On January 6, 2015 SIU flow from both FujiFilm Diosynth Biotechnologies USA, Inc (FujiFilm) and Biogen began discharging to the Western Wake Regional Water Reclamation Facility (WRF) (NPDES Permit # NC0088846). On August 16, 2016 CIU flow from Catalent Pharma Solutions, LLC (Catalent) began discharging to the North Cary WRF (NPDES Permit # NC0048879). All three industrial permits are still active. Number of Water Reclamation Facilities: 3 - North and South Cary WRFs and the Western Wake Regional WRF. The Western Wake Regional WRF was commissioned on July 28, 2014 and is a shared reclamation facility among the Western Wake Partners who consist of the Town of Cary, Town of Morrisville, and Town of Apex. Cary is responsible for the management, operation, and maintenance of the facility. Cary provides sewer service to the Town of Morrisville through an agreement in 2005 where Cary acquired ownership of the water and wastewater utilities and is the Control Authority for said service area. An updated inter -local sewer service agreement between the Town of Apex and Town of Cary was agreed upon for the Western Wake Regional WRF on January 19, 2016. Cary remains the Lead Agency for the WRF, and both entities maintain pretreatment programs for their respective portions of ownership in the WRF. Information is shared between the agencies with regards to Head Works Analysis and Allocation Tables. 2022 Industrial Data Summary Forms (IDSFs) are enclosed for each of the two SIUs. Averages were calculated for 6- month periods using detection limits (DL) for those with all values <DL in the 6- month period, and zero values for <DL where there were some measurable quantities sampled in the 6-month period. Wastewater disposal to Cary from the regulated pipes at both Biogen and FujiFilm occurred daily in 2022. There was no wastewater disposal to Cary from the CIU (Catalent) in all of 2022. NARRATIVE OF 2022 ANNUAL PRETREATMENT PROGRAM ACTIVITIES GENERAL PROGRAM INFORMATION SECTION General Information for the Town of Cary Pretreatment Program for Calendar Year (CY) 2022 with supporting historical information • North Cary WRF HWA & AT — Submitted and received March 26, 2019 and was approved with corrections June 24, 2019. Corrections included updating stream standards based on total metals allocated to this WRF. For arsenic the stream standard was updated based on Human Health/Water Supply standard. PERCS chose to approve the use of 0 mg/L for uncontrollable silver concentration as sampling data showed <1 mg/L. The next HWA is due March 31, 2024. (Current NPDES Permit expires February 28, 2023) • North Cary WRF Pharmaceutical Organic Headworks Analysis (POHA) — Submitted and received along with updated HWA and AT March 26, 2019 and was approved June 24, 2019. • South Cary WRF HWA & AT — Submitted and received May 13, 2019 and was approved with corrections August 6, 2019. Corrections included updating the dissolved metals calculator and Page 1 of 6 Town of Cary 2022 PAR Narrative updating stream standards based on total metals allocated to this WRF. For arsenic the stream standard was updated based on Human Health/Water Supply standard. PERCS chose to use NPDES loading for total nitrogen as it is more conservative than design criteria loading. PERCS also chose to use mercury literature removal rate and approved the HWA with negative mercury allocation since there are no SIUs discharging to the South Cary WRF and 95% of effluent data was below the detection limit. PERCS chose to approve the use of 0 mg/L for uncontrollable silver concentration as data showed <1 mg/L. No SIU or CIUs contributed wastewater flow to South Cary WRF in 2022. • Western Wake Regional WRF HWA and AT— Submitted and received by PERCS on January 14, 2021 and is still under review. (HWA due date April 1, 2021, current NPDES permit expired July 31, 2021 and no draft permit received yet.) An updated AT was submitted along with the SIU permit modification for FujiFilm Diosynth Biotechnologies USA, Inc on January 14, 2021 with modification approved February 10, 2021. Another SIU permit modification for FujiFilm Diosynth Biotechnologies USA, Inc (updating reporting requirements with no effect on the AT) was submitted January 4, 2022 and is currently under review by PERCS. There were no SIU/CIU contributions to the WWRWRF from the Town of Apex in 2022, see Town of Apex PAR. • North Cary WRF LTMP —Submitted for revision and received August 27, 2019 and approved November 19, 2019. • South Cary WRF LTMP —Submitted for revision and received January 19, 2017 and approved April 18, 