PROJECT DESCRIPTION: The project site is located at 841 Inlet View Road, adjacent to the Atlantic Intracoastal Waterway (AIWW) to the east and Shinn Point Canal to the south, in New Hanover County. The approximately 0.91-acre lot has approximately 342' of shoreline frontage stabilized by a wooden bulkhead on the eastern and southern sides. The lot is approximately 4' above Normal High Water (NHW). The high ground portion of the property is an unbuilt upon lot that consists of lawn grass, oak trees, and ornamental landscaping. The property is bordered by a single-family residence under construction to the north (authorized under CAMA Minor Permit 22-56) and the applicant's single-family residence to the west. An existing two slip docking facility extends east from the wooden bulkhead towards the AIWW. The facility was authorized by CAMA General Permit 32540D on 9/25/2002. The General Permit authorized the rearrangement of an existing facility to include a 16'xi6' two-story platform, a 10' wide by 24' long floating dock, and boat lift on the south side of the floating dock. The floating dock and portion of the boat lift appear to currently encroach into the USACE AIWW setback. No permit history was found for the wooden bulkhead, but it appears to predate Google Earth aerial image history. There are remnant pilings adjacent to the southern side of the property in the area of the proposed project. It appears, through Google Earth aerials, that some sort of docking facility existed on the southern side of the property within Shinn Creek Canal predating 1993 until 2007. No permit history was found. In the area of the remnant pilings there is approximately 60' of what appears to be concrete remnants of an old bulkhead immediately waterward of the existing bulkhead that is exposed at low tide. The concrete blocks have live oysters growing on them. The agent has stated the applicant is willing to relocate the oysters if requested by the resource agencies reviewing this proposal (See attached DCM Provided Photo 1 of 2 and 2 of 2). An old rock jetty extends approximately 90' from the southeast corner of the property parallel with the northern side of where Shinn Creek Canal intersects the AIWW. No permit history was found, but it appears to predate Google Earth aerial image history. The entire Shinn Point Canal appears to have been created in 1975 under State Permit 167-75 (See application materials for copy of permit and permit application). State Permit 167-75 authorized the creation of a 2,700' long canal with varying widths of40' and 60' to a depth of -12' MLW as well as 1,550 linear feet of bulkhead (See Page 1 of 2 and Page 2 of 2 of"Sound View Estates" in application materials). The canal is currently maintained under active State Permit 146-95 which authorized the access channel to connect to the depth of -6.5 MLW. There have been numerous maintenance events to maintain the access channel. The Wilmington -New Hanover County Land Use Plan classifies the area as Conservation. The waters in this location are classified as SA by the Division of Water Resources. The area is designated as a Primary Nursery Area (PNA) by the Division of Marine Fisheries and is CLOSED to the taking of shellfish. 10. PROPOSED PROJECT: The applicant proposes to remove an existing floating dock and boat lift, excavate an upland basin stabilized by a bulkhead adjacent to a man-made canal, install a floating dock, and dredge the existing canal to -8' NLW for the creation of two potential slips. The applicant proposes to remove the existing floating dock and boat lift at the existing docking facility which would remove structures from the USACE AIWW 80' setback as well as meet City of Wilmington Ordinances in regard to docking facility square footage. The applicant proposes to excavate a 100' long by 10' wide portion of highground on the southern portion of the property that exists landward of the current bulkhead to a depth of -8' NLW. The newly created basin would be stabilized by a 2' wide steel bulkhead that would run 100' long with 10' long wing walls on the eastern and western ends to connect with the existing bulkhead (See Sheet 1 of 5). Worden, Page 3 The proposal also includes plans to excavate to connect the newly created upland basin with the existing Shinn Point Canal. A 110' long by 40' wide area would be excavated, connecting the created upland basin with the existing Shinn Point Canal dredge footprint. A 100' long by 20' wide area within the existing Shinn Point Canal footprint would connect to the AIWW. The applicant proposes to increase the depth of Shinn Point Canal adjacent to the subject property to -8' NLW within the existing Shinn Point Canal dredge footprint to connect to the -8' NLW contour as it extends towards the AIWW (See Sheet 2 of 5). Written approval from the Shinn Point HOA is provided with the application materials. The spoil material would be trucked offsite to a 40' x 40' upland area, located outside of any Areas of Environmental Concern, located at 729 Piner Road. Written permission from the property owner of 729 Piner Road for spoil placement is provided with the application materials. According to application materials, water depths in the area currently range from -1.5' just waterward of the existing bulkhead to -15' approximately 10' beyond the waterward extend of the jetty as the canal intersects the AIWW. The application states average depth of the canal in front of the subject property is approximately -5.5' NLW. Based on current water depths taken by DCM on 2/16/2023, the average depth of the canal waterward of the subject property appears to be -5' NLW. The -8' NLW contour appears to be located approximately at the waterward end of the existing rock jetty. The last approximately 10' of open water area in the proposal at the mouth of the previously authorized access channel footprint is below -8' NLW. The applicant is proposing to maintain the authorized footprint at a connecting depth of -8' NLW due to shoaling that occurs within the access channel. The application also states the applicant's boat draws 6' or more. In addition, extending east from the western wing wall of the newly created upland basin would be a ramp that would lead to a 68' x 8' floating dock that would accommodate up to two formalized boat slips in the newly created upland basin (See Sheet 1 of 5). 11. ANTICIPATED IMPACTS: The proposed excavation would result in 1,000 sq. ft. of high ground excavation and 6,400 sq. ft. of bottom substrate excavation within the previously dredged canal. As proposed, the basin, canal, and access channel would be excavated to the connecting depth of -8' NLW. Approximately 120 sq. ft. of live oysters are currently located within the proposed excavation footprint. The approximate 6,400 sq, ft. of spoil will be placed on an upland location at 729 Piner Road. The proposed docking facility would incorporate 544 sq. ft. of created Estuarine and Public Trust Area. Minor increases in turbidity should be expected during excavation. Shoreline length = +/- 342 ft. x 8 sq. ft. = 2, 736 sq. ft. allowable (800 sq. ft. allowable per City of Wilmington) Existinp-: Fixed pier (132' x 6') = 792 sq. ft.
