This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). If any parts,measurement frequencies or sampling requirements contained in this permit are unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition,conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made,this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. In order to minimize disparities, regional staff recommend that both permits be renewed with BOD limits of 30 and ammonia limits of 2&4 . Discrepancies in DWQ' s approach to the two facilities is explained below. Outward Bound - Communication with Central Office Staff on this date indicated that Outward Bound' s permit would be renewed with BOD of 5&10 and NH-3 of 2&4 . DWQ issued the NPDES Permit on April 21, 1995 . The permit' s cover letter required submittal of an EAA within 12 months . The regional office received a thorough and well done EAA on July 29, 1996 . The permittee operates and maintains their treatment plant exceptionally well . Regional staff' s contact with the NPDES unit concerning the renewal was prompted by the facility' s plans to rehabilitate their treatment plant . The facility wanted to know if there would be any substantive limits . changes prior to expending funds to improve the plant . The permit issued April 27, 1995 with a cover letter requiring an EAA within 180 days prior to expiration of the permit . To the best of Regional staff' s knowledge, the facility has not initiated an EAA. The facility' s owners marginally operate the treatment plant . DWQ' s last three inspections were NOVs; enforcement will be recommended. Comparison of facts detailed above reveal that DWQ plans to require more stringent BOD limits for a permittee who has completed the required EAA, who operates and maintains their plant exceptionally well, and who is planning to rehabilitate their plant to insure continued excellent operation. Staff' s observations suggest that non-discharge options are unlikely to exist for Jonas Ridge Nursing Home . Therefore, an EAA would probabl not produce feasible options for Jonas Ridge Nursing Home . nce continuation of the discharge will likely occur, fairness dictates that we provide an excellent performer (Outward Bound School) the same limitations and treatment proposed for Jonas Ridge Nursing Home JONAS RIDGE NURSING HOME JOHN BARRIER, OWNER P.O.
