Division of Water Resources' Central and Regional staff has reviewed the application package
received on August 22, 2022. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on November
28, 2022.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A and B, or failure to provide the additional information on or before the above -requested date
may result in your application being returned as incomplete pursuant to 15A NCAC 02T .0107(e)(2).

A. Attachment L — Setback Waivers:
1. The existing permit does include a setback waiver which was executed on June 20, 2017. This
setback waiver allows for the application of wastewater effluent and the construction of wastewater
treatment and storage units up to the property line (reduced from 50 feet to 0 feet). For future
applications, pursuant to 15A NCAC 02T .0706(d), please provide a copy of all setback waivers
associated with the existing permit. No response is required.
B. Compliance Boundary (15A NCAC 02L):
A review of our records shows that this facility was modified on August 8, 2003, therefore, the
compliance boundary has been delineated in accordance with 15A NCAC 02L .0107(b). The
compliance boundary is established at a horizontal distance of 250 feet from the waste boundary,
or 50 feet within the property boundary, whichever is closer to the source. According to the site
map submitted with the renewal application and the located setback waiver, there are areas along
the waste boundary which are as close as 30 feet to the property line of Parcel 6344-05-19-4326000
owned by the Ocean Bay Villas Homeowner Association.
In accordance with the 15A NCAC 02L Groundwater Classifications and Standards rules (hereby
referred to as the 02L Rules), a compliance boundary is defined as a boundary around the waste
disposal area of a waste disposal system at and beyond which groundwater standards may not be
exceeded. The compliance boundary in this case would be located within the waste boundary
(because 50 feet within the property boundary is closer to the source), which is not compliant with
the 02L Rules. To become compliant, one of the following options is required:
a. In accordance with 15A NCAC 02L .0107(k), execute an easement or agreement with the
neighboring property owner allowing the compliance and review boundaries to be located
closer to the property line, which allows the compliance boundary to be located around the
waste boundary (i.e., up to the property line). This easement must be filed in the Carteret
County Register of Deeds and included a notice of the permit, the permit number, and a
description of the type of the permit.
b. A minor modification application to remove any sections of the infiltration area that are
located within the compliance boundary. This application package shall include a new
signed and sealed site map per 15A NCAC 02T .0704(d) depicting the new field boundaries
along with the compliance and review boundaries, the new field's area; and calculations
showing that the permitted flow of the system does not exceed the maximum annual
loading rates on the reduced infiltration area.
According to 15A NCAC 02L. 0 113, the Environmental Management Commission (hereby
referred to as the EMC) may grant a variance to the 02L Rules. A variance may be granted
for the compliance boundary of your system, provided it is still located within land owned
by the Permittee. An application package containing all the items in 15A NCAC 02L
.0113(c) shall be sent to the chairman of the EMC. If the application is complete, the matter
will be sent to a public hearing of the EMC, which will decide on the matter. However,
there is no guarantee that the variance will be granted, and either of the first two options
shall be required.