2017. • Western Wake Regional WRF LTMP- Submitted for revision and received January 19, 2017 and approved April 18, 2017. • SUO —On October 28, 2011 the PERCS Unit received a proposed modified SUO to reflect then recent changes to the NC Pretreatment Rules. On November 8, 2011 the Town received approval from PERCS for said modification. On December 15, 2011 the modified SUO was approved by the Cary Town Council. The Town received approval from PERCS on April 12, 2012 for the modified SUO. • A modified ERP was submitted on November 18, 2019 to reflect addition of an ERP for Dental Users and approved March 17, 2020. The program information sheets received from NCDEQ indicate that the updated ERP was received February 24, 2020. • Since the EPA rule for Dental Dischargers went into effect in 2017, 20 new users and 97 existing users have been identified and One Time Compliance Reports received. Reporting compliance is 100% for both new and existing users, with reports received from all existing users prior to the October 12, 2020 deadline. • IWS for Cary, Morrisville, and South Eastern RTP is conducted on an ongoing basis per plumbing permit review and approval. Cary also issues IWSs for facilities where more information is necessary for determining IU or SIU status. An IWS report for 2014-2019 was submitted and received March 29, 2019 and was approved April 5, 2019. The next IWS report is due April 1, 2024. The Town of Apex maintains IWS information for the portion of Apex that flows to the Western Wake Regional WRF. • In 2022 there were no SIUs or CIUs contributing wastewater flow to the South Cary WRF. • A Pretreatment Compliance Inspection was performed on August 25, 2021 and an inspection report was received dated December 6, 2021. The inspection report indicated a requirement to update the SIU Permit for FujiFilm Biotechnologies USA Inc to clarify reporting requirements. A modified permit was submitted on January 4, 2021 and is currently under review. A pretreatment Page 2 of 6 Town of Cary 2022 PAR Narrative program audit was conducted on July 28, 2017 and an audit report was received dated August 24, 2017. • A Mercury Minimization Plan (MMP) was developed in accordance with NPDES permits, is on file as per NPDES requirements, and is part of on -going operational activities. • A copy of the current North Cary, South Cary, and Western Wake WRF Program Information sheets are included with this 2022 PAR. • Included is the Historical SNC Report for Cary that lists Catalent as SNC for missed sampling in the first half of 2017, which is correct. Catalent has not had any additional permit or SNC violations to date. Town of Cary SIU Permitting Activities The first 2 SIUs listed below in the SIU Information Section began discharging to the new Western Wake Regional WRF on January 6, 2015 and are located within Cary's sewer service area. One CIU was issued an IUP to discharge to the North Cary WRF on August 16, 2016. There were no SIU or CIU contributions to the South Cary Water Reclamation Facilities in CY 2022. 1. Total number of enforcement actions taken against SIUs during period: 3 2. Number of Civil or Criminal Penalties against SIUs: 3 3. Total amount of fines levied against SIUs: $744.00 4. Number of SIUs in SNC this period: 0 No Compliance Schedules were in effect during this period. SIU INFORMATION SECTION 1. BIOGEN. TOC-051 5000 Davis Drive Research Triangle Park, NC A.) Permit Issuance: • A Permit Application was received on August 29, 2013 in anticipation of wastewater discharges commencing to the Western Wake Regional WRF. • SIU discharge permit was submitted to PERCS and received September 26, 2014, and approved October 22, 2014. Permit was issued to begin on January 6, 2015 (Discharges from this service area began flowing to Western Wake Regional WRF on January 6, 2015) and expired June 30, 2019. • A Permit Renewal Application was received March 25, 2019 that included requests for increased loading allocation. • SIU Permit was submitted to PERCS and received May 20, 2019, and approved June 14, 2019. • Permit was renewed with the changes requested by permittee on July 1, 2019 and expires June 30, 2024. Permit Renewal fees were paid October 10, 2019. B.) Enforcement Actions: Page 3 of 6 Town of Cary 2022 PAR Narrative • On September 17, 2022 a Notice of Violation was issued for Industrial User Permit (IUP) TOC-051 Part II 6 which specifies a duty to mitigate to prevent adverse impacts on the Publicly Owned Treatment Works (POTW). Biogen's RTP bio- utilities manager identified a propylene glycol leak to the biowaste system, it