Mr. Brown, 

On January 24, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water 
Quality Certification from the Division for the subject project. The Division has determined that your application is 
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:  

1. Notes 35 and 36 of Sheet 0.2 of the project plans indicate that a temporary pump around system will be used on 
Shoal Creek and a temporary diversion will be used on Boylston Creek. Please clarify and update plans to reflect 
when a temporary pump around system and a temporary diversion will be used. [15A NCAC 02H .0502(a)(4)] 

2. The application indicates that 830 linear feet of stream was identified within the project area and that 700 linear 
feet of impact is proposed. Project plans appear to show impacts to all stream length within the project area. 
Please clarify where 130 linear feet of stream is not proposed to be impacted. [15A NCAC 02H .0502(a)(4)] 

Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the 
proper consideration of the application. Please provide your response by March 24, 2023. If all of the requested 
information is not received, the Division will be unable to approve the application and it will be denied as incomplete. 
The denial of this project will necessitate reapplication to the Division for approval, including a complete application 
package and appropriate fee.
