DE press, which will also reduce solids from going to drain. It is now just a matter of working the solids through the system and getting the membranes back to a normal setpoint. Since the root causes have been addressed, we are unsure exactly how long a potential bypass may last or how much per day we may discharge, as it depends on how well the plant operates and how much influent we receive to the plant. At this time, our EQ basin is at 4,730hL, with overflow occurring at 5,094hL. There was not enough sample in the composite influent sampler for a sample today, but samples will be taken tomorrow and every day for the next 2 weeks for pH, COD and TSS. The previous bypass approval was for 160gpm and .10mgd. Since wastewater is still being treated, this amount shouldn't be needed. Approval for 50gpm and .072mgd or 75gpm and .10mgd should allow enough buffer to get through this upset. Approval for a two week timeframe (ending 4/18/22) should allow for enough time to work through the solids in the system.
