Joey Winston, Thank you for your comments to the PCN and Plans submitted for the Gamewell Park Abingdon Creek project. The following are our responses to your comments. Attached is a revised Sheet 0.2 of the plans. Do note in Section E, Part 1b of the PCN it states: "Some of the work will be conducted in sections of existing channel and will utilize a pump or pipe around system in order divert flows away from active work areas. However, due to the size of the watershed (greater than 5 square miles) it will not be feasible to pump/pipe around the stream base flow for most of the project work. In these areas, the contractor shall use gravel and cobble to create a berm that diverts flows around active work areas to minimize interaction of stream flows with areas being disturbed by earth and construction activities. Also, construction impacts will be minimized by limiting in -channel work to low -flow conditions and working from the streambanks where possible." There is 830 linear feet of Abingdon Creek in the project area. The stream work starts outside of the DOT right- of-way for Morganton Blvd. at station 1+30. See Sheets 1.1 and 1.2, look for start of 'Design Riffle.' The impacts to the stream will be 700 linear feet. Also, the work in the stream between stations 8+00 and 8+30 is above the ordinary high water mark and are not impacts to waters. If you have any questions or need clarification, please let me know. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Notes 35 and 36 of Sheet 0.2 of the project plans indicate that a temporary pump around system will be used on Shoal Creek and a temporary diversion will be used on Boylston Creek. Please clarify and update plans to reflect when a temporary pump around system and a temporary diversion will be used. [15A NCAC 02H .0502(a)(4)] 2. The application indicates that 830 linear feet of stream was identified within the project area and that 700 linear feet of impact is proposed. Project plans appear to show impacts to all stream length within the project area. Please clarify where 130 linear feet of stream is not proposed to be impacted. [15A NCAC 02H .0502(a)(4)] Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by March 24, 2023. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee. Please let me know if you have any questions.
