2.TheOperationalAgreementbetweenthePermitteeandtheEnvironmentalManagementCommission
isincorporatedhereinbyreferenceandshallbeaconditionofthispermit.Noncompliancewiththe
termsoftheOperationalAgreementshallsubjectthePermitteetoallsanctionsprovidedbyNorth
CarolinaGeneralStatutes§143Ͳ215.6Ato§143Ͳ215.6Cforviolationoforfailuretoactinaccordance
withthetermsandconditionsofthispermit.[15ANCAC02T.0115]


II.STANDARDCONDITIONS

1.Thispermitshallnotbetransferable.Intheeventthereisadesireforthewastewatercollection
facilitiestochangeownership,orthereisanamechangeofthePermittee,aformalpermitrequest
shallbesubmittedtotheDivisionaccompaniedbydocumentationfromthepartiesinvolved,and
othersupportingmaterialsasmaybeappropriate.Theapprovalofthisrequestshallbeconsidered
onitsmeritsandmayormaynotbeapproved.[15ANCAC02T.0116;G.S143Ͳ215.1(d3)]

2.Thispermitshallbecomevoidableunlessthewastewatercollectionfacilitiesareconstructedin
accordancewiththeconditionsofthispermit;15ANCAC02T;theDivision’sGravitySewerMinimum
DesignCriteriaadoptedFebruary12,1996asapplicable;theDivision’sMinimumDesignCriteriafor
theFastͲTrackPermittingofPumpStationsandForceMainsadoptedJune1,2000asapplicable;and
othersupportingmaterialsunlessspecificallymentionedherein.[15ANCAC02T.0110]

3.Thispermitshallbeeffectiveonlywithrespecttothenatureandvolumeofwastesdescribedinthe

4. Thewastewatercollectionfacilitiesshallbeproperlymaintainedandoperatedatalltimes.The
PermitteeshallmaintaincompliancewithanindividualsystemͲwidecollectionsystempermitforthe
operationandmaintenanceofthesefacilitiesasrequiredby15ANCAC02T.0403.Ifanindividual
permitisnotrequired,thefollowingperformancecriteriashallbemet:
a. Thesewersystemshallbeeffectivelymaintainedandoperatedatalltimestopreventdischarge
tolandorsurfacewaters,andtopreventanycontraventionofgroundwaterstandardsorsurface
waterstandards.
b. Amapofthesewersystemshallbedevelopedandshallbeactivelymaintained.
c. Anoperationandmaintenanceplanincludingpumpstationinspectionfrequency,preventative
maintenanceschedule,sparepartsinventoryandoverflowresponsehasbeendevelopedand
implemented.
d. Pumpstationsthatarenotconnectedtoatelemetrysystemshallbeinspectedeveryday(i.e.365
daysperyear).Pumpstationsthatareconnectedtoatelemetrysystemshallbeinspectedat
leastonceperweek.
e. HighͲprioritysewerlinesshallbeinspectedatleastoncepereverysixͲmonthsandinspectionsare
documented.
f. Ageneralobservationoftheentiresewersystemshallbeconductedatleastonceperyear.
g. OverflowsandbypassesshallbereportedtotheappropriateDivisionregionalofficeinaccordance
with15ANCAC2B.0506(a),andpublicnoticeshallbeprovidedasrequiredbyNorthCarolina
GeneralStatute§143Ͳ215.1C.
h. AGreaseControlProgramisinplaceasfollows:
1. Forpublicownedcollectionsystems,theGreaseControlProgramshallincludeatleast
biannualdistributionofeducationalmaterialsforbothcommercialandresidentialusersand
thelegalmeanstorequiregreaseinterceptorsatexistingestablishments.Theplanshallalso
includelegalmeansforinspectionsofthegreaseinterceptors,enforcementforviolatorsand
thelegalmeanstocontrolgreaseenteringthesystemfromotherpublicandprivatesatellite
sewersystems.
2. Forprivatelyownedcollectionsystems,theGreaseControlProgramshallincludeatleastbiͲ
annualdistributionofgreaseeducationmaterialstousersofthecollectionsystembythe
permitteeoritsrepresentative.
3. GreaseeducationmaterialsshallbedistributedmoreoftenthanrequiredinParts(1)and(2)
ofthisSubparagraphifnecessarytopreventgreaseͲrelatedsanitaryseweroverflows.
i. RightͲofͲwaysandeasementsshallbemaintainedinthefulleasementwidthforpersonneland
equipmentaccessibility.
j. DocumentationshallbekeptforSubparagraphs(a)through(i)ofthisRuleforaminimumofthree
yearswithexceptionofthemap,whichshallbemaintainedforthelifeofthesystem.

