Narrative Summary
January 1, 2022, through December 31, 2022
The following is a narrative summary of Pretreatment Program events that occurred during this
annual reporting period. The narrative includes a brief summary of those Significant Industrial
Users (SIU's) that were in Significant Non -Compliance (SNC) due to permit limit violations; those
SIU's that were in SNC due to reporting violations; those SIU's that are on Compliance Schedules; a
brief summary of waste reduction activities; and a summary of other pretreatment activities,
including permit issuance, inspections, etc.
I. Summary of SIU's in SNC:
A. Due to Limit Violations
Mann+Hummel Purolator Filters: Permit Number 2010CC SIU was SNC during
the first six-month period for monthly Carbonaceous Biochemical Oxygen Demand
(CBOD) Technical Review Criteria (TRC).
Nitta Gelatin USA, Inc: Permit Number: 2017RF SIU was SNC during the first
six-month period for monthly ammonia Technical Review Criteria (TRC).
Nitta Gelatin USA, Inc: Permit Number: 2017RF SIU was SNC during the second
six-month period for monthly Ammonia Chronic and TRC.

SIU permits issued, renewed, terminated.
Martin's Pork Products, Inc.: Permit Number 2004CC SIU
SIU was renewed January 1, 2022.
2. SIU permits modified.
Mann+Hummel Purolator Filters: IUP Number 201OCC
Effective 11-01-2022- Requirement for the use of automated samplers was
added for collecting samples. Monthly average CBOD limit was changed
from 200 mg/1 to 400 mg/1 and TSS monthly average limit was changed from
150 mg/l to 300 mg/1. Arsenic MDL was changed from 0.01 mg/L to 0.002
mg/L and selenium MDL was changed from 0.01 mg/L to 0.005 mg/L.
Darling Ingredients, Inc: IUP Number 2001CC
Effective 8-01-2022- MDL for CBOD, TSS, Ammonia, and TKN was
removed, requirement for use of automated samplers was added for
collecting samples, and per request name changed from Valley Proteins, Inc.,
to Darling Ingredients, Inc. — Fayetteville Division.
Local permits issued, renewed, modified, terminated.
Liquid Environmental Solutions of Georgia: IUP Number 2115RF
Effective 7-01-2022- Permit modification to change Daily CBOD limit from
5000 mg/1 to 4500 mg/1 and Monthly CBOD limit from 2,200 mg/1 to 1,500
mg/l.
4. Authorizations to Construct (A2C's) issued.
One A2C was issued in 2022.
Martin's Pork Products, Inc.: Permit Number 2004CC SIU
Permit was reviewed and approved by PERCS. A2C is attached.
B. Inspections
All SIU's were inspected by the PWC Pretreatment Staff between January 1, 2022,
and December 31, 2022.
C. Headwork's
The Cross Creek HWA and Rockfish Creek HWA were approved by PERCS July
12, 2018.
D. Industrial Waste Survey
In 1999, the industrial waste survey became an ongoing project rather than merely a
once per five-year event. The PWC IS Department designed a report, which lists all
users who consume more than five hundred thousand (500,000) gallons of potable
water each month. To date, this report has not revealed any new SIU's. PWC
conducted a formal IWS in 2018. No new SIU's were identified. The IWS was
approved by the PERCS October 4, 2018.
E. Public Notice
PWC published the name of one (1) Significant Industrial Users in a Public Notice
on February 12, 2023. A copy of the typed notice, as it appeared in the Fayetteville
Observer/Times newspaper is enclosed. A copy of the legal affidavit of publication
will be forwarded once PWC receives it.
F. Compliance Agreements
Mann+Hummel Purolator Filters: Permit Number 2010CC SIU was SNC during
the first six-month period for monthly CBOD/ TRC which is the second consecutive
six-month period of SNC. The SNC and Compliance Agreement is attached.
Nitta Gelatin USA, Inc: Permit Number: 2017RF SIU was SNC during the first
six-month period for monthly ammonia TRC and SNC during the second six-month
period for monthly Ammonia Chronic and TRC.
G. Civil Penalties
None
H. Grease Trap Inspections
The database PWC purchased continues to prove itself to be a valuable resource in
helping to maintain facilities and to effectively deal with non -compliant facilities. A
total of 903 grease trap inspections were completed in 2022.

