In accordance with the application for a discharge permit received on February 13, 1997,the Division
is forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the US Environmental Protection Agency dated December 6,1983.
If any parts,measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty(30)
days following receipt of this letter. This request must be in the form of a written petition,conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings,Post Office Drawer 27447,Raleigh, North Carolina 27611-7447. Unless such demand is made, this
decision shall be final and binding.
Please take notice this permit is not transferable. Part ILEA. addresses the requirements to be
followed in case of change in ownership or control of the subject facility.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Water Quality or permits required by the Division of Land Resources,Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

to receiving waters designated as East Fork Overflow Creek in the Savannah River Basin in accordance

hereof.
The permit shall become effective October 1, 1997
This permit and the authorization to discharge shall expire at midnight on August 31,2002

1. Continue to operate an existing 0.042 MGD extended aeration (diffused air) system with a
clarifier and ultraviolet disinfection at Mountain Laurel Subdivision, on NC Highway 106,
west of Highlands, Macon County (See Part III of this Permit), and
2. Discharge from said treatment works at the location specified on the attached map into East
Fork Overflow Creek which is classified Class C-Trout ORW waters in the Savannah
River Basin.

Facility is renewing at existing flow with no change in wastewater characteristics. Permit was drafted
with existing limits. No observable violations were noted during DMR review.
Region,please review downstream sampling location. The WLA, prepared on 4-9-92, stated 0.2 miles
for the downstream sampling location while the old permit stated 2.0 miles downstream. I changed the
downstream sampling location to 0.2 miles downstream to reflect the information reported in the WLA.
Region,please comment of downstream accessibility 0.2 miles from the outfall.
It is recommended that this permit be renewed as drafted.

SUBJECT: Instream Monitoring Requirements (NC0061930)
Bill Anderson of the ARO recommended dropping the instream monitoring requirements for the
subject facility. This request was brought to the attention of the modeler for this facility (Andy
McDaniel). Mr. McDaniel expressed extreme concern for dropping instream monitoring
requirements due to the following issues:
• Due to the fact that the stream is classified ORW.
• Due to the fact that we do not have a good handle on the 7Q10 flow (it's very hard to
estimate for facilities with very small drainage areas. The drainage area for this c✓Y--c�
is 0.33 mi2 ,
The instream monitoring requirement will remain in the permit renewal.
