In accordance with Division policy, we must hereby return the attached permit modification request
received on October 31, 2001. After a preliminary review by the NPDES staff, the Division has determined that
the request package lacks the following items:
■ Correct fee. The correct fee for this type of modification is $215.00, payable by check to
NC DENR (see attached fee schedule).
■ Authorization to represent permittee. This request has no documentation from the
permittee. If an Authorized Representative (such as a consulting engineer or environmental
consultant) submits a permit application or modification request, written documentation
must be provided showing the authority delegated to the Authorized Representative (see
Part II.B.1 Lb of the existing NPDES permit).
If the Town of Hertford wishes to request this modification, include the items list above when
resubmitting your request. Submit the items listed above and the items returned to you in one package.

NOTES/ SUMMARY
TB The Town of Hertford has an NPDES permit for 0.7 MGD and has submitted a design for expanding its plant to
0.7 and adding a spray irrigation system to reuse a portion of the treated effluent. What impact will the reuse
project have on the NPDES limits? Want to make sure the expansion is designed for the correct limits.
MET The reuse project itself will not impact NPDES limits; reuse limits are often tighter anyway. The Town should
send us a letter (recommend 180 days lead) describing the proposal and requesting a permit mod to reflect the
diversion of effluent for reuse. They can probably start up the reuse system without the NPDES mod,
assuming they have a Non -Discharge permit for it, we have the mod request, and there are no other wrinkles.
We will change the Supplement to Cover Page in the permit to reference the ND permit by number. Will also
need to clarify in the permit that the approved average design flow for the plant is still 0.7 MGD, regardless of
how much water is diverted for reuse.

Dear Mr. Green:
The Division has reviewed the proposed change of the outfall location. Though the
proposed relocation likely will have no effect on the permit limitations and monitoring requirements,
the Division feels a 1.4 mile relocation is significant and warrants a permit modification. The Division
is willing to expedite the permit modification process as much as possible.
Please be aware that relocation of an outfall requires a major permit modification. Major
permit modifications require a 30-day public notice period and a fee of $215.00 for minor facilities
(defined as flow less than 1.0 MGD). Please submit a letter requesting the modification, along with a
completed Standard Form A (available on the NPDES web page, referenced below) and the
modification fee to Charles Weaver at the address referenced below. Again the Division will make
every effort to expedite this modification.

Please! Find attached a letter from Green Engineering asking for clarification on a permitting
point. The existing permit requires a new discharge line be constructed to the Perquimans River. The
new discharge point was located in the Perquimans River at the existing effluent channel. It has been
determined that because of river access a discharge line at the proposed point is extremely costly. The
only possible solution for Hertford is to locate the discharge alonq side the Town of Winfall force main
crossing as shown in the attached map. Mr. Green, of Green Enineering asks if a permit modification
is required to relocate the discharge point 1.4 miles downstream. To the best of my knowledge, this
location will not alter any permit conditions or change the impacts on downstream waters. A permit
modification will at this pant hinder the construction process and it is hoped a modification will not be
required.
The Region recommends that if it is legally possible a permit modification not be required.