was estimated that approximately 8,000 gallons of 28% propylene glycol was discharged. A sample of the 28% glycol solution was collected on Monday, September 19 from Biogen's glycol system. The sample was analyzed and contained a concentration of 340,000 milligrams per liter of BOD. The calculated daily load of BOD discharged during the time of the glycol discharge was 164,107 pounds, based on an estimated flow of 57,874 gallons during the ten-hour discharge event. The BOD daily maximum discharge limit of 3,021 pounds was likely exceeded and exceeds the Technical Review Criteria (TRC) threshold which is defined as 20 percent above the permitted limit. A Tier I civil penalty of $300 was issued and paid on November 17, 2022. Monitoring occurred at the Western Wake Regional Water Reclamation Facility and no facility pass through, upset, or permit limit violation was identified with the accidental glycol release. 2. FUJIFILM DIOSYNTH BIOTECHNOLOGY. TOC-052 6501 George Watts Hill Drive Research Triangle Park, NC A.) Permit Issuance: • A Permit Application was received on July 11, 2014 in anticipation of wastewater discharges commencing to the Western Wake Regional WRF. • SIU discharge permit was submitted to PERCS and received September 26, 2014, and approved October 22, 2014. Permit was issued on January 6, 2015 (Discharges from this service area began flowing to Western Wake Regional WRF on January 6, 2015.) and expired June 30, 2019. • A Permit Renewal Application was received March 27, 2019. • SIU Permit was submitted to PERCS and received May 31, 2019, and approved June 14, 2019. • Permit was renewed with no changes on July 1, 2019 and expires June 30, 2024. Permit Renewal fees were paid December 2, 2019. • A Permit Application for modification was received September 2, 2020 that included requests for increased loading allocation. • SIU Permit was submitted to PERCS and received January 14, 2021, and approved February 10, 2021. The modification effective date was February 15, 2021. • Per request in the Pretreatment Compliance Inspection report dated December 6, 2021, a permit modification was issued to clarify reporting requirements, submitted on January 4, 2022 and is currently under review. B.) Enforcement Actions: • On May 27, 2022 a Notice of Violation was issued for missed sampling of Ethanol for the month of April, per FDBU industrial user permit (IUP) TOC-052 - Part I F. requires ethanol to be collected by grab sample once per month with a required Page 4 of 6 Town of Cary 2022 PAR Narrative detection level of 5.0 milligrams per liter. An Ethanol sample was collected in May which will constitute as a makeup sample for the missed April sample. A civil penalty of $144 was issued and paid on June 30, 2022. • On August 30, 2022 a Notice of Violation was issued for a chloride limit exceedance, Meritech Labs reported the chloride value was 1,490 mg/1 (1940 lbs/day). This value exceeds the permitted daily maximum value of 1300 lbs/day, it also exceeds the Technical Review Criteria (TRC) threshold which is defined as 20 percent above the permitted limit. A Tier I civil penalty of $300 was issued and paid on December 8, 2022. • Noted Discrepancies for minor pH excursions were issued on March 6, 2022 and March 31, 2022 for pH monitoring within the pH neutralization system. A violation was not identified at the permitted monitoring location, a proactive noted discrepancy was issued in order to help maintain compliance at permitted discharge pipe. The longest duration of these events was 40 minutes. The highest recorded pH of these events was 12.0 and the system remained compliant on the low end. The permitted pH allowable range is 5.0 to 11.0. Follow up actions included additional staff training and additional notification requirements prior to buffer disposal. A Notice of Concern letter was sent on March 23, 2022 that required a pH grab sample to be taken and analyzed from the sampling monitoring point -Pipe 03 anytime a pH excursion occurs in the pH neutralization system. • Noted Discrepancies for minor pH excursions were issued on July 11, 2022 and July 20, 2022 for pH monitoring within the pH neutralization system. A violation was not identified at the permitted monitoring location, a proactive noted discrepancy was issued in order to help maintain compliance at permitted discharge pipe. The longest duration of theses events was 7 minutes, the highest recorded pH of these events was 11.1 and the lowest was 3.9. The permitted pH allowable range is 5.0 to 11.0, follow up actions included additional staff training and additional notification requirements. C.) Additional Information: • On April 6, 2020 an Authorization to Construct was issued for a new waste neutralization building and upgrades to the neutralization system. On October 15, 2020 the final pretreatment inspections were completed and final system testing occurred in January 2022. New pH neutralization system became full time operational in September 2022. • On July 28, 2020 an Authorization to Construct was issued for a manufacturing site expansion to include two building additions and one warehouse. On June 17, 2021 the final pretreatment inspections were completed and the buildings were placed online in early January, 2022. 