NOTICE
(For the period January 1, 2022, through December 31, 2022)
In accordance with Section 403.8(f) 2 (vii) of the United States Environmental Protection Agency
(U. S. EPA) Federal Register (40 CFR, General Pretreatment Regulations of Existing and New
Sources of Pollution), the Fayetteville Public Works Commission (PWC) is required to publish, at
least annually, a list of those Significant Industrial Users (SUI's) which were at some time during
the previous twelve months in Significant Non -Compliance (SNC) with pretreatment standards
established by the U. S. EPA, the Sewer Use Ordinance for the City of Fayetteville, or the Indirect
Discharge Permits (IDP) issued by the PWC.
For the purpose of this provision, an Industrial User is determined to be in SNC if its violation(s)
meets one or more of the following criteria:
1) Chronic violations of wastewater discharge permit limits, defined here as those in
which sixty-six percent or more of all the measurements taken during a six-month
period exceed (by any magnitude) the maximum daily limit or the maximum
monthly average limit for the same pollutant/parameter.
2) Technical Review Criteria (TRC) violations, defined here as those in which thirty-
three percent or more of all of the measurements for each pollutant/parameter taken
during a six-month period equal or exceed the product of the maximum daily limit
or the maximum monthly average limit multiplied by the applicable TRC value
(TRC = 1.4 for BOD, TSS or fats and Oil & Grease; and 1.2 for all other parameters
except pH);
3) Any other violation of a pretreatment effluent limit (daily maximum or maximum
monthly average) or permit condition that PWC determines has caused, either alone
or in combination with other discharges, interference or pass through (including
endangering the health of the POTW personnel or the general public);
4) Any discharge of a pollutant that has caused imminent endangerment to human
health, welfare, or the environment, or has resulted in the POTW's exercise under
paragraph 403.8(f)(1)(vi)(B) of this section to halt or prevent such a discharge;
5) Failure to meet, within 90 days after the schedule date, a compliance schedule
milestone contained in a local control mechanism or enforcement order for starting
construction, completing construction, or attaining full compliance;
6) Failure to provide, within 30 days after the due date, required reports such as
baseline monitoring reports, 90-day compliance reports, periodic self -monitoring
reports, and reports on compliance with compliance schedules;
7) Failure to accurately report non-compliance;
8) Any other violation or group of violations which the PWC determines will
adversely affect the operation or implementation of the local pretreatment program.
The following is a list of those SIU who were found to be in SNC at least once during the twelve-
month period from January 1, 2022, through December 31, 2022:
Mann+Hummel Purolator Filters, in accordance with their permit and PWC's Enforcement
Response Plan (ERP) was determined to be in SNC for monthly Carbonaceous Biochemical
Oxygen Demand Chronic violations during the first six-month period.
Nitta Gelatin USA, Inc, in accordance with their permit and PWC's ERP was determined to be
in SNC for monthly Ammonia Technical Review Criteria violations during the first six-month
period, and monthly Ammonia Chronic and Technical Review Criteria violations during the
second six-month period.
The above -listed Significant Industrial Users were notified of their respective incidences of non-
compliance and has corrected, or is actively working to correct, these violations.

Subject: Notice of Significant Non -Compliance/ Compliance Order
Dear Ms. Hickson:
For the second six-month reporting period of 2022; Nitta Gelatin USA, Inc., is in Significant
Non -Compliance (SNC). In accordance with the City of Fayetteville Sewer Use Ordinance and the
Fayetteville Public Works Commission (PWC) Enforcement Response Plan (ERP), PWC hereby issues
Nitta Gelatin USA, Inc., a Notice of Violation (NOV) as described below.
1. SNC NOV for monthly Chronic ammonia (0.5 point)
The PWC arrived at this compliance status and point total based on the nature of the violation.
The ERP states, "Users are responsible for maintaining compliance with all effluent limits. PWC will
evaluate the extent of the limits violation(s), In determining the extent of violation(s), SNC as defined by
State and EPA regulations will be determined." The EPA defines Chronic as "sixty-six percent (66%) or
more of the measurements of each pollutant parameter taken during a six-month period equal or exceed
the product of the daily maximum limit or the average limit multiplied by the applicable Chronic." Your
facility was at 66.66% Chronic for the second six-month period of 2022. Specifically, your monthly
average ammonia results were as follows:

Your monthly permitted ammonia limit is 50 mg/L. The calculation for determining Chronic
percentage is the number of violations 'divided by the number of samples multiplied by .100, If the
percentage is 66 or greater it is a Chronic violation. Your August, October, November, and December
results were greater than your monthly ammonia permit limit of 50 mg/L. Your final Chronic calculation
is as follows:
4 (violations) divided by 6 (monthly samples) multiplied by 100 = 66.66%

This is the second consecutive six-month period your facility has been SNC for ammonia. Repeat
SNC violations are a serious matter, and the EPA requires appropriate enforcement action be taken.
Therefore, in addition to an SNC NOV, you are being issued an official enforceable compliance order and
must take the following actions:
I. Investigate your facility to determine the cause of the high ammonia.
2. Take actions to reduce the ammonia and return to compliance.
3. Report back to PWC your findings and actions monthly until compliance is accomplished and
you are no longer SNC.
To support you in preventing a third SNC violation, PWC hereby issues you a temporary monthly
ammonia variance of 100 mg/L for the first six-month reporting period of 2023. Unless otherwise notified
the variance will expire June 30, 2023, and the monthly limit will return to 50 mg/L July 1, 2023.
This order does not constitute a waiver of the Indirect Discharge Permit except for the temporary
ammonia limit, which remains in full force and effect. The PWC reserves the right to seek all remedies
available to it under the City of Fayetteville Sewer Use Ordinance for any violation cited by this order.
Failure to comply with the requirements of this order shall constitute a Rather violation of the
City of Fayetteville Sewer Use Ordinance and may subject Nitta Gelatin USA to increased sampling
requirements, civil penalties, criminal penalties, or such other enforcement as may be appropriate.
The above violations alone carry no civil penalty. However, provision of the Federal and State
pretreatment regulations require that those Significant Industrial Users who are found to be in SNC at
some time during the previous twelve-month reporting period must be published, at least annually, in the
largest newspaper serving the area. This Public Notice must appear within two months after the end of the
reporting period. For the Fayetteville PWC, the reporting period is January I through December 31 of
each year, with publication of the Public Notice on or before February 28. For your records I have
attached a copy of the notice.
A written response is required within ten (10) days of the receipt of this notice. The
response shall address the following:
I) Acknowledgment of receipt of SNC NOV and Compliance Order
2) Investigative actions taken
3) Measures taken to prevent recurrence

