The designation Grantor and Grantee as used herein shall include said parties, their heirs, successors, and assigns, and
shall include singular, plural, masculine, feminine or neuter as required by context.
WITNESSETH, that the Grantor, for a valuable consideration paid by the Grantee, the receipt of which is hereby
acknowledged, has and by these presents does grant, bargain, sell and convey unto the Grantee in fee simple, all that
certain lot or parcel of land situated in the City of None , Snow Creek Township,
Mitchell County, North Carolina and more particularly described as follows:
Those lands described in Schedule "A" attached hereto and incorporated herein by reference.
The property hereinabove described was acquired by Grantor by instrument recorded in Book 315, Page 488, Mitchell
County Reqistrv.
A map showing the above described property is recorded in Plat Book
page
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and appurtenances thereto belonging to
the Grantee in fee simple.
And the Grantor covenants with the Grantee, that Grantor is seized of the premises in fee simple, has the right to convey
the same in fee simple, that title is marketable and free and clear of all encumbrances, and that Grantor will warrant and
defend the title against the lawful claims of all persons whomsoever except for the exceptions hereinafter stated.
Title to the property hereinabove described is subject to the following exceptions:
a. Title to the property is subject to those easements of record together with all ordinary and customary easements and
rights of way for roads, highways and utilities.
b. Title to the property is subject to any condition apparent from a visual inspection of the premises
c. Description of the premises is subject to any errors, lappages or departures as would be revealed by a more accurate
survey of the premises.

SCHEDULE "A"
FIRST TRACT: Adjoining the lands of Maurice Jarrett, Mrs. Milton Young, Oscar O. Wilson, et als and
BEGINNING in the old road at the corner of a lot deeded to Oscar Wilson and runs with his line north 9
west 19 poles and 6 links to his corner; thence south 78 west with said line 14 %2 poles to a stake in the
old Young and Norman line; thence with said line north 9 west 21 poles and 7 links to a stake at the old
corner; thence north 50 east with the old line 45 poles to a stake near the branch; thence south 15 degrees
and 30 minutes east 32 poles to a stake; thence north 85 east 11 poles and 16 links to the northwest
corner of the school house lot; thence with the school lot line south 5 east 34 poles and 8 feet to a stake
at the southwest corner of school lot; thence north 87 east with the school lot line 15 poles and 6 feet to
a stake, corner of school lot; thence crossing the road 4 poles and 10 feet to the old Norman line; thence
with the old road westward 47 poles to the BEGINNING, containing 13.5 acres.
SECOND TRACT: Adjoining the lands of Milton Young et als and BEGINNING on a black oak, known as the
Milton Young corner, standing on the bank of the old road (an old corner) and runs with the old line north
9 west 12 poles to a stake; thence north 81 east 14 poles to a stake; thence south 12 east 20 % poles to a
stake in the old Marion-Bakersville Road; thence up with the road north 70 west 16 poles to the
BEGINNING, containing one and one-half (1 % ) acres, more or less.
THIRD TRACT: Adjoining the School House Property, Frank Greene, et als and BEGINNING on an iron stake
in Lee Greene's line, said stake is Frank Greene's southwest corner, and runs with Frank Greene's line
north 64 east 173 %2 feet to an iron stake on the west side of the Frank garland and Morris Jarrett Road;
thence down and with the west side of said road south 18 degrees 30 minutes east 344 feet to a stake, a
corner of the Ledger School House Property; thence south 85 west 192 feet to a stake, Lee Greene's
corner; thence south 85 west 192 feet to a stake, Lee Greene's corner, thence north 15 degrees 30
minutes west 267 %Z feet to the BEGINNING, and containing 1.3 acres, more or less.
There is excepted from the above -referenced tracts the following properties:
(1) A one -acre tract of land conveyed by W.N. Greene, Widower, and Lee Greene, single, to Frank Garland
and wife, Jolene Garland, by deed dated 13 January 1955, recorded at Book 177, page 439, in the Office
of the Register of Deeds for Mitchell County.
(2) A quitclaim deed from Lee Greene and wife, Maude H. Greene, to Henry H. Ingram and wife, Eulalia
M. Ingram. Said deed being dated 15 August 1974 and recorded in Book 147, page 64, in the Office of the
Register of Deeds for Mitchell County.
(3) That property condemned by the North Carolina Department of Transportation in a Consent Judgment
filed with the Clerk of Superior Court of Mitchell County, in file number 78 CvS 57; said action being
entitled " Department of Transportation, Plaintiff vs. Lee Greene and wife, Maude H. Greene,
Defendants."
(4) Grantors except and reserve unto themselves all of that portion of the lands described herein above
lying on the south side of the present-day N.C. Highway 226.
