WBS element The North Carolina Department of Transportation (NCDOT) proposes the replacement of a pipe conveying an unnamed tributary to Cirraham Branch on Hwy 15 in Stovall, Granville County (Figure 1 - 3}. Information c4nceming this activity is provided below: Ympacts to Waters of the United States The project crosses an intermittent stream, UT to Graham Branch, [NCDENR-DWQ Index No. 23-2-4-2, Best Usage Classification C; HUC 03010102] in the Roanoke River Basin. The existing structures that convey the creak are 2@ 24-inch reinforced concrete pipes that are 48 feet long (see Photographs 1-2). These existing pipe segments have disconnected and caused the overlaying dirt fill to collapse. The pavement above the pipe is also damaged, as there is already a hole in the North bound lane of this roadway. The NCDOT proposes to repiaee these pipes with one larger pipe (48-inch) that is the same length. No `new' surface water fill will result Crom this pipe replacement work. The ends o#' the new pipe will be armored with rip rap, not to exceed 4 linear feet on both ends. Please note that the stream channel is completely dry at this time, so no dewatering is necessary to complete this work. Riparian Buffer This project is located within the Roanoke River Basin. Therefore no impacts to protected riparian buffers will result fiom this maintenance activity, Waters of the Y7.S. Mitigstyon Avoidance: All wetlands and surface waters not affected by the project will be protected from unnecessary encroachment. Strict enforcement of sedimentation and erosion control ]3est Management Practices far the protection of. vuetlands and surface waters will be enforced during project construction. Continued coordination will occur with maintenance forces and the Envirorunental Officer during construction to minimize impacts to these sites. Com~ensataty Miti as tion: A.U compensatory mitigation requirements will be left to the discretion of the regulatory review agencies. None is anticipated. Protected Species Plants and animals with federal classifications of Endangered, Threatened, Proposed >>ndangered and proposed Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act. As of October 2007, the dwarf wedgemussel (Alasmidonta heterodan), smooth coneflower (Echinacea laevigata), and harperella (Prilimniurrt nodasum) are listed as federally protected species in Cxranville County. Please note that the bald eagle {Haliaeetus lettcocephalus) was recently delisted. The LTI' to Graham Branch is small and within the headwaters ofits drainage system. Therefore, it does not provide suitable habitat for mussel fauna, nor do they provide suitable habitat for harperella. Hwy 15 in Stovall is not adjacent to nor is it surrounded by open water suitable of supporting foraging habitat for the bald eagle. Additionally the roadway shoulders within the pro}ect limits are highly maintained and eliminate the possibility of smooth coneflower growing in this area. No specimens were observed during the 10/13/07 site visit. Additionally, a review of the Natural Heritage program database (last updated July 2007) revealed no occurrences of protected species tivithin the project limits. Therefore, based an lack of suitable habitat observed during the site visit and the l~HP database review, biological conclusions of No Bffeet have been rendered for each of those species. Summary The NCD4T proposes to replace the existing stnactures with a single Iine of pipe that is the same length. No `new' surface water fill is proposed with this project, but up to S ft of rip rap armoring is proposed for bank stabilization. No dewatering will be necessary to complete this work. This project is located within the Roanoke River Basin. Therefore no impacts to protected riparian buffers will result from this maintenance acti~~ity. Application is hereby trade for a NC171uNR-DWQ Section 401 Water Quality Certification (WQC) No. 3627 for above-described activities. An automated payment procedure has been implemented betv~~een the NCDOT and NCDWQ. This procedure will enable the Division to apply for the 401 VVQC without submitting a Check for this permit application. This. procedure will provide payment to the NC17'WQ by charging the permit application fee of $200.00 directly to the appropriate NCDOT WBS elcrnent SC.03~035. Apre-construction notification is attached with this request. Per General Condition 27 [Notification provision], the USACE is not copied an this permit request. The proposed activities meet the conditions of the l7epartment of the Anny Section 404 Nationwide permit (NWP) 14 and the proposed impacts do not exceed the 1/10 acre of loss of Waters of the United States. Granville County Maintenance forces have a site just 0.26 S of the intersection of Stovall on Hwy 15 where the existing pipes have separated, the above dirt fill has collapsed, and the roadway (North bound lane) has a hole in the pavement. They would like to do this work, ASAP. The stream at this location is dry right now, but it is a jurisdictional site. Therefore I've prepared an application for a WQC 3627 and will fax it to you in just a minute or so. -The site is within the Roanoke River Basin, so NO protected buffer impacts -It involves replacing two existing 24-inch pipes with a new 48-inch pipe that is the same length (48ft), so NO 'new' surface water fill is proposed -Rip rap armoring will be used to stabilize the pipe ends, not to exceed 4 linear feet at both ends -No dewatering will be necessary. If you could possibly consider this WQC today, time permitting, and fax me an approval that would be great. I will still mail you the original application with color photos and 4 extra copies.
