Easley, Governor C D E ■ William G. Ross, Jr., Secretary Kerr T. Stevens, Director NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES March 9, 2001 Mr. James S. Erwin, Jr. Henderson County Utilities Department 101 East Allen Street Hendersonville. North Carolina 28792 _- Subject: Issuance of NPDES Permit NC0086070 NC Justice Academy WWTP Henderson County Dear Mr. Erwin: Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Division personnel have reviewed your request for changes to BODS and NH3 - N limits. Based on the amount of public interest and the irrigation practices of the area, the Division must deny your request. These stringent limits would not normally be imposed where the receiving stream has significant flow, however several water withdrawals from the creek (for irrigation) cast doubt on the low-flow estimates of this stream. The hearing officer also took the public comments into account and recommended the strictest effluent limits possible as an extra precaution. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. 1617 Mail Service Center,Raleigh,North Carolina 27699-1617 Telephone(919)733-5083 FAX(919)733-0719 An Equal Opportunity Affirmative Action Employer VISIT US ON THE INTERNET©httpJ/h2o.enr.state.nc.us/NPDES 1 • Permit NC0086070 SUPPLEMENT TO PERMIT COVER SHEET Henderson County Utilities Department is hereby authorized to: 1. Stevens, Director Division of Water Quality 1617 Mail Service Center Raleigh, NC 27699-1617 RE: NPDES Permit#NC 0086070 Henderson County's WWTP which serves the Justice Academy Request for change in Permit limits Dear Mr. Stevens: The above referenced permit is due to expire on October 31, 2000. Our application for permit renewal was submitted in March of this year. As a part of the renewal process I would like to request that the following changes be made to the referenced Permit: Current limits Requested limits Monthly Weekly Monthly Weekly Average Average Average Average BOD25(April 1-October 31) 5.0 mg/1 7.5 mg/1 10.0 mg/1 15.0 mg/1 NH3 as N (April 1-October 31) 2.0 mg/1 4.0 mg/1 If the "anti-degradation clause" was a major factor in requiring strict limits for BOD25 and NI-b as N, I believe it would be appropriate to make the limits less strict due to the following: Lewis Creek, at the discharge point for the subject Permit, is not a pristine mountain stream, but rather a stream that is being affected by farming and commercial activities. Additionally, I believe the comparison of the actual average daily flow to the 7Q10 flow of Lewis Creek supports our request for the referenced limit changes. The subject treatment plant is currently permitted for 30,000 gallons per day, however, the Justice Academy is the only customer discharging to the treatment plant in question and even with the dormitory and cafeteria ;)-Q3119 now in operation the actual daily flow is only 3,180 gallons per day compared to a summer 7Q10 flow in Lewis Creek of 1CFS (646,272 gallons per day). The actual flow into the subject treatment plant is not expected to increase significantly over the next 5-year permitting period. If I can provide additional information, please let me know. Your consideration is greatly appreciated. Sincerely, J. James S. Erwin, Jr.,Director Henderson County Utilities Department cc: Mr. Roy Davis, Environmental Engineer N.C.