3. CATALENT PHARMA SOLUTIONS, LLC. 160 N. Pharma Dr Morrisville, NC A.) Permit Issuance: • A permit application was received on December 18, 2014 for fit -up of existing lab space into a manufacturing suite that falls under 40 CFR Part 439 Subpart D. This location discharges to the North Cary WRF. Page 5 of 6 Town of Cary 2022 PAR Narrative • An Authorization to Construct was issued March 9, 2015 for pretreatment components that include flow monitoring, temperature and pH monitoring, inside/outside process waste tanks, and a sampling pit. Construction inspections were conducted October 13, 2015, March 14, 2016 and May 13, 2016. • CIU Discharge Permit was submitted to PERCS and received August 15, 2016, and approved August 26, 2016. The Permit was issued on August 16, 2016 and expired December 31, 2018. Permit modifications were submitted to PERCS and received February 20, 2017, and approved March 20, 2017. • A Permit Renewal Application was received from Catalent on June 27, 2018. • CIU Permit was submitted to PERCS and received December 7, 2018, and approved December 21, 2018. • Permit was renewed with no changes January 1, 2019 and expires December 31, 2023. B.) Enforcement Actions: • No enforcement actions were necessary in CY 2022. There was no wastewater disposal to Cary in CY 2022. Page 6 of 6 November 14, 2022 Mr. Peter Self Associate Director, EHSS Biogen 5000 Davis Drive RTP, NC 27709 Subject: Propylene Glycol Discharge Dear Mr. Self, TOWN OF CARY NOTICE OF VIOLATION Certified Mail On September 17, 2022, the Town of Cary Utilities Department, Pretreatment Division received phone and email notifications from Ms. Hanna Gamache (Biogen EHS) regarding an accidental propylene glycol discharge. Ms. Gamache also called and notified the on -shift operator at the Western Wake Regional Water Reclamation Facility (WWRWRF) in accordance with Biogen's Spill Control and Countermeasures Plan. During the time frame of 10:00 AM on September 16, 2022, until 8:00 AM on September 17, 2022, Biogen's RTP bio-utilities manager identified a propylene glycol leak to the biowaste system. Biogen submitted their 5-day follow-up report on September 20, 2022, which detailed the investigation and corrective actions taken. It was estimated that approximately 8,000 gallons of 28% propylene glycol was discharged. No sampling from the permit -regulated sampling point (Pipe 09) occurred during the time of the propylene glycol discharge. Industrial User Permit (IUP) TOC-051 Part II 6 specifies a duty to mitigate to prevent adverse impacts on the Publicly Owned treatment Works (POTW) and specifically states: Duty to Mitigate - Prevention of Adverse Impact The permittee shall take all reasonable steps to minimize or prevent any discharge in violation of this permit which has a reasonable likelihood of adversely affecting human health, the POTW, the waters receiving the POTW's discharge, or the environment. Industrial User Permit (IUP) TOC-051 Part I Section F specifies a Biochemical Oxygen Demand (BOD) daily max mass limit of 3021.0 pounds per day. A sample of the 28% glycol solution was collected on Monday, September 19 from Biogen's glycol system. The BOD daily maximum discharge limit of 3,021 pounds was likely exceeded and exceeds the Technical Review Criteria (TRC) threshold which is defined as 20 percent above the permitted limit. Please see 40 CFR Part 430.8(f)(2)(viii)(B) for further information. As a result of the duty to mitigate violation, the following actions are required: • Review and revise procedures for the Building Management System (BMS) to help identify slower and longer duration propylene glycol leaks for earlier detection and warning. • Provide awareness training to operations and maintenance staff for early notification to appropriate industrial user permit management staff of any propylene glycol, high strength, or hazardous discharges to the biowaste system and sanitary