During the pre -review process, the Division noted that the following items were missing from the submitted application package: 1. The Applicant, Equity Life Style Properties, Inc. is not the current Permittee, which is MCH TT, L.P. We cannot process the submitted major modification request without an accompanying Change of Ownership / Name Change application. You may download the Non - Discharge Permit Ownership / Name Change Application (FORM: NDPONC 06-16) at our website. 2. Please remove the Authorization to Construct (FORM: ATC-12-14) from the application package. This form is for NPDES permits only. Application Item L3 and the Applicant's Certification how Andy Boswell as the signature authority. Pursuant to 15A NCAC 02T .0106(b)(1), the request for the permit modification shall be signed by a principal executive officer of at least the level of vice-president or his authorized representative. If an authorized representative is to be used, pursuant to 15A NCAC 02T .0106(c), delegation of authority to sign permit applications to other authorized employees or any employee in a specific position shall be provided in writing to the Division and signed by a principal executive officer of at least the level of vice-president. 4. Please complete Wastewater Irrigation Systems (FORM: WWIS 06-16) Application Items IIL3, IIL4, IVA, V.1, VI.8, VL12, and VIL7. 5. Pursuant to 15A NCAC 02T .0504(f) and Application Instruction D, submit documentation demonstrating the Applicant's ownership of the proposed wastewater treatment, storage, and irrigation facilities. Please note that review of the Davie Count, GIS shows that neither the Applicant (Equity LifeStyle Properties, Inc.), nor the Permittee (MCH TT, L.P.) is the property owner. Please address. Pursuant to 15A NCAC 02T .0507 and Application Instruction N, submit an operation and maintenance (O&M) plan encompassing all wastewater treatment, storage and irrigation systems that shall include at a minimum a description of: ➢ Operation of the wastewater treatment, storage, and irrigation systems in sufficient detail to show what operations are necessary for the system to function and by whom the functions are to be conducted. ➢ Anticipated maintenance of the wastewater treatment, storage, and irrigation systems. ➢ Safety measures, including restriction of access to the site and equipment. ➢ Spill prevention provisions such as response to upsets and bypasses, including how to control, contain and remediate. ➢ Contact information for plant personnel, emergency responders and regulatory agencies. 8. Pursuant to 15A NCAC 02T .0504(i), .0508, and Application Instruction O, submit a Residuals Management Plan that shall include at a minimum: ➢ A detailed explanation of how generated residuals (including trash, sediment, and grit) will be collected, handled, processed, stored, treated, and disposed. ➢ An evaluation of the treatment facility's residuals storage requirements based upon the maximum anticipated residuals production rate and ability to remove residuals. ➢ A permit for residuals utilization or a written commitment to the Applicant from a Pennittee of a Department approved residuals disposal/utilization program that has adequate permitted capacity to accept the residuals or has submitted a residuals/utilization program application. ➢ If oil/grease removal and collection are a designed unit process, submit an oil/grease disposal plan detailing how the oil/grease will be collected, handled, processed, stored and disposed. 9. Pursuant to 15A NCAC 02T .0I05(c)(10) and Application Instruction P, submit documentation from the Department's Natural Heritage Program demonstrating the presence or absence of threatened or endangered aquatic species within the boundary of the wastewater treatment, storage and irrigation facilities. If the facility directly impacts such species, this documentation shall provide information on the need for permit conditions pursuant to 15A NCAC 02B .0110. 10. Please note the Division will retain the $395 major modification fee under lock and key in anticipation of the resubmittal. 11. When resubmitting, please submit the original application and the above omitted materials as a single PDF at: https://edocs.deci.nc.eov/Forms/NonDischaree-Branch- Submittal-Form-Vert. Accordingly, the Division is returning your pennit major modification request as incomplete pursuant to 15A NCAC 02T .0107(b). The success of the Non -Discharge Branch's permitting process depends upon the receipt of complete and accurate applications and supporting documentation. Please amend the application package to include omitted items noted above and resubmit with the appropriate permit processing fee. When resubmitting, please submit the application electronically as a single PDF via the Non -Discharge online portal. Mr. Andy Boswell February 22, 2023 Page 3 of 3 Please be advised that construction and/or operation of the subject facilities without a valid permit is a violation of G.S. 143-215.1, and may subject you to appropriate enforcement actions pursuant to G.S. 143-215.6A., 613., and 6C. The Division may assess civil penalties of up to $25,000 per day per violation for failure to secure a valid permit.
