Said deed being dated 15 August 1974 and recorded in Book 147, page 64, in the Office of the Register of Deeds for Mitchell County. (3) That property condemned by the North Carolina Department of Transportation in a Consent Judgment filed with the Clerk of Superior Court of Mitchell County, in file number 78 CvS 57; said action being entitled " Department of Transportation, Plaintiff vs. Lee Greene and wife, Maude H. Greene, Defendants." (4) Grantors except and reserve unto themselves all of that portion of the lands described herein above lying on the south side of the present-day N.C. Highway 226.
