Attached are two more examples of basins in the Tar/Pamlico buffer. I have all my files from
my years as a field representative with the Division of Coastal Management. I went through
them friday afternoon and found a couple more boat basin examples, one from 2006 and one
from 2012 that went through the Major CAMA permit process. I got the DWR Project ID off
the note section of the major permit and looked them up on laserfiche. From 2006 the DWR
Project ID number did not match the file on laserfiche. I attached the 2006 example Major
CAMA/Dredge and Fill permit for your information. The DWR Project ID Number is found
in the note section on the last page of permit conditions. The project from 2012, I was able to
locate the file in Laserfiche and attached the DWR approval.
I know there are other examples out there, these are some I could find on my own without
going through a formal request to DWR or DCM. DWR staff had to have considered these as
a water dependent structure. Even the note section in the Major permit makes reference to
water dependent activities when noting that the project is in the Tar/Pam Basin subject to the
DWR buffer standards.
I hope the DWR review of the more information and project design changes is nearing
completion. If more examples like this will help Toby get a favorable decision in regards to
an upland boat basin as "allowable" as a water dependent activity/structure per the table of
uses, let me know as there are many more examples from both CAMA General Permits NCAC
7H.1500 and issued Major CAMA/Dredge and Fill permits.

As discussed during our January 10, 2023 meeting attached is a Buffer Authorization issued
to Mr. David Williams on September 23, 2022 by DWR staff Mr. Robert Tankard for a
house and new upland boat basin for a project located in Beaufort County on a
canal, subject to the Tar/Pamlico Buffer rule, off Chocowinity Bay near the City of
Washington on the Pamlico River. The purpose and need for this project is exactly the same
as Mr. Tetterton's current project with the exception that Mr. Tetterton's project does not
include any impervious surface in the buffer. The canal for the Willams Project was narrow
so to maintain navigation in the canal an upland boat basin was designed and permitted.
Please take the time to review William's BA and it's conditions. I submit this to you to
support a similar decision regarding Mr. Tetterton's request to undertake upland excavation
in a man made canal for the purpose of mooring vessels while maintaining navigation. The
thought process and project evaluation per the "Table of Uses" of the "William's Project"
had to have considered an upland boat basin as a water dependent structure.
I hope the EMC meeting last week was productive. I look forward to DWR's response to the
materials provided during our January 10, 2022 meeting regarding Mr. Tetterton's project so
that we can get his project moving again through the Major CAMA/Dredge and Fill permit
process.

Thanks for the follow up ... just wanted to make sure that we were all squared away
because several of our folks might be travelling.
I have cc'd all of the DWR staff who will be attending so that your team can reach out
to the group. I'm not sure what the volume of information is that your team would be
circulating on Monday PM or Tuesday AM, but we will do our best to review the
materials prior to the meeting. However, I am personally in meetings from 9am-2pm on
Tuesday (and then would be driving from Raleigh to the meeting) and know that some
of our staff are similarly situated. Asa result, I just want to make sure that we all
understand that some or all of the DWR team may not have had an opportunity to fully
review the materials prior to the meeting. If that is a concern, then please let me know
and I can provide DWR's availability for the following week. With respect to
scheduling next week, a big conflict for some of our folks is the EMC meetings on
Wednesday and Thursday.
I understand the urgency and would like to meet ASAP, but I also want to be respectful
of everyone's time and to make sure that this meeting is as efficient/productive as
possible. I am happy to discuss scheduling/logistics with you if helpful and my
immediate availability for a call is: Sunday afternoon from 1-3 and Monday from 8--10
and 121.

I'm following up regarding DWR availability for a meeting —feel free to respond via
email or call me during the placeholder time set for today at 4.
If there is a preference for an in -person meeting (in Washington Regional Office), then
the earliest time (and only time next week) that seems to work for our team is Monday,
January 9th at 2pm. We would have folks coming from Raleigh and Wilmington.
If the flex option (some remote and some in person) is preferable, then the availability
next week opens up to include Monday, January 9th: 15 and Tuesday, January loth: 1
2 and 45.
If none of those times work well for your team, then I can circle back to provide
DWR's availability for the weeks of January 17th-20th and January 2327th
