Dear Mr. Ramsey:
Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).
Please note that the Total Residual Chlorine TRC limit was erroneously added to the draft permit
and has been deleted from the final permit. (Refer to A.(1.).) However, the Division is currently
in the process of implementing a Water Quality Standard for TRC and expects to introduce
permit limits statewide in April 2003. Although TRC is- not currently limited in this permit, the
Division recommends that you prepare a budget and schedule construction of facility upgrades
to restrict the discharge of TRC (or explore alternative methods of disinfection). Future renewals
of this permit will include a TRC limit of between 17 mg/L and 28 mg/L.
Please also note that the requirement to submit an Engineering Alternatives Analysis (EAA) was
a condition of the previous permit. However, the permittee failed to submit this information.
Therefore, no later than 180 days following the effective date of this permit, the permittee shall
submit a detailed analysis of all available means to dispose of this facility's wastewater. This
EAA shall be prepared in compliance with the Division's guidance document for EAAs. If no EAA
is submitted, the Division may reopen and modify this permit to increase monitoring frequencies
or change the effluent limits as necessary to protect the receiving stream. (Refer to Special
Condition A. (2.).)Please be advised that the requirement of an EAA is an enforceable condition to
this permit. If no EAA is received, this matter may also be forwarded to DWQ's Compliance and
Enforcement Unit for further action_
- If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-
6714). Unless such demand is made, this decision shall be final and binding.

may require modification or revocation and reissuance of the permit. This permit does not affect

This permit and authorization to discharge shall expire at midnight on August 31, 2005.

To Whom It May Concern:
The NPDES permit will be issued by December 31, 2002. I have received comments
from Mr. Michael J. Power, objecting to the addition of a Total Residual Chlorine (TRC)
limit. Please note that the TRC limit was erroneously added to the draft permit and will
be deleted in the final permit. However, the Division is currently in the process of

Please accept this as our formal objection to your draft permit dated 9/21/02, specifically for the addition
of a Residual Chlorine limit. The permit application was sent in and the application package had no
request for an alternate comparison when submitted in 2001 as required. Over the past year and a half; T
have occasionally received calls from DENR regarding this renewal and provided all information as
requested. No one ever requested an alternative plan. Extension to county sewer would cost in excess of
$200,000. That, along with the ongoing charges would bankrupt the facility. Addition of a residual
chlorine limit appears punitive and unfounded. We request that the residual chlorine limit be removed
firom the permit.

The Division received Berkley Oaks LLC's application for a renewed National Pollutant Discharge
Elimination System (NPDES) permit on March 27, 2001, The Division of Water Quality has prepared a
draft permit for your review.
Please review the draft permit carefully. Check to insure that the facility information is correct, including
address and location. The draft permit includes the following changes.
A total residual chlorine limit has been added to the permit. The previous permit contained a condition
requiring the facility to evaluate alternatives to discharge. The analysis was also required to evaluate the
cost for meeting more stringent limits. To date, the Division has not received this report. Since the
Division has not received the required report, the Division is including a 17 µg/L total residual chlorine
limit as outlined in the previous permit.
The permit currently contains only monthly average limits for ammonia. The Division is currently
evaluating an appropriate daily rnaximurn limit for all dischargers in 1Nvrth Carolina. The current
schedule is to complete this evaluation by September 30, 2002. Permits issued after September 30tk may
contain daily maximum ammonia limits in addition to the month average lianits contained in this permit.
The Division will notify affected dischargers of any changes to the ammonia limits proposed in this
permit after completion of the evaluation.
The Division will hold the comment period open for 30 days. During this time the Division will accept
comments from _you or your representative, the public and other agencies. This is your opportunity to
comment on the provisions of the permit,

Sludge management plan and policy for this plant is as follows: Sludge generated during normal
operations is pumped to an aerated sludge holding tank. Stanley Septic Tank Company pumps the tank and
hauls it to a certified dumping facility in Charlotte, NC; Irwin Creek WWTP. Bar screenings are deposed of at
Long Creek WWTP.

turn left onto Jeran Lane (no SR number). The WWTP is located at the end of Jeran Lane.