Dear Mr. Bryant:
For the first six-month reporting period of 2022, Mann+Hummel Purolator Filters is in
Significant Non -Compliance (SNC). In accordance with the City of Fayetteville Sewer Use Ordinance
and the Public Works Commission (PWC) Enforcement Response Plan (ERP), PWC hereby issues
Mann+Hummel Purolator Filters a Notice of Violation (NOV) as described below.
1. SNC NOV for monthly Technical Review Criteria (TRC) for Carbonaceous Biochemical
Oxygen Demand (CBOD). (0.5 point)
The PWC arrived at this compliance status and point total based on the nature of the violation.

To determine the TRC limit for CBOD we are required to multiply the limit by 1.4. Your monthly
limit is 200 mg/L, so your applicable monthly TRC limit is 280 mg/L,
The Calculation for determining TRC is: % Violations divided by # of samples multiplied by 100.
The May and June results were over the 280 TRC limit making your final TRC calculation as follows:
2 (violations) divided by 5 (samples) Multiplied by 100 = 40%
This is the second consecutive six-month period your facility has been SNC for monthly CBOD.
Repeat SNC violations are a serious matter, and the EPA requires appropriate enforcement action be
taken. Therefore, in addition to an SNC NOV, you are being issued an official enforceable compliance
order and must take the following actions:

1. Investigate your facility to determine the cause of the high CBOD.
2. Take actions to reduce the CBOD and return to compliance.
3. Report back to PWC your actions and findings monthly until compliance is accomplished and
you are no longer SNC.
To support you in preventing a third SNC violation, PWC hereby issues you a temporary variance
of 500 mg/L for the second six-month reporting period of 2022.
This order does not constitute a waiver of the Indirect Discharge Permit except for the temporaty
CBOD limits, which remains in full force and effect. The PWC reserves the right to seek all remedies
available to it tinder the City of Fayetteville Sewer Use Ordinance for any violation cited by this order.
Failure to comply with the requirements of this order shall constitute a further violation of the
City of Fayetteville Sewer Use Ordinance and may subject Mann+Hummel Purolator Filters to increased
sampling requirements, civil penalties, criminal penalties, or such other enforcement as may be
appropriate.
These violations alone carry no civil penalty. However, provision of the Federal and State

At the beginning of another pretreatment year, we wanted to provide you with an update on some
important issues and distribute the Pretreatment Program Info Database sheets.
1. Emerging Compounds: The Division requests you review the 12/5/2022 EPA Memo titled
Addressing PFAS Discharges in NPDES Permits and Through the Pretreatment Program
and Monitoring Programs. DWR may request local pretreatment programs conduct an
emerging contaminant (EC) screening for new Significant Industrial Users (SIUs) and
additional guidance is forthcoming.
2. The Industrial Database: The Division has a subscription to Industr, Sy elect an online
industrial database from Manufacturers News, Inc. Industrial information for your POTW's
service area can be downloaded and emailed to you upon request. POTWs must complete
an Industrial Waste Survey (IWS) upon each renewal of the NPDES Permit and an Industry
Select download with SIC / NAICS info is a good way to get started.
3. Permit Review and Approval: This is a reminder that the State Pretreatment rules (.0900)
were updated effective on July 1, 2019. Per 15A NCAC 0211.0917(a), each control
authority shall transmit to the Division copies of all significant industrial user
pretreatment permits 30 days prior to the effective date. Please note that approved permit
writers can submit the IUPs at the time of issuance. More details can be found on the Permit
Writing Guidance page.
4. Industrial Waste Survey (IWS) Table: There is a redesigned the Industrial Wastewater
Survey Summary to use for your POTW's submission to the NPDES Municipal
Permitting Unit for review and approval. Please download this spreadsheet use it to
document your IWS efforts. We welcome any comments or suggestions on your experience
with this updated document.
S. POLs & Over Allocations: The Division issued a "PQL Data Handling" letter on March 21,
2022 to address Headworks Analysis over allocation issues. Options presented allow for
adjustments based upon conditional POC analysis using the appropriate PQL. The
Pretreatment Consortium recently drafted a revised detection level chart which will be
reviewed and approved for distribution soon.
