Dear Mr. Schmitt:
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as
subsequently amended).
No later than 180 days after the effective date of this permit, the Permittee shall submit to the Division
a wastewater management plan. (Refer to A.(2.).)
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

This permit shall become effective October 1, 2002.

A. (2.) WASTEWATER MANAGEMENT PLAN
No later than 180 days after the issuance date of this permit, the Permittee shall
submit to the Division a wastewater management plan. The plan shall include, at a
minimum, the following elements:
• Alternatives analysis. Conduct a technical and economic evaluation
of wastewater disposal alternatives, specifically including at least the
following alternatives:
• connection to a wastewater collection system
• conversion to a spray irrigation system
• implementation of a reuse program
• any combination of the above options
The analysis and report should be consistent with guidance provided
by the Division.
• Facilities assessment. Describe deficiencies and operational
difficulties in the existing collection system or treatment facility which
affect performance or permit compliance, and identify potential
improvements to correct those. At a minimum, evaluate the following
considerations:
• headworks performance,
• equipment repairs and preventative maintenance,
• removal of accumulated solids, wastes, other debris
• Optimization plan. Develop a strategy for optimization, rehabilitation,
expansion and/or replacement of the collection and/or treatment
system to achieve optimum performance. Identify specific measures
and key tasks, including those in the above facilities assessment, and
provide an estimated schedule for completion of each.
• Biosolids management plan. Develop an operations protocol to be
used or describe the protocol currently used for managing septage/
biomass in the treatment system, including associated solids wasting
and disposal, to promote optimum treatment system performance.
Identify operating parameters to be used and target values or ranges of
values where appropriate.
• Communications plan. Describe a strategy for informing utility
customers of their potential impacts on treatment system performance
and appropriate practices for minimizing those impacts, including a
schedule for implementation of the strategy. At a minimum, include the
following elements:
• _ oil and grease contributions to the collection and treatment system
• introductory material for new tenants, describing acceptable waste
disposal practices, common problem practices, notification
procedures in case of emergency

Sludge Management Plant
Sludge that is generated at Mark Laurel Association wastewater treatment plant is fast
handled by disposing of the solids in the digestor. When the digestor is full
B&B Concrete,a septic truck service is called in to remove solids from the digestor.
B &B Concrete disposes of the sludge by hauling it to the Town of Franklin's
wastewater treatment plant.

Dear Mr. Schmitt:
On May 15, 2001, Mr. Kevin Barnett of my staff inspected the wastewater treatment system at Mark
Laurel. Attached, please find an NPDES Compliance Inspection Report Form.
The facility has been found to be in violation of NPDES Permit Condition C. 2. Proper Operation and
Maintenance.
The following observations were made during the inspection:
• UV disinfection lights were on, UV Intensity meter reading 0%
• Control panel indicates that one UV Bulb is out of order.
• Operator log has some detail, could use more.
• Both blowers hooked up: Left blower has old belt/belt loose.
Right blower has old belt. No spare belts onsite.
• Both blowers on auto/timers. #1: On 30/Off 45, #2: Runs from 12:00 till 6:15/Off from 6:15
tilil 1:00, On from 11:00 till 12:00
• No air filters on blowers.
• All diffusers set half open.
• De-nitrified solids in clarifier.

The plant appears to be in a state of disrepair. The following actions must be taken in order to prevent
further enforcement action and possible civil penalty assessment:
• UV lights must be cleaned and checked for proper operation. The UV intensity meter should be
checked for operation.
• Sufficient spares for blowers must be maintained onsite.
• Air filters must be in place on blowers.
• Sufficient solids should be removed from the plant to prevent the de-nitrified solids from floating to the
surface of the clarifier. The plant may need to be re-seeded with fresh mixed ligour.
• The flow meter must be reinstalled (and re-calibrated).
• Solids in the chlorine contact chamber must be pumped out.
• Trees inside fence need to be removed.
• All diffusers must be serviced, repaired, or replaced.
• A clear path to point of discharge must be maintained.
• High water alarms on influent pump station must be repaired/replaced.
• Both pumps and all alarms in the influent pump station must be operational.
• The bulb in the visual alarm on the influent pump station must be replaced.
• An audible alarm must be installed on the influent pump station.
Additionally, the operator's log must contain more detail. Attached, please find a copy of the 15A.
NCAC 02B .0500 rules detailing the minimum requirements for the operator's log.
It is recommended that Mark Laurel Homeowners Association purchase and install a composite sampler
in a permanent structure.
All repairs / modifications must be made immediately, or within 30 days if equipment needs to be
ordered. A plan of action covering these repairs should be prepared and mailed to my attention within ten
days at the letterhead address.
Nothing in this letter should be taken as removing from you the responsibility or liability for failure to
comply with all applicable state laws and regulations.