sewer system that may require spill notification or mitigation efforts. As a result of the duty to mitigate violation and in accordance with the Town of Cary's Enforcement Response Plan, the Town hereby issues Biogen a Notice of Violation with a Tier I civil penalty of three hundred dollars ($300.00). According to the Cary sewer user ordinance, section 36-188, a user who receives notice of an assessment of a civil penalty under section 36-179(b); or a user who receives notice of the issuance of an administrative order under section 36-179(a)(4) shall have the right, upon filing written demand, to a hearing before a hearing officer designated by the director. The written demand for a hearing shall be filed with the director within 30 days of receipt of this notice. Unless such written demand is filed within the time specified herein, the contested action shall be final. Morris Commons Lane Morrisville, NC 27560 NOTICE OF VIOLATION ELECTRONIC SUBMITTAL Re: Compliance Violation for Missed Sampling - Ethanol Dear Ms. Vannais, On May 27, 2022, the Town of Cary Utilities Department, Pretreatment Division staff became aware through a phone call from Mr. Brad Shelton that FujiFilm Diosynth Biotechnologies USA, Incorporated (FDBU) had neglected to collect the required monthly ethanol sample for April 2022. The missed ethanol sample was identified when the April 2022 monthly wastewater report was being assembled on May 27. A written follow up of the missed sample was submitted by Mr. Shelton that included corrective actions that will be taken to prevent missing this sample again in the future. An ethanol sample was collected in May which will constitute as a makeup sample for the missed April sample. FDBU industrial user permit (IUP) TOC-052 - Part I F. requires ethanol to be collected by grab sample once per month with a required detection level of 5.0 milligrams per liter. Please note that it is the responsibility of the permittee to ensure that all requirements specified in the IUP are met. As a result of the missed sampling violation and in accordance with Cary's Enforcement Response Plan, FDBU is hereby issued a Notice of Violation with a Tier 1 civil penalty of one hundred forty- four dollars ($144.00), which is the cost of the missed sampling plus 20%. Unless a written demand for a hearing is filed in accordance with Cary's sewer use ordinance, failure to pay the one hundred forty-four dollar ($144.00) civil penalty in full by thirty (30) days from receipt of this letter will result in Cary undertaking collection efforts. Morris Commons Lane Morrisville, NC 27560 TOWN OF CARY NOTICE OF VIOLATION TIER I — CIVIL PENALTY CERTIFIED MAIL Re: Chloride Permit Limit Exceedance — Civil Penalty Assessment Dear Ms. Vannais, On August 30, 2022, Don Johnson, Utility Pretreatment Program Supervisor, received a text message at 10:00 PM from Mr. Brad Shelton that FujiFilm Diosynth Biotechnologies USA, Incorporated (FDBU) received wastewater data indicating that a chloride permit limit exceedance occurred on July 19, 2022. On August 31, 2022, Cary pretreatment staff received FDBU industrial wastewater discharge report that included a self -monitoring wastewater chloride concentration result of 1,490 mg/L. FDBU Industrial User Permit (IUP) TOC-052 - Part I F specifies a chloride daily maximum discharge limit of 1,300 lb/day. The reported daily concentration of 1,490 mg/L and an industrial wastewater discharge of 156,116 gallons, equals a discharge of 1,940 pounds of chloride and exceeds the daily chloride permit limit. Please note that it also exceeds the Technical Review Criteria (TRC) threshold which is defined as values above 20 percent the permitted limit. Please see the code of federal reregister (CFR), 40 CFR Part 430.8(f)(2)(viii)(B) for further information on TRC. As a result of the limits exceedance violation and in accordance with Cary's enforcement response plan, FDBU is hereby issued a Notice of Violation with a Tier I civil penalty of three hundred dollars ($300.00). According to the Cary sewer user ordinance, section 36-188, a user who receives notice of an assessment of a civil penalty under section 36-179(b); or a user who receives notice of the issuance of an administrative order under section 36-179(a)(4) shall have the right, upon filing written demand, to a hearing before a hearing officer designated by the director. The written demand for a hearing shall be filed with the director within 30 days of receipt of this notice. Unless such written demand is filed within the time specified herein, the contested action shall be final.