5. ThePermitteeshallreportbytelephonetoawaterresourcesstaffmemberattheRaleighRegional
Office,telephonenumber(919)791Ͳ4200,assoonaspossible,butinnocasemorethan24hours,
followingtheoccurrenceorfirstknowledgeoftheoccurrenceofeitherofthefollowing:

a. Anyprocessunitfailure,duetoknownorunknownreasons,thatrendersthefacilityincapable
ofadequatewastewatertransport,suchasmechanicalorelectricalfailuresofpumps,line
blockageorbreakage,etc.;or
b. AnySSOand/orspillover1,000gallons;or
c. AnySSOand/orspill,regardlessofvolume,thatreachessurfacewater
Voicemailmessagesorfaxedinformationispermissible,butthisshallnotbeconsideredastheinitial
verbalreport.Overflowsandspillsoccurringoutsidenormalbusinesshoursmayalsobereportedto
theDivisionofEmergencyManagementattelephonenumber(800)858Ͳ0368or(919)733Ͳ3300.
Personsreportinganyoftheaboveoccurrencesshallfileaspillreportbycompletingandsubmitting
PartIofFormCSͲSSO(orthemostcurrentDivisionapprovedform)withinfivedaysfollowingfirst
knowledgeoftheoccurrence.Thisreportmustoutlinetheactionstakenorproposedtobetakento
ensurethattheproblemdoesnotrecur.PartIIofFormCSͲSSO(orthemostcurrentDivisionapproved
form)canalsobecompletedtoshowthattheSSOwasbeyondcontrol.[G.S.143Ͳ215.1C(a1)]

6. Constructionofthegravitysewers,pumpstations,andforcemainsshallbescheduledsoasnotto
interruptservicebytheexistingutilitiesnorresultinanoverfloworbypassdischargeofwastewater
tothesurfacewatersoftheState.[15ANCAC02T.0108(b)]

7. Uponcompletionofconstructionandpriortooperationofthesepermittedfacilities,thecompleted
EngineeringCertificationformwithchecklistattachedtothispermitshallbesubmittedwiththe
requiredsupportingdocumentstotheaddressprovidedontheform.Acompletecertificationisone
wheretheformisfullyexecutedandthesupportingdocumentsareprovidedasapplicable.Any
wastewaterflowmadetributarytothewastewatercollectionsystemextensionpriortocompletion
ofthisEngineer'sCertificationshallbeconsideredaviolationofthepermitandshallsubjectthe
Permitteetoappropriateenforcementactions.

IfthepermitisissuedtoaprivateentitywithanOperationalAgreement,thenacopyoftheArticles
ofIncorporation,Declarations/Covenants/Restrictions,andBylawsthathavebeenappropriately
filedwiththeapplicableCounty’sRegisterofDeedsofficeshallbesubmittedwiththecertification.

Acompletecertificationisonewheretheformisfullyexecutedandthesupportingdocumentsare
providedasapplicable.Supportingdocumentationshallincludethefollowing:

a. Onecopyoftheprojectconstructionrecorddrawings(plan&profileviewsofsewerlines&force
mains)ofthewastewatercollectionsystemextension.Finalrecorddrawingsshouldbeclearon
theplansorondigitalmedia(CDorDVDdisk)andaredefinedasthedesigndrawingsthatare
markeduporannotatedwithafterconstructioninformationandshowrequiredbuffers,
separationdistances,materialchanges,etc.

b. Onecopyofthesupportingapplicabledesigncalculationsincludingpipeandpumpsizing,velocity,
pumpcycletimes,andlevelcontrolsettings,pumpstationbuoyancy,wetwellstorage,surge
protection,detentiontimeinthewetwell,andforcemain,abilitytoflushlowpointsinforce
mainswithapumpcycle,anddownstreamsewercapacityanalysis.Ifaportablepowersourceor
pumpisdedicatedtomultiplestations,anevaluationofallthepumpstations’storagecapacities
andtherotationscheduleoftheportablepowersourceorpump,includetraveltimeframes,shall
beprovided.

c.ChangestotheprojectthatdonotresultinnonͲcompliancewiththispermit,regulations,orthe
MinimumDesignCriteriashouldbeclearlyidentifiedontherecorddrawings,onthecertification
inthespaceprovided,orinwrittensummaryform.

PriortoCertification(FinalorPartial):Permitmodificationsarerequiredforanychangesresulting
innonͲcompliancewiththispermit(includingbutnotlimitedtopipelengthchangesof10%or
greater,increasedflow,pumpstationdesigncapacitydesignincreasesof5%orgreater,and
increasesinthenumber/typeofconnections),regulations,ortheMinimumDesignCriteria.
RequestedmodificationsorvariancestotheMinimumDesignCriteriawillbereviewedonacaseͲbyͲ
casebasisandeachonitsownmerit.PleasenotethatvariancestotheMinimumDesignCriteria
shouldberequestedandapprovedduringthepermittingprocesspriortoconstruction.AfterͲ
constructionrequestsarediscouragedbytheDivisionandmaynotbeapproved,thusrequiring
replacementorrepairpriortocertification&activation.[15ANCAC02T.0116]

8.GravitysewersinstalledgreaterthantenpercentbelowtheminimumrequiredslopepertheDivision’s
GravitySewerMinimumDesignCriteriashallnotbeacceptableandshallnotbecertifieduntil
corrected.Ifthereisanunforeseenobstacleinthefieldwhereallviablesolutionshavebeen
examined,aslopevariancecanberequestedfromtheDivisionwithfirmsupportingdocumentation.
Thisshallbedonethroughapermitmodificationwithfee.Suchvariancerequestswillbeevaluated
onacaseͲbyͲcasebasis.Resolutionofsuchrequestshallbeevidentpriortocompletingandsubmitting

9.Acopyoftheindividualpermitandconstructionrecorddrawingsshallbemaintainedonfilebythe
