Dear Ms. Hannan:
On July 10, 2000, the Division received your request to modify permit NC0086169.
Correspondingly, we are forwarding herewith the modifications to the subject permit, which are to be found
on the effluent limitations pages. In accordance with your request, the date on which the permitted flow
increases from 0.0274 MGD to 0.107 MGD will be changed from March 1, 2001 to January 1, 2001.
Please find enclosed the revised permit pages. The revised permit pales should be inserted into your
permit. The old pages may then be discarded. All other terms and conditions contained in the original
permit remain unchanged and in full effect. This permit modification is issued under the requirements of
North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and
the U.S. Environmental Protection Agency.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings
(6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision
shall be final and binding.

During the period beginning on the effective date of the permit and lasting until January I, 2001, the Permittee is authorized to discharge from outfall serial number 003—
Industrial Process Wastewater, Non-contact Cooling Water, and Carbon Filter Backwash. Such discharges shall be limited and monitored by the Permittee
as specified below:

I The compliance point for flow shall be upstream of the non-contact cooling water and boiler blowdown internal outfall. The compliance point for all other parameters
shall be at the Rocky River discharge location.
2 The temperature of the effluent will be regulated so that the temperature of the receiving stream does not increase more than 2.8'C above the natural water temperature.
Receiving water temperature will not exceed a maximum of 32'C.
3 Chronic Toxicity(Ceriodaphnia)at 0.31%;January,April,July and October;See Item A(4)of the Supplement to Effluent Limitations and Monitoring Requirements.
4 The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.

There shall be no discharge of floating solids or visible foam in other than trace amounts.

As indicated in our NPDES Permit, No. NC0086169 and per our request, effluent
limitations for the proposed flow of 0.017 MGD become effective on March 1, 2001.
Based on current construction progress, we are requesting that the March 1, 2001 date be
changed to January 1, 2001. At that time, the permitted flow will increase from 0.0274
MGD to 0.107 MGD and the chronic toxicity concentration will increase from 0.31% to
1.0% per the permit.
