NOV-2013-PC-0279 Permit No. NCS00250 and 20110392

Dear Mr. Basinger:
In response to the subject notice recently received by NCDOT DOH Division 7, the following is
provided.
The site was reviewed by Amy Euliss of your office and_a clean-up method was recommended. The
clean-up for this issue was completed on 3 August 2013, reviewed by Amy Euliss and found to be
satisfactory.
Events that led to the violation are described in the Notice of Violation. I would like to further add that
on the date of the violation, the NCDOT Inspector was on site as the grading wark was being
performed. He remained with the.grading operation until the majority of the work was complete and as
he left for the day, he reminded the Contractor again that the slope drains needed to be reinstalled
before leaving for the day. The inspector had reminded the Grading Foreman several times during the
work operation. There had beeri discussion with the inspector from the Grading Foreman that the
operation was fine grading and they did not want to disturb the area. The inspector instructed them that
the slope drains would be required or other diversion measures would be necessary regardless. The
Contractor did not install the devices as instructed or necessary prior to leaving for the day.
In an effort to prevent any violation of this type occurring again, Division 7 met with the Contractor
personnel on 2 August 2013 to discuss what had occurred. I further requested the Contractor to
provide a Plan of Action so no future violations occur and have attached to this response. The
Division7 inspection staff will be more diligent in the future prior to the end of the day operations to
verify that all permitted areas have all erosion control devices in place as required in the contract plans.
We are conducting weekly construction meetings with the Contractor to discuss the permitted sites
along with required erosion control measures according to BMPs.

The Division certainly regrets that this violation occurred and will not in the future allow or tolerate
any willful violation of any surface water or permitted area. We appreciate your consideration of the
circumstances involved in this instance as it pertains to NCDOT and Division 7.

In response to your July 30, 2013 letter concerning the NOV received on the above referenced project, Tetra
Tech is providing the following Plan of Action to prevent future violations. This plan will be implemented
immediately.
Attached is a copy of the daily end of shift checklist to be reviewed each day at all active work areas. The
checklist will be reviewed and signed off on by a competent person (Level II certified) each day prior to close of
business. The project will not shut down for the day until all erosion items are properly installed. A copy of the
completed checklists will be kept on file for review. '
The NCDENR Notice of Violation Letter stated that "sediment loss was a direct result of the contractor not
installing proper measures before leaving for the day". We feel that the daily end of shift checklist will ensure
that proper erosion control measures are in place prior to leaving the project each day. I encourage NCDOT
participation with these daily inspections, and look forward to completing the remainder of the project incident
fcee.
